By using Melogen (the "App"), you agree to these Terms. If you do not agree, you must not use the App.
Melogen generates music, and where applicable lyrics, using artificial intelligence in response to open-ended user prompts. Because of the nature of AI-generated content, the App is intended for users who are at least 13 years old. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
Phebsoft grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use Melogen for its intended purpose.
You agree not to:
Reverse engineer, decompile, or attempt to extract the source code of the App
Use the App to build or train competing products or services
Misuse the App in any way that could harm its functionality or availability
Submit inputs to, or use outputs from, the App for any unlawful, infringing, or harmful purpose
Melogen is a tool that generates music, and where applicable lyrics, in response to the inputs you provide (such as genre, mood, style, or lyric prompts). You direct what is created; the App produces a result based on your inputs.
Lyrics Generation: Where you choose to generate lyrics, your prompt may be processed by OpenAI. You should review OpenAI's Privacy Policy at https://openai.com/policies/privacy.
Music Generation: Music is generated using a third-party open-source AI model (ACE-Step) operated on our infrastructure.
Important — AI output and copyright: AI music generation can produce output that resembles existing copyrighted works, including in melody, style, arrangement, or lyrics. Phebsoft does not monitor, review, or store your inputs or your generated outputs, and cannot determine whether any given output resembles protected material.
You are responsible for how you use the music you generate — including any decision to download, publish, distribute, perform, or monetize it — and for ensuring that your use complies with applicable copyright and other laws. As between you and Phebsoft, you accept this responsibility.
Phebsoft does not warrant that outputs are free from potential third-party rights, and provides no guarantee regarding the originality, ownership, or legal status of any generated content.
You may provide prompts, selections, or lyrics as input to the App.
You agree that:
You have the right to use any material (including any lyrics, references, or other content) that you submit as input, and that doing so does not infringe the rights of any third party
You will not submit unlawful, harmful, or infringing content
You are responsible for the content you provide
We are not responsible for outputs generated from your inputs
Melogen is offered through a single paid subscription.
Subscription: $49 per month, providing unlimited music generation and stem separation.
Fair-use limit: To maintain service quality and availability for all users, your combined use of music generation and stem separation is subject to a fair-use limit of 100 operations per day.
All payments are processed by the Apple App Store or Google Play Store. Their terms and conditions govern billing, renewals, and cancellations.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your App Store or Google Play account settings.
We do not control or process your payment information.
Refunds: All purchases are generally non-refundable unless required by applicable law or granted by the app store provider.
EU/UK Users (Right of Withdrawal): By purchasing and immediately using digital services, you expressly consent to immediate performance and acknowledge that you waive any applicable statutory right of withdrawal, where permitted by law.
All underlying technology, software, and AI models remain the property of Phebsoft and its licensors.
Phebsoft does not claim ownership of the content you generate using the App. This is not a warranty that you hold any particular rights in that content; it means only that Phebsoft asserts no ownership over it (see Section 3).
7. Changes to the Service
We are continually improving Melogen, and features or content may change over time. We may update, modify, suspend, or discontinue the App, or any feature or part of it, and may remove or delist content where necessary — for example, for legal, security, technical, or operational reasons.
Where a change is significant, we will make reasonable efforts to let you know. In some situations, such as legal or security requirements, we may need to act without prior notice.
Any music you have already saved to your device remains yours — changes to the App do not delete the files you have already created.
Melogen does not provide user accounts.
Generated files are stored locally on your device. We do not keep a copy on our servers and cannot recover or restore your files for you if they are lost or deleted.
Whether your files remain after the App is uninstalled depends on your device and platform. Please refer to our Privacy Policy for details.
You are responsible for maintaining access to your device and data, and for backing up any files you wish to keep.
Melogen relies on third-party services (including OpenAI, the ACE-Step model, and app stores) to function.
We are not responsible for interruptions, errors, or issues caused by third-party services.
Your use of such services may also be subject to their terms and policies.
Melogen is provided on an "as is" and "as available" basis. While we strive to ensure smooth operation and high-quality AI-generated content:
The App may occasionally experience minor interruptions or errors.
AI-generated music and lyrics are provided for creative and entertainment purposes.
Generation times may vary depending on device performance, network conditions, and server load.
To the maximum extent permitted by law, Phebsoft shall not be liable for:
Indirect, incidental, or consequential damages
Loss of data, files, or generated content
Dissatisfaction with AI-generated outputs
Service interruptions or unavailability
To the maximum extent permitted by law, Phebsoft's total aggregate liability arising out of or relating to the App or these Terms shall not exceed the total amount you paid to Phebsoft (through the applicable app store) in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
These Terms shall be governed by and construed in accordance with the laws of Pakistan.
If you are a consumer in a jurisdiction with mandatory consumer protection laws (such as the EU or UK), those laws and rights will apply to the extent required.
We may update these Terms from time to time. When material changes occur, we will notify you within the App, and your continued use after notification constitutes acceptance of the updated Terms.
