These Terms of Use (“Terms”) govern your use of the MigrainePhase app, developed by Sayra Tasmin Rabita (“we,” “us,” or “our”). By downloading or using MigrainePhase, you agree to these Terms.
If you downloaded MigrainePhase from Apple’s App Store, Apple’s standard Licensed Application End User License Agreement also applies. Where applicable, these Terms govern your use of MigrainePhase to the extent permitted by law.
MigrainePhase is a personal tracking and journaling tool designed to help you record migraine and headache events, symptoms, medications, and potential patterns in your own records.
MigrainePhase is not a medical device and does not provide medical advice.
The app does not:
Diagnose medical conditions
Recommend medications, treatments, or dosages
Predict or prevent migraine or headache attacks
Replace professional medical care
Provide emergency medical services
Any patterns or insights displayed by the app are based only on information you enter and should be understood as observations or possible associations, not medical conclusions.
Always consult a qualified healthcare professional regarding your symptoms, medications, diagnosis, and treatment. Do not delay, stop, or change medical care because of information displayed in MigrainePhase.
MigrainePhase is not intended for emergency use. In an emergency, contact your local emergency services or seek appropriate medical attention.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable licence to use MigrainePhase on Apple devices that you own or control, in accordance with Apple’s App Store terms.
You may not, except where applicable law permits:
Copy or redistribute the app
Sell, rent, lease, or sublicense the app
Modify or alter the app
Reverse-engineer, decompile, or disassemble the app
Create derivative works based on the app
Attempt to interfere with the app’s operation or security
All rights not expressly granted to you remain with us or our applicable licensors.
Information you enter into MigrainePhase remains your responsibility.
As described in our Privacy Policy, your migraine and headache records are stored locally on your device rather than on our servers.
Because we do not maintain a copy of your health records:
We cannot restore your records if your device is lost, damaged, reset, or replaced.
Deleting the app may permanently remove locally stored app data.
You are responsible for maintaining any backups you consider necessary.
You are responsible for any reports or exports that you choose to create or share.
You should only share exported reports or other information with people or services you trust.
MigrainePhase may offer optional paid features through a MigrainePhase Pro subscription.
Core logging functionality remains available without a subscription. Pro features may include additional functionality such as extended history, pattern analysis, and doctor reports.
Subscription terms include the following:
Payment is charged to your Apple ID account when you confirm your purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period.
Renewal charges are made within 24 hours before the end of the current subscription period.
The renewal price is the price displayed to you at the time of purchase, subject to applicable Apple and App Store terms.
You can manage or cancel your subscription through your Apple account or App Store subscription settings.
Deleting MigrainePhase does not automatically cancel an active subscription.
If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the trial period ends.
Any unused portion of a free trial may be forfeited when you purchase a subscription, where permitted by applicable terms.
Eligible purchases may be restored on another device using the app’s Restore Purchases functionality.
Refund requests are handled by Apple according to Apple’s applicable App Store policies.
If your Pro subscription ends, your existing logged data remains yours. Features available under the free version may continue to be accessible, subject to the app’s current functionality.
You agree to use MigrainePhase only for lawful and personal purposes.
You must not:
Use the app for unlawful activities
Attempt to disrupt or compromise the app
Attempt to gain unauthorized access to the app or related services
Abuse or interfere with third-party services used by the app
Use automated methods to interfere with the normal operation of the app
MigrainePhase may rely on third-party services, such as Apple’s App Store, RevenueCat for subscription management, and Open-Meteo for optional weather information.
Third-party services may have their own terms, policies, availability, and limitations.
Weather information provided through third-party services may be unavailable, delayed, incomplete, or inaccurate. We are not responsible for the availability or accuracy of third-party services.
MigrainePhase is provided “as is” and “as available”, to the maximum extent permitted by applicable law.
We do not guarantee that:
The app will always be available or uninterrupted.
The app will be free from errors or defects.
Information displayed by the app will always be accurate or complete.
Weather information will always be available or accurate.
The app will meet every individual user’s requirements.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits any rights or protections that cannot legally be excluded under applicable law.
To the maximum extent permitted by applicable law, Sayra Tasmin Rabita will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, MigrainePhase.
This includes, where permitted by law, loss of data or other losses resulting from your use of the app.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Some jurisdictions do not permit certain limitations of liability, so some provisions of this section may not apply to you.
We may update MigrainePhase and these Terms from time to time.
If we make a material change to these Terms, we will update the effective date and may provide notice through the app or its release notes.
Your continued use of MigrainePhase after an updated version of these Terms becomes effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
You may stop using MigrainePhase at any time by deleting the app from your device.
We may terminate or suspend your licence to use MigrainePhase if you materially violate these Terms, subject to applicable law.
Termination does not affect any rights or obligations that, by their nature, should continue after termination.
