Pursuant thereto, DILG Memorandum Circular Nos. 2017-105, 2017-168, and 2018-
216 were issued by the Department to provide general guidelines for the Local
Government Units (LGUs). Heeding to the call of President Ferdinand R. Marcos, Jr.,
all LGUs are reminded of the following:
1. To reduce cases of fireworks-related injuries, all LGUs are highly encouraged
to conduct community fireworks exhibitions/displays for their constituents and
discourage the individual or household use of firecrackers.
2. All prohibited fireworks (see Annex “A”), as determined by the Director-General,
now Chief of the Philippine National Police (PNP), shall not be manufactured,
sold, distributed, nor used as part of community fireworks exhibitions/displays.
LGUs shall enact appropriate ordinances, or reinforce existing local issuances,
to adhere to this regulation and promote alternate means to the same effect.
3. Coordinate with the PNP and the Bureau of Fire Protection (BFP), on the
conduct of fireworks exhibitions, and the designation of fire exhibition safe
zones, which shall be guided accordingly by the provisions of the Implementing
Rules and Regulations of R.A. No. 9514, to wit:
a. That a fireworks display operator shall secure a permit to possess and
display fireworks from the PNP;
b. That fireworks should be fired at a distance of one hundred feet (100 ft.)
away from people;
c. That all fireworks shall project upwards;
d. That a responsible person of at least twenty-one (21) years and with
adequate knowledge of handling fireworks shall be assigned to
supervise the fireworks exhibitions;
e. That sufficient approved type of first-aid and fire protection equipment
shall be on hand at the site during fireworks exhibitions; and
f. That the nearest fire station shall be notified of such exhibitions; and
g. That per Section 11, any person who manufactures, sells, distributes or
uses firecrackers and other pyrotechnic devices in violation of the
provisions of this Act shall be punished by a fine of not less than Twenty
thousand pesos (P20,000.00) nor more than Thirty thousand pesos
(P30,000.00), or imprisonment of not less than six (6) months nor more
than one (1) year, or both such fine and imprisonment, at the discretion
of the court in addition to the cancellation of his license and business
permit and the confiscation by the Government of his inventory or stock.
4. Conduct information campaigns within their respective jurisdictions on the
danger of prohibited fireworks, use of firearms, and the danger of fire due to the
improper use of firecrackers and fireworks. Households may be advised on the
reasonable use of common household items in celebrating the holidays, so as
to not disrupt peace and order in the community.
