Section 7 of Republic Act (RA) No. 107421 mandates the creation and election of the Sangguniang Kabataan (SK) in every barangay to be composed of a chairperson and seven (7) members who shall be elected by the registered voters of the Katipunan ng Kabataan. The SK chairperson shall, with the concurrence of the majority of the SK members, appoint from among the members of the Katipunan ng Kabataan, a secretary and a treasurer.
1.2 Section 10 of the same Act provides, among the others, the age qualification of either elective or appointive, with is at least eighteen (18) years but not more than twenty-four (24) years of age on the day of the elections.
1.4 RA No. 117682 was enacted amending among others Section 10 of RA No. 10742, which provides in part that:
1.4.1 Provided, That the Sangguniang Kabataan treasurer and secretary must be at least eighteen (18) years but not more than thirty (30) years of age on the day of the appointment.
1.4.2 Provided, further, The Sangguniang Kabataan Chairperson shall appoint a treasurer with an educational or career background relating to business administration, accountancy, finance, economic, or bookkeeping.
1.4.3 Provided, further, That only if no person meets the requirements can the Sangguniang Kabataan chairperson consider other suitable nominees.
1.4.4 Provided, furthermore, That the appointed Sangguniang Kabataan treasurers shall undergo a mandatory bookkeeping training from, and be duly certified by, the Technical Education and Skills Development Authority (TESDA) before assumption to office.
1.4.5 Provided, finally, That the appointed Sangguniang Kabataan treasurers shall be prioritized in the allocation of the appropriate TESDA scholarships.
Pursuant to Section 10 of RA No. 10742, as amended by RA No. 11768, the SK Secretary and SK Treasurer must have the following qualifications:
4.1.1 Citizen of the Philippines;
4.1.2 A qualified voter of the Katipunan ng Kabataan;
4.1.3 A resident of the barangay for not less than one (1) year immediately preceding the day of the elections;
4.1.4 Must be at least eighteen (18) years, but not more than thirty (30) years of age on the day of the appointment;
4.1.5 Able to read and write Filipino, English, or the local dialect;
4.1.6 Must not be within the second civil degree of consanguinity or affinity to any incumbent elected national official or to any incumbent elected regional, provincial, city, municipal, or barangay official, in the locality where he seeks to be appointed; and
4.1.7 Must not have been convicted by final judgment of any crime involving moral turpitude.
In addition to the above qualifications, the SK Treasurer, must:
• have an educational background relating to business administration, accountancy, finance, economics, or bookkeeping.
4.17 Must not have been convicted by final judgement of any crime involving moral turpitude.
The SK Chairperson shall appoint a treasurer with an educational or career background relating to business administration, accountancy, finance, economics, or bookkeeping. Provided that, only if no person meets the requirements can the SK Chairperson consider other suitable nominees.
4.5.1 The appointed SK treasurers shall undergo mandatory bookkeeping training from, and must be duly certified by the Technical Education and Skills Development Authority (TESDA) before the assumption of office. Provided that, the mandatory bookkeeping training shall be in addition to the mandatory training under Section 31 of this Rules, Provided further, that only the certification from TESDA shall be considered for purposes of appointment as SK Treasurer.
Provided finally, that the appointed SK treasurers shall be prioritized in the allocation of appropriate TESDA scholarship in accordance with the guidelines to be issued by the TESDA for the purpose.
