# Terms of Service for MailCode

## 1. Acceptance of Terms
By downloading, installing, or using **MailCode** ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MailCode ("we," "us," or "our").

## 2. Description of Service
### 2.1 What MailCode Does
MailCode is a mobile application that allows you to:
- Access and manage your Gmail emails
- Create and use HTML email templates
- Send emails with dynamic variable substitution
- Store and sync email templates across devices
### 2.2 What MailCode Does NOT Do
- ❌ We do not read, analyze, or use your email content for any purpose other than displaying it to you
- ❌ We do not send marketing emails or spam
- ❌ We do not sell your data to third parties
- ❌ We do not store your Gmail messages on our servers (only locally on your device)

## 3. User Eligibility
### 3.1 Age Requirement
You must be at least **13 years old** to use MailCode. If you are under 18, you must have parental or guardian consent.
### 3.2 Account Requirements
- You must have a valid Google account
- You must have an active Gmail account
- You are responsible for maintaining the security of your account

## 4. User Responsibilities
### 4.1 Acceptable Use
You agree to use MailCode only for lawful purposes. You will NOT:
- ❌ Send spam, phishing emails, or unsolicited bulk emails
- ❌ Violate any laws or regulations
- ❌ Infringe on intellectual property rights
- ❌ Transmit viruses, malware, or harmful code
- ❌ Harass, threaten, or harm others
- ❌ Impersonate any person or entity
- ❌ Attempt to hack, reverse engineer, or exploit the App
### 4.2 Gmail Policy Compliance
You must comply with:

- [Google API Services User Data Policy](https://developers.google.com/terms/api-services-user-data-policy)
- [CAN-SPAM Act](https://www.ftc.gov/business-guidance/resources/can-spam-act-compliance-guide-business) (if sending commercial emails)
### 4.3 Your Content
- You retain ownership of all email templates and content you create
- You grant us a license to store and sync your templates on our servers (Supabase)
- You are solely responsible for the content of your emails

## 5. Prohibited Activities
You agree NOT to:
### 5.1 Abuse the Service
- Send more than 500 emails per day (Gmail's limit)
- Use automated scripts or bots
- Create multiple accounts to bypass limits
### 5.2 Violate Third-Party Rights
- Use copyrighted material without permission
- Use trademarked logos or brand names without authorization
- Violate privacy rights of others
### 5.3 Illegal Activities
- Send illegal content (child abuse, terrorism, etc.)
- Engage in fraud or scams
- Violate export control laws
**Violation of these terms may result in:**
- Immediate termination of your access
- Reporting to law enforcement
- Legal action

## 6. Intellectual Property
### 6.1 MailCode's IP
- The App, its design, code, and features are owned by MailCode
- "MailCode" name and logo are our trademarks
- You may not copy, modify, or distribute the App without permission
### 6.2 Your IP
- You retain ownership of your email templates and content
- By using MailCode, you grant us a limited license to:
- Store your templates on our servers
- Display your templates in the App
- Sync your templates across your devices
### 6.3 Third-Party Licenses
MailCode uses open-source libraries. See `LICENSES.md` for details.

## 7. Privacy and Data
### 7.1 Privacy Policy
Our collection and use of your data is governed by our [Privacy Policy](PRIVACY_POLICY.md).
By using MailCode, you consent to our Privacy Policy.
### 7.2 Data Security
- We use industry-standard security measures (HTTPS, OAuth 2.0)
- We cannot guarantee 100% security (no system is completely secure)
- You are responsible for keeping your Google account credentials secure
### 7.3 Data Backups
- We do not guarantee backups of your email templates
- You should export and backup your templates regularly
- We are not liable for data loss

## 8. Third-Party Services
### 8.1 Google Services
MailCode relies on:
- **Gmail API:** To access your emails
- **Google Sign-In:** To authenticate you
You must comply with Google's terms:

### 8.2 Supabase
We use Supabase for backend storage. See [Supabase Terms](https://supabase.com/terms).
### 8.3 Third-Party Liability
- We are not responsible for third-party service outages
- Google or Supabase may revoke access at any time
- Changes to third-party APIs may affect MailCode functionality

## 9. Service Availability
### 9.1 No Warranty
MailCode is provided "AS IS" without any warranties:
- ❌ We do not guarantee 100% uptime
- ❌ We do not guarantee error-free operation
- ❌ We do not guarantee compatibility with all devices
### 9.2 Service Changes
We reserve the right to:
- Modify, suspend, or discontinue the App at any time
- Change features or pricing (currently free)
- Update these Terms with notice
### 9.3 Maintenance
- We may perform scheduled maintenance (with notice)
- Emergency maintenance may occur without notice

## 10. Limitation of Liability
### 10.1 No Liability for Damages
**TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:**
- ❌ Lost data, emails, or templates
- ❌ Business losses or lost profits
- ❌ Indirect, incidental, or consequential damages
- ❌ Damages caused by third-party services (Google, Supabase)
- ❌ User error or misuse of the App
### 10.2 Maximum Liability
If we are found liable, our total liability shall not exceed:
- **$50 USD** or
- **The amount you paid for the App** (whichever is less)
Currently, MailCode is free, so our liability is $0.

## 11. Indemnification
You agree to **indemnify and hold us harmless** from any claims, damages, or expenses arising from:
- Your use of MailCode
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Content you send via the App
**Example:** If you send spam and someone sues us, you agree to cover our legal costs.

## 12. Termination
### 12.1 By You
You may stop using MailCode at any time by:
- Signing out of the App
- Uninstalling the App
- Revoking Gmail access in Google Account settings
### 12.2 By Us
We may terminate your access immediately if you:
- Violate these Terms
- Engage in prohibited activities
- Abuse the service
### 12.3 Effect of Termination
Upon termination:
- You lose access to the App
- Your local data is deleted (when you uninstall)
- Your templates on Supabase may be deleted (after 30 days)

## 13. Dispute Resolution
### 13.1 Informal Resolution
Before filing a lawsuit, you agree to contact us to resolve disputes informally:

- **Response Time:** 30 days
### 13.2 Arbitration (US Only)
If informal resolution fails, disputes will be resolved through **binding arbitration** (not court):
- Arbitration in accordance with AAA rules
- Location: CANADA
- Each party pays their own costs
### 13.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action.
### 13.4 Governing Law
- **Jurisdiction:** QUEBEC
- **Language:** FRENCH

## 14. Changes to These Terms
We may update these Terms from time to time. We will notify you by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Sending a notification (for material changes)
**Your continued use after changes constitutes acceptance.**
If you do not agree to the new Terms, stop using the App.

## 15. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

## 16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MailCode.
They supersede any prior agreements or communications.

## 17. No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
