Terms of Use — Merit

1. Purpose
These terms of use govern the use of the Merit app, a focus timer published by PeakLabz ("the publisher"). By downloading or using the app, you agree to be bound by these terms.
2. Acceptance
By using the app, you acknowledge that you have read, understood, and accepted these terms. If you do not accept these terms, please do not use the app.
3. License to Use
The publisher grants you a personal, non-exclusive, non-transferable, and revocable license to use the app for strictly personal and non-commercial purposes. This license does not transfer to you any ownership rights in the app.
4. Premium Subscriptions
The app offers optional Premium subscriptions, on a monthly or annual basis, with prices shown within the app. A 7-day free trial may be offered where applicable. Subscriptions renew automatically at the end of each period unless cancelled. Billing is processed through the App Store (Apple) or Google Play (Google), depending on your platform. Subscription management and cancellation are handled in your account settings with the relevant store. Premium access rights are managed via the RevenueCat service. No refund can be granted by the publisher outside the applicable store policies.
5. Free Trial
Where a free trial is offered, it gives you access to Premium features for the stated duration (for example, 7 days). If you do not cancel before the end of the trial period, it automatically converts into a paid subscription, billed through your store. You may cancel at any time before the end of the trial from the subscription settings of your App Store or Google Play account, without being charged.
6. Intellectual Property
The Merit app, together with the brand, name, logo, visuals, texts, graphic elements, and code that make it up, are the exclusive property of the publisher and are protected by applicable intellectual property laws. Using the app grants you no ownership rights over these elements. Any reproduction, modification, distribution, or exploitation, in whole or in part, without the publisher's prior written authorization, is prohibited. Any other trademarks or names mentioned remain the property of their respective owners.
7. Content & Acceptable Use
You agree to use the app in accordance with the law and these terms. In particular, you are prohibited from: decompiling, disassembling, or reverse-engineering the app; circumventing or attempting to circumvent protection or payment measures; using the app in an abusive, fraudulent manner or in a way likely to disrupt its operation; or exploiting the app for unauthorized purposes.
8. Warranties & Liability
The app is provided "as is" and "as available," without warranty of any kind, express or implied. The publisher does not warrant that the app will be error-free or available without interruption. The statistics and information displayed are provided for indicative purposes only. To the extent permitted by law, the publisher shall not be liable for any indirect damages arising from the use of, or inability to use, the app.
9. Termination
The publisher reserves the right to suspend or restrict your access to the app in the event of a breach of these terms. You may stop using the app at any time; cancellation of any Premium subscription is carried out via your account settings with the relevant store, in accordance with Section 4.
10. Changes to the Terms
We may update these terms at any time, in particular to reflect changes to the app, its features, or applicable law. In the event of a significant change, we will notify you by an appropriate means within the app before the new terms take effect. The applicable version is the one in force at the time you use the app. By continuing to use Merit after the changes take effect, you accept the updated terms.
11. Governing Law & Disputes
These terms are governed by the laws of France, without prejudice to the mandatory consumer protection rules applicable in the user's country of residence. Any dispute relating to their validity, interpretation, or performance falls under the jurisdiction of the courts of Paris, subject to any mandatory venue provided by law. Subscription purchases made through the App Store or Google Play are also subject to Apple's and Google's terms.
