Photo Session Contract

It is understood that Lauren A. Rupar Photography is the exclusive official photographer retained to perform the photographic services requested on this Contract.

A 50% deposit is required to secure services. Remaining 50% is due at the start of the session. Photo session will not begin until the balance is paid in full. Payment is accepted via Venmo, Zelle, Cash app, or cash. No PayPal and no checks will be accepted.

Lauren A. Rupar Photography shall reserve the time and date agreed upon. All fees and deposits are nonrefundable. In the case of inclement weather, an alternative indoor location may be found OR a suitable new date and time will be found that is mutually agreed upon.

The charges in this Contract are based on Lauren A. Rupar Photography Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

The Client has unlimited personal usage rights to the photography created during the assignment; The Client has no commercial usage rights unless express written permission is given by Lauren A. Rupar Photography.

Lauren A. Rupar Photography reserves the right to use images created under this contract for promotional usage such as advertising, display, publication or other purposes. The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the session in this manner and shall indemnify and defend Lauren A. Rupar Photography in the event of litigation arising out of such use. Digital Negatives, RAW digital files and previews remain the exclusive property of Lauren A. Rupar Photography. The client shall be provided with final digital files for the purpose of printing or sharing for personal use ONLY. These files are still considered the property of Lauren A. Rupar Photography.

If Lauren A. Rupar Photography cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the Photographer shall return any deposit or fee to the client but shall have no further liability with respect to the Contract. Should Client cancel or postpone event, any deposit is non-refundable.

This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer.

In the event that Lauren A. Rupar Photography fails to perform for any other reason, Lauren A. Rupar Photography shall not be liable for any amount in excess of the retail value of the Client’s order.

Creative License: Images are edited at the photographer’s discretion, and delivered prints may not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer’s artistic standards. RAW and unedited (digital negatives) files will not be released to client. Files that will be released will be in jpeg format.

Requested Photos: While Photographer will make every reasonable effort to take photos that may be specifically requested by Client, Client understands that due the vagaries of the weather, available light, time restrictions, and willingness of subjects, Photographer cannot guarantee that requested photos will be taken and no specific pose or photograph can be promised and Photographer will not be responsible for any missed moments. Due to the limited and subjective nature of the event, Photographer cannot be held responsible for requested photographs not taken, compromised, or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by location restrictions, the lateness of contracting parties, or other principles, or the rendering of props/decorations of the location. Photographer is not responsible for existing backgrounds or lighting conditions, which may negatively affect or restrict the photography coverage. It is acknowledged that any requests submitted to Photographer will be used for organizational purposes only and in no way represents photography that will actually be produced. Photographer will do her best to fulfill all requests but can make no guarantees all images will be delivered. Clients are responsible for all location fees and permits.

Props: Client is responsible for providing any and all desired props. Props are always welcome and encouraged but cannot be guaranteed to work in any particular photo/setup, though Photographer will do her best to include provided props. Newborn sessions generally include some wraps, hats, blankets and other items, which can/will be used if the Client desires. No prop is guaranteed to be available and Photographer is not responsible for bringing any particular prop to a session. Suggestions for props the Client might wish to bring: a blanket (to sit on), family heirlooms, baby blocks, age blocks, wooden crate, smash cake (for birthday sessions), balloons, baskets, etc. These are simply suggestions and not required in ANY way. Any session can be completed without props being provided by the Client. If the Client has specific ideas in mind regarding photos, examples should be sent to the Photographer no less than 24 hours before the scheduled session for proper evaluation and discussion, if needed. As stated in item #11, no requests for specific photos can be guaranteed.

SCHOOL PORTRAITS ONLY: School portrait sessions do not require a sitting fee but a minimum of 30 participants are required for session to take place. If the Photographer shows at the scheduled time and there are not at least 30 participants, the session will be forfeited. Photographer will reschedule if her time allows for a fee of $50.00. Being a participant does not require a purchase, though purchase of final digital images will be offered for any family interested.

This Contract incorporates the entire understanding of the parties. Any modifications of this Contract must be in writing and signed by both parties.
