In 1974, Pennsylvania established Act 89 to provide non-public school students with opportunities to access related services. Act 89 is administered by the local IU and its purpose is to provide supplemental support to students who do not qualify for special education, but need additional support. Act 89 services are not to be perceived as a substitute for special education placement. Students in Grades K-12, enrolled in non-profit, non-public schools are eligible to receive Act 89 services.

"Auxiliary services includes guidance, counseling and testing services, psychological services, services for exceptional children, remedial services, speech and hearing services, services for the improvement of the educationally disadvantaged (such as, but not limited to, teaching English as a second language), and other secular, neutral, nonideological services of a supplementary and remedial nature. "
