Terms of Service Agreement

Once you purchase an adoptable or custom from me, you automatically agree to my terms of service. 

I only sell digital art goods. These rules apply to anyone purchasing my products or services

You acknowledge and accept that by purchasing an adoptable or custom from my online store, you confirm you are 18+ years old, and have read and agree to these Terms of Service in its entirety,

You are aware you will receive a digital product(s)

Payment

You must be 18+ years old to purchase and own my designs.

Payment currency is always USD or EUR. Sales tax is already applied to the amount 

You can contact me through private messages to purchase / bid privately.

⇢ Payment must be made within 24 hours. No holds.

⇢When transaction is completed through the ko-fi platform, the buyer will receive adoptable image file(s) and commercial usage rights to the design. 

You are responsible for saving and backing up your files. I normally save all the files of my designs however there is no guarantee I will retain your file(s) after a long period of time due to limited storage. Please be sure to backup your files.

If you are purchasing using  someone else's money/credit or debit card. You will need to inform me first and show proof that this transaction is approved by all parties.

If you claim an adoptable but I do not hear explanation / response from you for 24 hours, the design will be for sale again.

Edits & Credit

⇢You are allowed to make any change to the adoptable such as gender, colors, clothes, etc. 

You are allowed to edit the adoptable if you`re the owner, but please keep the original files available of your adoptable.

⇢You are allowed to resell, gift or trade your adoptable. 

[IMPORTANT] For reselling an adopt: Reselling can be done for my adopt designs however I request that you please make the price fair for others.

Keep in mind: I will not be responsible for any failed/unsuccessful transactions between users.

⇢After purchasing a design, you are allowed to repost, please give me credit for the original artwork and design.

Usage rights

⇢You are allowed to use the adoptable design for commercial use.  Please give me credit for the original artwork and design. Do not use my art for AI training or merch sales. You own the rights to the adoptable but not to my art itself.

⇢You are buying the rights to USE the ADOPTABLE DESIGN for vtubing, visual novels, stories, animations, videogame,etc.

Prohibited Usage

Final Sales

⇢All sales are strictly final sales, once you make your purchase, I do not provide refunds / exchanges.

⇢I hold partial rights to all designs sold, I reserve the right to ban/redistribute ownership of my designs for anyone who breaks the Terms of Service. 

Design revocation will only affect buyers who file chargebacks.

I have the right to take back full ownership of an adoptable or custom in the case of chargebacks. 

⇢In case of chargebacks on an adoptable or custom you purchased: I have the right take back full ownership of the adoptable / custom design from you. You will be publicly blacklisted and banned permanently from obtaining a design from me. This applies to any adoptable or custom bought. I can keep the design and resell this design to others.

 I also have every right to file a complaint and I have all the right to the money you have given me.

Payment Plans

⇢ Payment plans can be offered, please communicate with me first so it can be discussed.

Payment is taken in USD/EUR. The payments will be through my ko-fi page.

Depending on the adoptable price. I will ask you to pay a down payment first.  Please communicate with me about the payments.

Timeframe of payment plans should be 4 weeks maximum.

If you cannot finish the payment plan, please let me know, the payments (including down payment) will not be refunded.

Please keep in mind that the character does not belong to you until the full payment is completed.

Please do not announce, post, or order commissions about the character until the payment plan is complete.

Copyright

⇢I own full copyright of my artwork. 

Do not trace, recolor, heavily reference, edit, copy any of my artwork / designs. You are not allowed to make profit off my artwork unless an agreement has been made.

I have the right to use my artwork for any reason ⇢ such as portfolio purpose, designs sample, sample of commissions, promotions and for other social media.

I retain partial rights over every design that is sold, which means I have the right to showcase my designs in my website, portfolio, social media,etc.

I do not consent to having any of my artwork and/or adoptable designs to be used for AI learning and AI training. I do not consent to having any of my art used in anything involving AI. 

 Terms of Service Agreement

By purchasing an adoptable, you acknowledge you have read and agree to these terms of service in its entirety. 

I am not responsible from any consequences resulting from failure to read the Terms of Service.

 If you transfer ownership of your adoptable, the new owner has to read and agree to these terms of service. These terms of service are subject to change without notice at any time. You have the responsibility to follow and respect them.

Failure to comply with the Terms of Service can lead you to be blacklisted.
