Republic Act No. 10361 otherwise known as the “Domestic Workers Act” or “Batas Kasambahay” is an Act instituting policies for the protection and welfare of domestic workers. It was signed into law on January 18, 2013. Section 17 thereof mandates the DILG, in coordination with DOLE, to formulate a registration system on Barangay Registration of Kasambahay.
Further, Sections 3 and 4, Rule IX of the IRR of the same Act provide that the Punong Barangay shall designate a Registration/Kasambahay Desk in the Barangay Hall to accommodate the continuous registration by the employers, maintain, and update the Kasambahay Masterlist, and submit reports, through the Kasambahay Desk, on the data regarding the registration of Kasambahay to the Local Government Units, through the PESO.
Furthemore, the same Rule, Section 4, mandates the PESOs to submit a "monthly report" to the DILG for monitoring and data analysis. The report shall be made available to the DOLE and other concerned government agencies.
Remind all Punong Barangays relative to their compliance on Kasambahay-related activities, which may be included as indicators under the Seal of Good Local Governance for Barangay, such as the following:
Conduct of continuous Barangay Registration of Kasambahay.
Maintenance of a Kasambahay Masterlist.
Preparation, accomplishment and submission to the City/Municipal PESO of KR Form No.3 (Monthly Barangay Consolidated Kasambahay Report of the previous month), not later than the 15" day of every month.
Establishment of a Kasambahay Desk.
Designation of the Kasambahay Desk Officer.
Posting of the modified Kasambahay Flowchart.
Continuous conduct of information dissemination to increase public awareness on the Kasambahay Law.
Remind the City/Municipal PESO on the submission of the Monthly Consolidated Kasambahay Report, using KR Form 4, in compliance with Rule IX, Section 4, of the IRR of RA No. 10361, not later than the end of the ensuing month, and ensure the submission of the same to the following offices:
City/Municipal DILG
DOLE District or Provincial Office
Field Offices of Pag-IBIG Field, SSS and PhilHealth
DOLE-Bureau of Workers with Special Concerns (BWSC), through e-mail address: bwsc@dole.gov.ph
Ensure to obtain the accomplished monthly KR Form 4, from the City/Municipal PESO.
Maintain a folder, compile and label accordingly, for easy reference, the accomplished monthly KR Form 4 submitted by the City/Municipal PESO.
Retain the compiled reports in the DILG City/Municipal Office, which shall always be made available to DOLE and other concerned government agencies, in compliance with the IRR of the Kasambahay Act.
Ensure that the monthly City/Municipal KR Form 4 shall be ready for transmission to DILG Central Office, whenever necessary or upon instruction by the DILG Secretary or other DILG Officials.
