What is FOIA?
The Freedom of Information Act in Michigan, established under Public Act 442 of 1976, grants the public the right to access records from state and local government agencies to ensure transparency. Any person, except incarcerated individuals, can request public records, which must be provided within five business days, though agencies may extend this period by ten additional days if necessary. While certain records, such as those related to personal privacy, ongoing investigations, or trade secrets, may be exempt, all other documents must be disclosed unless a legal exemption applies. Agencies can charge reasonable fees for searching, reviewing, and copying records. If a request is denied, the agency must provide a written explanation, and requesters have the right to appeal.
