Terms and Conditions for Khalil Food App

Welcome to the Khalil's Food app, the official mobile application for ordering from Khalil's Food, including locations at Khalil Biryani House(Bronx, NY), Khalil Biryani House(Jamaica, NY),  Khalil Halal Chinese and Khalil's Food Court. By using this app, you agree to these Terms and Conditions. If you do not agree, please refrain from using the app.

1. User Accounts and Registration

• Account Creation
  To place orders, you must create an account with accurate information, including a unique username, full name, phone number, and email address.

• Account Verification
  During registration, an OTP (One-Time Passcode) will be sent to your phone number for verification. This helps secure your account and ensures that only verified users access our services.

• Responsibility for Account
  You are responsible for maintaining the confidentiality of your account credentials and agree to notify us immediately if there is unauthorized use or security breach. Khalil Food will not be liable for any loss arising from unauthorized use of your account.

2. Permissible Use of the App

• Personal Use
  The Khalil's Food app is intended for personal, non-commercial use to browse menus, place orders, and manage your account.

• Prohibited Activities
  You agree not to:

  • Use the app for any illegal purpose or in violation of any local, state, national, or international law.

  • Misrepresent your identity or provide false information.

  • Attempt to gain unauthorized access to the app’s systems or another user’s account.

  • Use bots, scripts, or other automated processes to interfere with the app’s functionality.

  • Post or transmit any content that is offensive, defamatory, fraudulent, or violates the rights of others.

• Compliance with Local Laws
  You are responsible for compliance with all local laws regarding food ordering, payment processing, and use of mobile applications.

3. Ordering and Payments

• Ordering Process
  Users can browse the menu, select items, and place orders from any of the Khalil Food locations within the app. Orders are final upon confirmation and cannot be canceled once prepared.

• Pricing
  Prices are displayed in the app and may vary by location. Prices are subject to change at our discretion. We strive for accuracy but are not responsible for any pricing, typographical, or other errors.

• Payment Methods
  Payments are processed through Stripe, which allows you to securely save your credit or debit card information. Payment options include:

  • Debit/Credit Cards: Card information is managed and stored securely by Stripe.

  • Reward Points: When available, reward points can be applied during checkout. Points are earned and redeemed as specified in the Rewards Program.

• Order Confirmation and Receipt
  After placing an order, you will receive a confirmation and a digital receipt via email or within the app. Please check your receipt for accuracy.

4. Rewards Program

• Earning Points
  Users earn reward points on eligible purchases as indicated in the app. The number of points awarded per purchase may vary based on the item or promotion.

• Using Points
  Points can be redeemed to offset order costs. Rewards are subject to expiration and may have restrictions based on promotions or available items.

• Point Adjustments
  We reserve the right to adjust reward points for various reasons, including but not limited to suspected misuse or account inactivity.

5. Cancellations, Refunds, and Modifications

• Order Cancellations
  Once an order has been placed and confirmed, it cannot be canceled if already in preparation.

• Refunds
  Refunds are issued only in the case of an error or other exceptional circumstances. If you encounter an issue with your order, please contact us directly through the app’s customer support.

• Modification of Orders
  Modifications to orders may be possible before they are confirmed. Please review your order carefully before submission.

6. Intellectual Property Rights

• Ownership of Content
  All content in the app, including but not limited to menus, images, logos, trademarks, and software, is the exclusive property of Khalil Food and is protected by applicable intellectual property laws.

• User-Generated Content
  If you submit reviews, feedback, or other content, you grant Khalil Food a non-exclusive, royalty-free, perpetual, and irrevocable license to use, modify, and display such content.

• Restrictions on Use
  Users may not copy, reproduce, distribute, or create derivative works from any content within the app for commercial purposes without prior written permission.

7. Privacy and Data Collection

Our Privacy Policy outlines the data we collect, how it’s used, and how it’s protected. By using the app, you agree to our data practices as described in our Privacy Policy.

8. Limitation of Liability

• Service Availability
  While we aim to ensure the app operates smoothly, Khalil Food does not guarantee uninterrupted or error-free functionality. Downtime may occur for maintenance or technical issues.

• Limitation of Damages
  To the extent permitted by law, Khalil Food is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the app, including but not limited to:

  • Damages related to data loss, financial loss, or unauthorized access to your account.

  • Issues with third-party services, such as Stripe for payment processing.

• Disclaimer of Warranties
  The app is provided on an “as-is” and “as available” basis. We make no warranties, express or implied, regarding the app’s functionality, accuracy, reliability, or suitability for your needs.

9. Termination of Account

• Voluntary Account Closure
  You may delete your account at any time through the app’s settings. Upon deletion, all data associated with your account will be removed in accordance with our data retention policies.

• Termination by Khalil Food
  We reserve the right to suspend or terminate your account if we suspect violation of these Terms and Conditions, fraud, misuse, or any activity deemed harmful to the app or other users.

• Effect of Termination
  Upon termination, you will no longer have access to your account or any accumulated rewards. Any unredeemed reward points will be forfeited.

10. Third-Party Services and Links

The app may include third-party services, such as Stripe for payment processing. When using these services, you agree to comply with the terms and conditions of those third parties. Khalil Food is not responsible for the content or practices of third-party services, and you acknowledge that using them is at your own risk.

11. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time to reflect operational or legal changes. Any modifications will be communicated via the app, and the Effective Date will be updated. By continuing to use the app after any changes, you accept the revised Terms and Conditions.
