The PLEB is a check and balance mechanism. It is part of the Rule of Law under which an ordinary citizen can have redress of his grievance against law enforcers who abuse their authority. The PLEB involves the active participation of the
community and empowers the individual citizen and the community as a whole in
instilling discipline in the ranks of our law enforcers, or providing rewards and
incentives for exceptional performance.
The PLEB acts as the Central Receiving Entity of any citizen’s complaint against
PNP officers and members. Also acts as a quasi-judicial board, whose powers and
procedures resemble those of a court of law or judge, but not part of the judiciary.
The PLEB is comprised of five members of the community, and are tasked to
conduct hearing and adjudication of citizen’s
Any member of the Sangguniang Panlungsod/Bayan chosen by his respective sanggunian;
A punong barangay of the city or municipality chosen by the Liga ng mga Barangay; and
Three (3) other members, who can be removed only for a cause, chosen by the city/municipal peace and order council from among the respected members of the community known for their probity and integrity, one (1) of whom must be a woman and another, a member of the Bar, or in the absence thereof, a college graduate, or, the principal of the central elementary school in the locality.
The Chairperson of the PLEB shall be elected from among its members. Applying
the provisions of Article 152, Chapter IV, Title III, Book II of the Revised Penal Code,
the members of the PLEB are considered persons in authority.
Note: There should be a resolution from the Sanggunian Panlungsod/Bayan, the Liga ng mga Barangay and the Peace and Order Council to affirm that the certain SB Member, Punong Barangay and 3 representatives from the community will represent the Sangguniang/LNB and/or to be a member of the PLEB.
The Sanggunian Panlungsod/Bayan shall pass a resolution formally organizing the PLEB, a copy of the resolution shall immediately be submitted to the
City/Municipal Mayor who shall, within five (5) days from receipt, issue the appropriate Executive Order adopting the resolution of the Sanggunian concerned. The copy of the E.O. shall be furnished to the NAPOLCOM Regional Office within ten (10) days from issuance.
The term of office of the PLEB shall be for a period of three (3) years from assumption of office unless sooner removed for a cause. The member shall hold
office until his/her successor shall have been chosen and qualified. However, for the members who have been designated as members by virtue of his election to
the Sangguniang Panlungsod/Bayan or membership in the Liga ng Mga Barangay ends upon expiration of his term of office. If reelected, and subsequently redesignated to the PLEB, the member must take a new oath of office.
The annual budget of the LGU shall include an item and the corresponding appropriation for the maintenance and operation of their local PLEB(s).
Membership in the PLEB is a civic duty. However, PLEB members may be paid per diem as may be determined by the city or municipal council from city or municipal funds. Per diem is given per session and may be pegged at P1,000.00 per session but should not exceed P4,000.00 irrespective of the number of sessions. Life insurance coverage may also be given as determined by the city or municipal council.
The presence of three (3) members of the PLEB shall constitute a quorum, provided, however, that a vote of at least three (3) members shall be required in
rendering a decision.
If for any reason, the chairperson is absent or is disqualified from participating in the hearing, the members, there being a quorum, shall elect from among themselves a temporary chairperson to perform the duties of a chairperson.
When a PLEB member, after sufficient notice, fails or refuses to attend the hearings and/or deliberations of the Board without any valid and justifiable reason and it could not proceed for lack of quorum, the Chairperson or the designated presiding officer may request the Sangguniang Panlungsod/Bayan or the Liga ng mga Barangay or the City/Municipal Peace and Order Council, as the case as may be, to designate a temporary representative to enable the body to constitute a quorum, provided that such temporary representative shall act as such only for the specific case.
The Chairperson or any member of the PLEB who is related to the complainant or respondent by affinity or consanguinity within the fourth civil degree shall be
disqualified from participating in the proceeding and the case shall be tried by the remaining members, provided that there is a quorum. In the event that the PLEB could not proceed with the hearing for lack of quorum, the Peace and Order Council, the Sangguniang Panlungsod/Bayan or the Liga ng mga Barangay of the city/municipality concerned shall appoint a temporary member for that specific case only.
