These Terms of Use ("Terms") govern your use of the MIgraine Companion mobile application ("the App"). By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.
These Terms constitute a legal agreement between you (the user of the App) and Iuldashov Rustam Muhiddinovich ("we," "us," or "the Developer"), the owner and operator of MIgraine Companion. You must also follow any applicable rules or policies of the platforms from which you download the App (such as Apple App Store or Google Play Store), but these Terms apply specifically to your use of the App itself.
To use MIgraine Companion, you must log in via a third-party account (Google or Apple). You are responsible for maintaining the security of your login credentials for those accounts. Please ensure that your account information is accurate and current. You agree that you will not share your App access with others or allow others to use the App while logged in with your credentials.
By using a Google or Apple account to sign in, you also agree to abide by those services' terms of service. If your third-party account is disabled or otherwise unavailable, you may lose access to the App until you can log in with a valid account. We are not responsible for any issues arising from third-party account management.
You should secure your device and your third-party login (for example, with strong passwords and two-factor authentication) to prevent unauthorized access. If you suspect any unauthorized use of your App account, please log out and re-authenticate. We are not liable for any loss or damage arising from unauthorized access resulting from your failure to secure your account.
Each user should use their own account to log in. Creating multiple accounts to abuse trial periods or other features is not allowed and may result in termination of your access.
The MIgraine Companion app offers extended features via a subscription model. Please review the terms below:
New users receive a one-time free trial for 7 days, granting full access to premium features. The trial starts upon activation. After 7 days, access is blocked unless a subscription is purchased.

All payments are processed via Google Play or Apple App Store. Subscriptions automatically renew unless cancelled in advance. Charges are made 24 hours before the next billing cycle starts.

After cancellation, the subscription remains active until the end of the current paid period.
The free trial is available only once per user. If you subscribe again after cancellation, you may be charged immediately without another trial, in accordance with platform policies.
We do not issue refunds, as users are offered a free trial to evaluate the service. For billing issues (for example, mistaken charges), please contact Apple or Google support. Refunds are subject to their policies and decisions.
We reserve the right to change subscription prices or plan options. If pricing changes, we will notify you in advance, and the new rates will apply starting from the next billing cycle.
Using the App and its premium features may require a stable internet connection for authentication and subscription verification. You are responsible for any internet or mobile charges you may incur while using the App.
We grant you a personal, non-transferable, non-exclusive, revocable license to use the MIgraine Companion App for your own personal, non-commercial use, subject to these Terms. All rights not expressly granted to you are reserved by us.
By using the App, you agree to the following:
You will use the App only for lawful purposes and will not use the App in any manner that violates any applicable laws or regulations.
You agree not to engage in any activity that could harm or disrupt the functioning of the App or the experience of other users. This includes:
Not attempting to circumvent security features
Not introducing malware or malicious code
Not attempting to gain unauthorized access to any systems or accounts
You will not use the App to collect information on others without authorization. The App is intended for tracking your personal health data. You should not input information about others unless you have legal authority (for example, a parent recording for a minor child with appropriate consent).
You may not reproduce, duplicate, copy, sell, trade, or resell the App or any of its content or code for any commercial purpose. You may not rent, lease, lend, or sublicense the App to anyone else.
You will not reverse engineer, decompile, or disassemble the App, or attempt to derive the source code of the software, except to the extent that such activity is expressly permitted by applicable law. You will not remove or alter any copyright, trademark, or other proprietary notices in the App.
If the App allows you to input text, images, or other content (for example, notes about your condition), you retain ownership of that content. However, you are solely responsible for ensuring that any content you input does not violate any laws or rights of third parties. You must not input content that is defamatory, obscene, infringing, or otherwise objectionable.
Violation of any of the above conditions may result in the suspension or termination of your right to use the App, at our discretion.
All intellectual property rights in and to the MIgraine Companion App, including but not limited to the app name, logo, design, software code, features, characters (including "Mi"), and content provided by us are the property of Iuldashov Rustam Muhiddinovich and are protected by copyright, trademark, and other intellectual property laws.
"MIgraine Companion" and any related logos, characters, or graphics are trademarks or service marks owned by the Developer. You are not granted any right or license to use these marks.
Except for the limited license to use the App under these Terms, you are not granted any ownership of or rights to any intellectual property in the App or associated content.
If you choose to provide feedback, suggestions, or ideas regarding the App, you agree that we may use your feedback freely and incorporate it into the App without any obligation to compensate you. You grant us a perpetual, irrevocable, royalty-free license to use the feedback you provide.
Unauthorized use of our intellectual property is prohibited. You may not copy or distribute any part of the App or content without our prior written permission, except as allowed by law or these Terms.
⚕️ Important: MIgraine Companion is not a medical or healthcare provider, and the App is not a substitute for professional medical advice, diagnosis, or treatment. The content and features in the App are for informational and tracking purposes only.
Any information, reports, or notifications you receive through the App (for example, identifying a pattern in your migraines or suggesting possible triggers) are not medical advice. Always seek the guidance of a qualified physician or other licensed healthcare provider with any questions you have regarding a medical condition or treatment. Never disregard professional medical advice or delay seeking it because of something you have read or tracked in the App.
The App is not a medical device and is not approved by regulatory authorities (such as the FDA or other medical device regulators) for the diagnosis or treatment of diseases. It is a self-management tool intended to assist you in tracking your personal health information.
The App's usefulness depends on the accuracy and completeness of the data you provide. We do not guarantee that any analysis or correlations provided by the App will be accurate or applicable to your specific situation. Any health-related information provided by the App is general in nature and may not be validated by medical science.
Your use of the App does not establish a doctor-patient or healthcare provider-patient relationship between you and us. The Developer is not a licensed medical professional.
Do not use the App in a medical or psychiatric emergency. The App cannot contact emergency services. If you think you may be experiencing a medical emergency, call your local emergency number immediately.
You assume full responsibility for how you use the information generated by the App. We are not responsible for any decisions you make regarding your health or for any consequences that arise from those decisions.
To the fullest extent permitted by law, Iuldashov Rustam Muhiddinovich (the developer of MIgraine Companion) shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or relating to your use of the App or these Terms.
This includes, but is not limited to, any loss of data, health issues, personal injury, pain and suffering, emotional distress, or other damages that result from:

Our total cumulative liability to you for any claims arising out of or relating to the App or these Terms will not exceed the amount that you have paid to us for the use of the App in the 12 months immediately preceding the claim. If you have not made any payments to us, then we owe you no damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. If laws applicable to your use of the App do not allow such exclusions, the above limitations may not apply to you fully. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind (express or implied) including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
You may stop using the App at any time by simply deleting it from your device.
We reserve the right to suspend or terminate your access to the App (including your subscription) at any time, with or without notice, if you violate these Terms or if we determine that it is necessary for security or legal reasons. If we terminate your access due to a breach of these Terms, you will not be entitled to any refunds.
Upon termination of your rights under these Terms, you must cease all use of the App and remove it from your devices.

We may update or modify these Terms of Use from time to time. When we do, we will update the "Last updated" date at the bottom of this document.
In the event of a significant change to the Terms, we will make reasonable efforts to notify you — for example:

If you continue to use the App after updated Terms have been posted, you are indicating that you accept and agree to the revisions. If you do not agree to the new Terms, you must stop using the App.
These Terms of Use and any disputes arising out of or relating to these Terms or the App shall be governed by and construed in accordance with applicable international laws and the laws of the jurisdiction where the Developer resides.
We reserve the right to resolve any disputes through alternative dispute resolution mechanisms such as arbitration or mediation, in accordance with applicable laws.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
