Terms of Service

Welcome to Load Souq. These Terms of Service ("Terms") govern your use of our freight and logistics platform. Load Souq connects Shippers who need to transport goods with Drivers who provide transportation services, and facilitates load management through Admins. By accessing or using Load Souq, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our service, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. These Terms apply to all users including Shippers, Drivers, and Admins.
2. User Accounts
You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Each user may only register as either a Shipper, a Driver, or login as an authorized Admin.
3. Shipper Responsibilities
As a Shipper, you agree to: (a) Provide accurate and complete information when posting a load, including origin, destination, weight, and cargo type. (b) Ensure that all goods posted for transport are lawfully tradeable and comply with applicable laws and regulations. (c) Review driver offers and accept or decline them in a timely manner. (d) Once a driver request is accepted, communicate respectfully with the driver via in-app call or messaging. (e) Track your shipment through the real-time location tracking feature provided in the app. (f) Fairly compensate drivers for services rendered as agreed at the time of load acceptance.
4. Driver Responsibilities
As a Driver, you agree to: (a) Maintain a valid driver's license, vehicle registration, and insurance at all times. (b) Browse available loads posted by Shippers or Admins and submit offers or contact the relevant party via in-app call. (c) Only contact a Shipper or Admin after your request for a load has been formally accepted. (d) Handle goods with care, professionalism, and in accordance with the agreed terms. (e) Meet agreed pickup and delivery timelines and keep the Shipper or platform informed of any delays. (f) Maintain your vehicle in a roadworthy condition suitable for the loads you accept. (g) Allow real-time location tracking during active shipments as required by the platform.
5. Admin Responsibilities & Privileges
As an Admin, you agree and acknowledge that: (a) Admins have the operational authority to create loads within the platform. An Admin has the permission to cancel a load only if it was originally created by that specific Admin account, and provided that the load status is neither active (ongoing) nor delivered. (b) Admins have access to a dedicated dashboard containing real-time operational metrics, including total registered drivers, active loads, delivered loads, and pending loads. (c) Admins receive automated real-time alerts whenever a new load is created on the platform to ensure immediate processing. (d) Admins are granted visibility into Driver registration profiles—including names, phone numbers, vehicle registration numbers, vehicle types, and vehicle lengths—solely for the purposes of verification, support, and dispatch efficiency. (e) All actions performed by an Admin account, including load creations and valid cancellations, are persistently tracked via automated audit logs for compliance and quality control. (f) Admins must strictly maintain the confidentiality of all user profiles, dashboard analytics, and load data accessed during their duties. Sharing Admin account credentials, OTPs, or corporate data with unauthorized parties is strictly prohibited and will result in immediate termination of access and legal liability.
6. Load Posting & Offers
Shippers and Admins may post loads on the platform that are visible to all registered Drivers. Admins retain the strict authority to cancel pending loads that they created themselves; however, no load may be canceled by an Admin or user once it has transitioned to an ongoing or delivered status. Drivers may submit an offer or initiate a call to the Shipper or Admin regarding a posted load. A Shipper or Admin may accept or decline any driver's offer at their sole discretion. Once an offer is accepted, both parties are connected and may communicate via in-app calling and messaging to coordinate the shipment.
7. Communication Between Users
Load Souq provides in-app calling and messaging features to facilitate communication between Shippers and Drivers. These features are unlocked after a Driver's request for a specific load is accepted. Users agree to communicate respectfully and professionally. Any misuse of communication features including harassment, threats, or spam may result in account suspension.
8. Real-Time Location Tracking
Load Souq provides Shippers and Admins with the ability to track the real-time location of a Driver during an active shipment. Drivers consent to sharing their location with the assigned Shipper for the duration of the accepted load. Location data is visible to Admins when operationally necessary to resolve disputes, support active shipments, or update delivery logs, and is not shared with unauthorized third parties.
9. Payment Terms
Payment for services is agreed directly between the managing party (Shipper/Admin) and the Driver at the time of load acceptance. Load Souq facilitates the platform infrastructure but is not responsible for external payment disputes, non-payment, or independent financial transactions between users. All rates and pricing are determined by the parties involved.
10. Limitation of Liability
Load Souq is provided on an "as-is" basis. We do not warrant that the service will be error-free or uninterrupted. To the maximum extent permitted by law, Load Souq and its Admins shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform including but not limited to cargo damage, delivery delays, or disputes between Shippers and Drivers.
11. Indemnification
You agree to indemnify and hold harmless Load Souq, its officers, directors, and employees from any claims, damages, losses, or costs arising from your use of the service, your violation of these Terms, or any dispute between you and another user of the platform.
12. Termination
Load Souq reserves the right to terminate or suspend your account (including Shipper, Driver, and Admin accounts) at any time, with or without cause, including for violation of these Terms, fraudulent activity, or misuse of the platform. Upon termination, your right to use the service ceases immediately.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the platform. Your continued use of the service after changes are posted constitutes your acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Riyadh, Saudi Arabia.
