Scam Shield — Terms of Service

These Terms are an agreement between you, the merchant who installs Scam Shield on a Shopify store ("you"), and Liran Brook, Osek Murshe (licensed dealer) no. 231451511, 8 Shaul HaMelech St., Kiryat Ono, Israel ("we", "us"). By installing or using Scam Shield you accept these Terms. If you do not accept them, do not install the app, or uninstall it.
1. The service
Scam Shield helps you spot orders that may lead to chargebacks or transaction-denial fraud. It compares details from your orders with details from orders at other stores that use Scam Shield (the "Network"). It then adds a risk level (low, medium or high) and the reasons for it to the order in your Shopify admin. Scam Shield gives you information only. It never cancels, refunds, holds or fulfils an order. Every decision about an order stays with you.
2. The Network and your authorisation
Scam Shield works only because participating stores contribute to the Network. By installing the app, you expressly authorise us to:
(a) process customer details from your orders (name, shipping and billing address, email, phone, order and store identifiers), and convert them into irreversible keyed hashes;
(b) compare those hashes with hashes from other participating stores; and
(c) show other participating stores factual risk signals derived from your orders, for example "the same name and address were used at 3 stores in the last 24 hours".
Other stores never see your store's name, your orders, or your customers' personal details. Only the derived signal is shown. You can withdraw this authorisation at any time by uninstalling the app (see section 7).
You are responsible for having a lawful basis to share your customers' data with us for fraud prevention, and for telling your customers about it in your own privacy notice. We provide the privacy policy linked in section 6 to help.
3. Plans, trial and billing
Scam Shield costs US$3 per month and includes a 30-day free trial. All charges are billed and collected by Shopify through your Shopify invoice, under Shopify's billing terms. You can cancel at any time by uninstalling the app. After the trial, charges are not refunded for partial months unless the law requires it. If we change the price, we will tell you at least 30 days in advance. Without an active subscription, risk assessments are not written to your orders and the app's dashboard shows limited information.
4. Your responsibilities
You agree not to:
use Scam Shield or its results to discriminate against customers on grounds prohibited by law;
try to identify people or other stores from the Network;
reverse-engineer, overload or misuse the app; or
use Scam Shield in breach of Shopify's terms or applicable law.
A risk score is a signal, not proof of fraud. Treat it as one input when you review an order.
5. Relationship with Shopify
Scam Shield is a third-party app. We alone are responsible for it.
Shopify is not a party to these Terms and is not responsible for the app or for any faults in it.
Shopify does not provide support for Scam Shield. For support, contact us.
We accept all liability arising from your access to or use of Scam Shield, subject to section 9.
6. Privacy and data
We process personal data as described in the Scam Shield Privacy Policy: https://sites.google.com/view/liran-brook-dev/scam-shield-privacy-policy. We follow Shopify's data-protection requirements, including its API License and Terms of Use.
7. Term, uninstall and deletion
These Terms apply for as long as the app is installed. You may end them at any time by uninstalling the app. We may suspend or end your access if you materially breach these Terms, or if we discontinue the app. We will give reasonable notice where possible. After you uninstall, we delete all data held about your store and its customers within 30 days.
8. Disclaimer
Scam Shield is provided "as is" and "as available". Fraud detection cannot be perfect. The app may miss fraudulent orders, and it may flag legitimate ones. To the extent the law permits, we make no warranty that the app will be accurate, uninterrupted or error-free, or that it will prevent chargebacks.
9. Limitation of liability
To the extent the law permits, we are not liable for indirect, incidental or consequential damages, or for lost profits, revenue, chargebacks or orders. Our total liability under these Terms is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. No restrictions on your business
These Terms do not require exclusivity. They do not prevent you from using or building competing products, and they do not otherwise limit how you run your business.
11. Changes
We may update these Terms. For material changes, we will notify you in the app or by email at least 30 days in advance. If you keep using the app after that, you accept the updated Terms.
12. Law and jurisdiction
These Terms are governed by the laws of the State of Israel. The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction. This does not remove any mandatory consumer or data-protection rights you have where you are based.

תנאים אלה הם הסכם בינך, הסוחר המתקין את Scam Shield בחנות Shopify ("את/ה"), לבין לירן ברוק, עוסק מורשה מס' 231451511, שאול המלך 8, קריית אונו, ישראל ("אנחנו"). התקנת האפליקציה או השימוש בה מהווים הסכמה לתנאים אלה. אם אינך מסכים/ה להם, אל תתקין/י את האפליקציה, או הסר/י אותה.
1. השירות
Scam Shield עוזרת לזהות הזמנות שעלולות להסתיים בהכחשת עסקה או בהונאת חיוב חוזר. האפליקציה משווה פרטים מההזמנות שלך לפרטים מהזמנות בחנויות אחרות המשתמשות ב-Scam Shield ("הרשת"). לאחר מכן היא מוסיפה להזמנה בממשק הניהול של Shopify רמת סיכון (נמוכה, בינונית או גבוהה) ואת הסיבות לה. Scam Shield מספקת מידע בלבד. היא לעולם אינה מבטלת, מזכה, מעכבת או שולחת הזמנות. כל החלטה לגבי הזמנה נשארת בידיך.
2. הרשת וההרשאה שלך
Scam Shield פועלת רק בזכות החנויות המשתתפות ברשת. בהתקנת האפליקציה את/ה מתיר/ה לנו במפורש:
(א) לעבד פרטי לקוחות מההזמנות שלך (שם, כתובת משלוח וחיוב, אימייל, טלפון, מזהי הזמנה וחנות) ולהפוך אותם לגיבובים (hash) מוצפנים בלתי הפיכים;
(ב) להשוות את הגיבובים לגיבובים של חנויות משתתפות אחרות; וכן
(ג) להציג לחנויות משתתפות אחרות אותות סיכון עובדתיים הנגזרים מההזמנות שלך, למשל "אותו שם ואותה כתובת שימשו ב-3 חנויות ב-24 השעות האחרונות".
חנויות אחרות לעולם אינן רואות את שם החנות שלך, את ההזמנות שלך או את הפרטים האישיים של הלקוחות שלך. מוצג להן רק האות הנגזר. ניתן לבטל הרשאה זו בכל עת על ידי הסרת האפליקציה (ראו סעיף 7).
באחריותך שיהיה לך בסיס חוקי לשתף איתנו את נתוני הלקוחות לצורך מניעת הונאות, ולעדכן את הלקוחות שלך על כך במדיניות הפרטיות של החנות. מדיניות הפרטיות המקושרת בסעיף 6 יכולה לעזור בכך.
3. תוכנית, תקופת ניסיון וחיוב
Scam Shield עולה 3 דולר ארה"ב לחודש וכוללת 30 ימי ניסיון בחינם. כל החיובים נגבים על ידי Shopify דרך חשבונית Shopify שלך, בהתאם לתנאי החיוב של Shopify. ניתן לבטל בכל עת על ידי הסרת האפליקציה. לאחר תקופת הניסיון אין החזר על חלקי חודש, אלא אם החוק מחייב זאת. אם נשנה את המחיר, נודיע על כך לפחות 30 יום מראש. ללא מנוי פעיל, הערכות הסיכון אינן נכתבות להזמנות, ולוח הבקרה של האפליקציה מציג מידע מוגבל.
4. האחריות שלך
את/ה מתחייב/ת שלא:
להשתמש ב-Scam Shield או בתוצאותיה כדי להפלות לקוחות מטעמים האסורים בחוק;
לנסות לזהות אנשים או חנויות אחרות מתוך הרשת;
לבצע הנדסה לאחור, להעמיס על האפליקציה או לעשות בה שימוש לרעה; וכן
להשתמש ב-Scam Shield בניגוד לתנאי Shopify או לדין.
ציון סיכון הוא אות, לא הוכחה להונאה. יש להתייחס אליו כאל נתון אחד מתוך כמה בבדיקת הזמנה.
5. היחסים עם Shopify
Scam Shield היא אפליקציית צד שלישי. אנחנו לבדנו אחראים לה.
Shopify אינה צד לתנאים אלה ואינה אחראית לאפליקציה או לתקלות בה.
Shopify אינה מספקת תמיכה ל-Scam Shield. לתמיכה יש לפנות אלינו.
אנו נושאים בכל האחריות הנובעת מהגישה שלך ל-Scam Shield או מהשימוש בה, בכפוף לסעיף 9.
6. פרטיות ונתונים
אנו מעבדים מידע אישי כמתואר במדיניות הפרטיות של Scam Shield: https://sites.google.com/view/liran-brook-dev/scam-shield-privacy-policy. אנו פועלים לפי דרישות הגנת המידע של Shopify, כולל תנאי הרישיון והשימוש ב-API שלה.
7. תקופה, הסרה ומחיקה
התנאים חלים כל עוד האפליקציה מותקנת. ניתן לסיים אותם בכל עת על ידי הסרת האפליקציה. אנו רשאים להשעות או להפסיק את הגישה שלך אם הפרת את התנאים באופן מהותי, או אם נפסיק להפעיל את האפליקציה. במידת האפשר ניתן הודעה סבירה מראש. לאחר הסרת האפליקציה, נמחק את כל הנתונים על החנות שלך ועל לקוחותיה תוך 30 יום.
8. הסתייגות
Scam Shield מסופקת "כמות שהיא" ("AS IS") ו"כפי שהיא זמינה". זיהוי הונאות אינו יכול להיות מושלם. האפליקציה עלולה לפספס הזמנות הונאה, ועלולה לסמן הזמנות לגיטימיות. במידה המותרת בדין, איננו מתחייבים שהאפליקציה תהיה מדויקת, רציפה או נקייה משגיאות, או שתמנע הכחשות עסקה.
9. הגבלת אחריות
במידה המותרת בדין, איננו אחראים לנזקים עקיפים, נלווים או תוצאתיים, או לאובדן רווחים, הכנסות, חיובים חוזרים או הזמנות. האחריות הכוללת שלנו לפי תנאים אלה מוגבלת לסכום ששילמת לנו ב-12 החודשים שקדמו לתביעה. אין בתנאים אלה כדי להגביל אחריות שלא ניתן להגבילה לפי דין.
10. אין הגבלה על העסק שלך
תנאים אלה אינם מחייבים בלעדיות. הם אינם מונעים ממך להשתמש במוצרים מתחרים או לפתח כאלה, ואינם מגבילים בכל דרך אחרת את ניהול העסק שלך.
11. שינויים
אנו רשאים לעדכן תנאים אלה. על שינויים מהותיים נודיע באפליקציה או באימייל לפחות 30 יום מראש. המשך השימוש לאחר מכן מהווה הסכמה לתנאים המעודכנים.
12. דין וסמכות שיפוט
על תנאים אלה חלים דיני מדינת ישראל. לבתי המשפט המוסמכים בתל אביב-יפו סמכות שיפוט ייחודית. אין בכך כדי לגרוע מזכויות קוגנטיות להגנת הצרכן או להגנת המידע החלות במקום מושבך.
