PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE APPLICATION.

By downloading, installing, accessing, or using AI Photo Enhancer - LumiPic (“LumiPic”, “Application”, “App”, “Service”, “we”, “us”, “our”), you agree to be legally bound by these Terms of Use (“Terms”).

If you do not agree to these Terms, you must immediately discontinue use of the Application.

1. DESCRIPTION OF THE APPLICATION

AI Photo Enhancer - LumiPic is an AI-powered mobile application that allows users to edit, enhance, transform, and process images directly on their devices.

Features of the Application may include, but are not limited to:

* AI-based photo quality enhancement;

* restoration of old or damaged photographs;

* black-and-white photo colorization;

* object removal from photos;

* background removal and replacement;

* image cropping and resizing;

* face editing features, including makeup effects, smile adjustments, lips, eyes, and facial appearance modifications;

* artistic and stylized templates including flowers, business style, cartoon conversion, and other visual transformations.

The Application is intended solely for lawful personal and non-commercial use unless explicitly authorized otherwise.

2. ELIGIBILITY

By using the Application, you represent and warrant that:

* you are legally capable of entering into a binding agreement;

* you are not prohibited from using the Application under applicable laws;

* you are at least the minimum digital consent age required in your jurisdiction;

* you possess all necessary rights to any content uploaded or processed through the Application.

If you are under the legal age required in your jurisdiction, you may use the Application only under parental or legal guardian supervision.

3. USER CONTENT

Users retain ownership of all photos, images, and content processed through the Application (“User Content”).

You are solely responsible for all User Content uploaded, edited, processed, generated, exported, or shared using the Application.

You represent and warrant that:

* you own the content you upload; or

* you possess all necessary permissions, licenses, and legal rights to use such content.

You may not upload, process, generate, store, distribute, or share any content that:

* violates copyrights, trademarks, or intellectual property rights;

* violates privacy or publicity rights;

* contains illegal, abusive, defamatory, threatening, hateful, violent, or discriminatory material;

* contains sexually explicit unlawful material;

* promotes harassment or illegal activities;

* impersonates another person without authorization;

* violates applicable laws or regulations.

The developer assumes no responsibility for User Content or consequences arising from its use.

4. AI-GENERATED RESULTS DISCLAIMER

The Application uses artificial intelligence technologies to generate, modify, enhance, restore, or transform images.

Users acknowledge and agree that:

* AI-generated results may be inaccurate;

* generated outputs may contain errors, distortions, unrealistic details, or unintended artifacts;

* facial modifications may alter appearance unpredictably;

* restored or colorized images may not accurately represent historical reality;

* cartoon or artistic transformations are fictional representations only.

We do not guarantee:

* factual accuracy;

* realism;

* historical correctness;

* identity preservation;

* visual consistency;

* suitability for professional, legal, medical, journalistic, forensic, or evidentiary purposes.

Users assume all risks associated with reliance on AI-generated results.

5. FACE EDITING AND IMAGE MANIPULATION

The Application includes tools capable of modifying facial appearance and image content.

You agree not to use the Application for:

* deepfake generation intended to deceive others;

* identity fraud;

* misinformation;

* political manipulation;

* harassment;

* revenge content;

* impersonation;

* unauthorized editing of third-party images;

* deceptive or malicious purposes.

Users are solely responsible for obtaining consent from individuals whose likenesses appear in edited images.

The developer bears no responsibility for misuse of face-editing or AI-manipulation features.

6. LOCAL PROCESSING AND STORAGE

The Application is designed to process images locally on the user’s device whenever technically possible.

We do not intentionally:

* store user images on developer-controlled servers;

* maintain permanent copies of uploaded images;

* archive user-generated content.

All exported images remain under the user’s control and responsibility.

Users acknowledge that temporary cache files, memory buffers, or operating-system-level temporary storage may exist outside the developer’s direct technical control.

7. NO GUARANTEE OF DATA PRESERVATION

Users are solely responsible for:

* backing up their images;

* protecting local device storage;

* exporting processed results;

* preserving important content.

We do not guarantee preservation, recovery, or restoration of:

* original images;

* edited images;

* generated outputs;

* project history;

* temporary processing data.

The developer shall not be liable for any loss, corruption, deletion, or alteration of images or files.

8. ACCEPTABLE USE

You agree not to:

* reverse engineer the Application;

* copy or replicate Application functionality;

* scrape or extract AI outputs at scale;

* use the Application to train competing AI models;

* bypass security or technical limitations;

* use automated bots or scripts;

* interfere with Application functionality;

* distribute malware or malicious code;

* use the Application for unlawful purposes.

Commercial exploitation of the Application or its outputs may require separate written authorization.

9. INTELLECTUAL PROPERTY

All Application-related materials, including but not limited to:

* software;

* AI models;

* algorithms;

* interface designs;

* visual effects;

* branding;

* templates;

* graphics;

* logos;

* application architecture,

remain the exclusive property of the developer or its licensors and are protected by intellectual property laws.

Nothing in these Terms grants users ownership rights to the Application itself.

10. THIRD-PARTY SERVICES

The Application may rely on:

* operating system services;

* app marketplaces;

* device hardware APIs;

* third-party libraries or frameworks.

We are not responsible for:

* third-party service interruptions;

* device incompatibility;

* operating system behavior;

* cloud backup systems;

* third-party data collection practices.

Use of third-party services may be subject to separate terms and privacy policies.

11. DISCLAIMER OF WARRANTIES

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

* MERCHANTABILITY;

* FITNESS FOR A PARTICULAR PURPOSE;

* NON-INFRINGEMENT;

* SECURITY;

* RELIABILITY;

* ACCURACY;

* AVAILABILITY.

We do not guarantee that:

* the Application will operate uninterrupted;

* the Application will be error-free;

* AI outputs will meet expectations;

* generated results will be accurate;

* all devices will be compatible;

* files will remain safe from corruption or loss.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

* loss of data;

* loss of images;

* corrupted files;

* emotional distress;

* reputational damage;

* identity misuse;

* unauthorized third-party use of images;

* AI inaccuracies;

* misleading AI-generated content;

* device malfunction;

* operating system failures;

* indirect damages;

* incidental damages;

* punitive damages;

* consequential damages;

* loss of profits;

* legal claims arising from user content or user conduct.

Users assume full responsibility for all use of the Application and all consequences arising from edited or generated content.

13. INDEMNIFICATION

You agree to indemnify and hold harmless the developer, affiliates, employees, contractors, licensors, and partners from any claims, liabilities, damages, losses, legal expenses, or costs arising from:

* your use of the Application;

* your violation of these Terms;

* your violation of applicable laws;

* content you upload, edit, distribute, or publish;

* misuse of AI-generated content;

* infringement of third-party rights.

14. TERMINATION

We reserve the right to suspend, restrict, or terminate access to the Application at any time without notice if we believe a user has violated these Terms or applicable laws.

Termination does not limit any legal rights or remedies available to the developer.

15. CHANGES TO THE TERMS

We reserve the right to modify these Terms at any time.

Updated versions become effective immediately upon publication inside the Application or marketplace listing.

Continued use of the Application after updates constitutes acceptance of the revised Terms.

16. GOVERNING LAW

These Terms shall be governed and interpreted in accordance with the laws applicable within the developer’s jurisdiction, without regard to conflict-of-law principles.

Any disputes arising from these Terms or the use of the Application shall be resolved exclusively in the competent courts of the applicable jurisdiction.
