Terms of Use

These Terms of Use apply to all digital resources supplied by Kingfisher Exams.

1. Ownership

All digital resources, including assessments, examinations, revision materials, teaching resources, branding, and website content, are protected by copyright and remain the intellectual property of Kingfisher Exams.

Purchase or access to a resource does not transfer ownership.

2. Licensed to School and Teachers

Teachers in schools with licences for Kingfisher Exams examination resource packs are bound by these Terms of Use. The teacher who receives the emailed examination resource packs is responsible for informing other teachers with access to the files about these Terms of Use.

3. Licence Grant

Kingfisher Exams grants the purchasing school a non-exclusive, non-transferable licence to use the supplied digital resources (examination resource packs) for educational purposes within that school only.

Permitted use includes:

• classroom teaching

• assessment and revision

• publishing to internal learning management systems

• use by staff and enrolled students of the purchasing school

The examination resource pack must not be published or otherwise released before the release date linked to the assessment window for that resource.

4. Restrictions

Unless expressly agreed in writing, resources (examination resource packs) may not be:

• shared with other schools or organisations

• redistributed outside the purchasing school

• resold or sub-licensed

• uploaded to public websites or shared drives

• used for commercial purposes

5. Release date

No part of an examination resource pack can be released to students until the release date; that is, the Monday after the assessment window.

6. Modifications

Schools may adapt resources for internal educational use, subject to the licence restrictions, provided such adaptations are not redistributed and do not remove attribution to Kingfisher Exams.

Adapted resources remain subject to these Terms of Use.

7. Multiple Campuses

Unless otherwise stated on the invoice or licence agreement, a licence applies to one school site only.

Multi-campus or shared licences must be agreed separately.

8. Breach of Licence

Unauthorised use or distribution of resources constitutes a breach of these Terms of Use and may result in withdrawal of access or further action.

Resources may contain embedded identifiers to assist in the investigation of unauthorised release.

9. Updates and Corrections

Kingfisher Exams may issue updated versions or corrections to resources. Access to updates is provided at the discretion of Kingfisher Exams unless otherwise stated.

10. Limitation of Liability

Resources are provided for educational use. While care is taken to ensure accuracy, Kingfisher Exams is not liable for outcomes arising from their use in assessment or instruction.

11. Governing Law

These Terms of Use are governed by the laws of New Zealand.

12. Privacy

Personal and organisational information collected through the order form is handled in accordance with our Privacy Policy.
