1. INTRODUCTION

Welcome to Keshi ("App", "we", "us", or "our"), a screen time management and digital wellbeing application designed for Android users.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and us, governing your use of the App and related services.

By accessing or using the App, you agree to these Terms. If you do not agree, you must not use the App.

2. ELIGIBILITY

2.1 Age Requirement

• You must be at least 13 years old

• Users under 18 must have parent/guardian consent

2.2 Legal Use

You agree:

• To comply with Indian laws (IT Act, Consumer Protection Act, etc.)

• Not to misuse the App for illegal or harmful purposes

3. DESCRIPTION OF SERVICES

The App provides digital wellbeing tools including:

3.1 Screen Time Management

• View app usage statistics

• Track daily and historical usage

• Monitor usage patterns

3.2 Control Features

• Set daily app limits

• Block selected apps

• Create focus schedules

• Receive reminders and alerts

3.3 Social Accountability Features

• Add friends

• Send/receive time extension requests

• Chat regarding requests

• Share media for context

4. WILLPOWER & MOTIVATIONAL CONTENT

4.1 Content Provision

• The App includes a "Willpower" section designed to provide motivational reels, carousels, and other media content to encourage mindful device usage and reduce distractions. This content is updated periodically (e.g., every 1-2 hours) to provide fresh inspiration

4.2 Push Notifications

• To keep you engaged and informed about new motivational content, we may send push notifications (e.g., "Tap to boost your willpower"). Clicking on these notifications will redirect you to the relevant section within the App where the new content is displayed

4.3 Nature of Content

• The motivational content provided in the "Willpower" section is for informational and inspirational purposes only. It is not intended to be a substitute for professional advice, therapy, or medical treatment. We do not guarantee specific outcomes or changes in user behavior as a result of engaging with this content

4.4 User Discretion

• Users are advised to exercise their own judgement and discretion when engaging with the motivational content. We are not responsible for any actions taken or not taken based on the content provided.

5. ACCOUNT AND ACCESS

5.1 Account Creation

Some features require an account. You agree to:

• Provide accurate information

• Keep login credentials secure

• Accept responsibility for account activity

5.2 Account Security

You must:

• Not share your credentials

• Notify us of unauthorized access

6. DATA HANDLING & STORAGE

6.1 Local Processing (Core Principle)

We follow a local-first architecture:

• Screen time data is processed and stored locally

• App limits and schedules remain on your device

• We do not maintain full usage history on our servers

6.2 Server Data (When Applicable)

If you use social/account features, we may store:

• Profile information

• Friend connections

• Time requests (including app name, duration, message)

• Chat messages

• Media uploads 

• Notification tokens

6.3 Data Minimization

We only collect data that is:

• Necessary for functionality

• Relevant to the service

• Limited in scope

7. DEVICE PERMISSIONS & SYSTEM ACCESS

To function correctly, the App requires certain Android permissions:

7.1 Usage Access

Used to:

• Read app usage statistics

• Display screen time insights

7.2 Accessibility Service

Used to:

• Detect foreground apps

• Enforce app limits and blocking

We do not use Accessibility for spying, reading personal messages, or collecting sensitive input data.

7.3 Overlay Permission

Used to:

• Show blocking screen when limits are reached

7.4 Background Services

Foreground/background services may run to:

• Monitor app usage

• Apply limits in real-time

7.5 Notifications

Used for:

• Reminders

• Time alerts

• Social requests

8. APP LIMITATION & ENFORCEMENT DISCLAIMER

While the App attempts to enforce usage limits:

• Restrictions may be bypassed due to device settings, OS limitations, or user actions

• We do not guarantee 100% blocking accuracy

• Functionality may vary across Android devices and versions

• The App operates in the background to monitor usage and enforce limits. This may lead to increased battery consumption and impact device performance. We are not responsible for any such effects

• The effectiveness of the App's blocking and monitoring features relies on the functionality of third-party applications and the Android operating system. Updates or changes to these third-party applications or the OS may temporarily or permanently affect the App's ability to enforce limits. While we will endeavor to adapt to such changes, we do not guarantee uninterrupted or 100% accurate functionality in such scenarios

9. SOCIAL FEATURES & USER INTERACTION

9.1 Friend Connections

• You control who you connect with

• We recommend only adding trusted individuals

9.2 Requests System

• Requests are optional and user-controlled

• You are not obligated to approve any request

9.3 Misuse

We may restrict features if:

• Spam requests are sent

• Harassment or abuse occurs

9.4 Ads & Third-Party Services

• Our app uses Google AdMob to display advertisements. AdMob is a third-party advertising service provided by Google Inc.

     AdMob may collect and use data such as device information, IP address, and advertising identifiers to provide personalized and non-personalized ads.

     This data collection is governed by Google’s Privacy Policy. We do not have direct control over how Google uses this data.

     Users can opt out of personalized advertising by adjusting their device settings.

10. USER-GENERATED CONTENT

10.1 Ownership

You retain ownership of content you upload.

10.2 License to Us

You grant us a limited license to:

• Store

• Display

• Process content for App functionality

10.3 Content Rules

You must not upload content that:

• Is illegal or harmful

• Contains nudity or explicit material

• Promotes violence or hate

• Violates copyright or privacy rights

11. THIRD-PARTY DEPENDENCIES

The App may depend on:

• Cloud services (e.g., Supabase)

• Notification providers

• Device-level Android APIs

We are not liable for failures caused by third-party services.

12. SERVICE AVAILABILITY

We reserve the right to:

• Modify or discontinue features

• Add or remove functionalities

• Restrict access temporarily or permanently

We do not guarantee uninterrupted service.

13. UPDATES & CHANGES

We may release updates that:

• Improve performance

• Add new features

• Fix bugs or security issues

You agree to install updates for continued use.

14. SUBSCRIPTIONS & PAYMENTS

14.1 Paid Features

Some features of the App may be available through paid subscriptions or one-time purchases ("Premium Features").

14.2 Payment Methods

We use trusted Indian payment providers such as:

• Razorpay

• UPI (AutoPay / recurring payments)

• Other supported payment gateways

All payments are processed securely via third-party providers.

14.3 Subscription Billing

• Subscriptions may be monthly

• Charges are applied at the time of purchase

• Auto-renewal may apply unless cancelled

14.4 Cancellation

• You can only cancel your subscription and request refund within 36 hours after renewal via autopay

• You can not cancel subscription when you are purchasing first time and setting autopay by himself, you can only cancel your subscription and take refund when money deducted from your account via autopay.

• Cancellation will apply from the next billing cycle

• No partial refunds for unused time unless eligible

14.5 Pricing

• Prices are shown in INR (₹)

• We may update pricing with notice

14.6 Price Changes

• We reserve the right to modify the pricing of any subscription plan or one-time purchases at any time. Such changes will be communicated to you in advance. Existing subscribers will continue to pay their current rate until their next billing cycle, after which the new pricing will apply upon renewal

14.7 Ads in Free Version

• The free version of the App may display advertisements provided by google AdMob. We do not endorse or control the centent of these third-party advertisements. Your interaction with such ads is solely between you and the advertiser

15. REFUND POLICY

15.1 Eligibility for Refund

We provide refunds only in eligible cases, such as:

• Payment errors or duplicate charges

• Technical issues preventing service usage

• Valid complaints reviewed by our team

• User can take withdrawal under 36 hours of subscription activation via autopay

15.2 Non-Refundable Cases

Refunds may not be provided if:

• Service has already been used

• You can not cancel subscription when you are purchasing first time and setting autopay by himself, you can only cancel your subscription and take refund when money deducted from your account via autopay.

• Subscription period is partially consumed

• Misuse or violation of Terms is detected

15.3 How to Request Refund

You can request a refund by:

• Contacting us via in-app chat, OR

• Sending an email to: support.keshiapp@gmail.com

15.4 Refund Process

• Requests are reviewed within a reasonable time

• If approved, refund will be processed to the original payment method

• Processing time depends on your payment provider

16. PROHIBITED ACTIVITIES

You must not:

• Bypass app limits intentionally

• Use automation or hacking tools

• Reverse engineer the App

• Use the App for surveillance or misuse

• Interfere with App systems or servers

17. LIMITATION OF LIABILITY

17.1 No Guarantee of Results

• The App is provided as a tool to assist with screen time management and digital wellbeing. We do not guarantee that the use of the App will result in specific improvements in productivity, reduction of screen time, or resolution of digital addiction. The effectiveness od the App is highly dependent on individual user commitment and external factors.

17.2 Disclaimer of Damages

• To the maximum extent permitted by applicable law, in no event shall keshi, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the app; (ii) any conduct or content of any third party on the app; (iii) any content  obtained from the App' (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

18. INTELLECTUAL PROPERTY

• The App, its design, code, and features are owned by us

• You are granted a limited, non-transferable license to use it

• You may not copy or redistribute any part of the App

19. DISCLAIMER OF WARRANTIES

The App is provided "as is" without warranties.

We do not guarantee:

• Accuracy of usage data

• Continuous or error-free service

• Compatibility with all devices

20. LIMITATION OF LIABILITY

To the maximum extent permitted by Indian law:

• We are not liable for indirect or consequential damages

• We are not responsible for loss of data or device issues

• Your use of the App is at your own risk

21. NOT A MEDICAL OR PARENTAL CONTROL TOOL

• This App is not a substitute for medical, psychological, or professional advice

• It is not a full parental control solution

22. TERMINATION

22.1 By User

You may stop using the App anytime.

22.2 By Us

We may suspend or terminate access if:

• Terms are violated

• Abuse or fraud is detected

• Legal issues arise

23. PRIVACY

Your data is handled as per our Privacy Policy.

We prioritize:

• Local storage

• Minimal data collection

• User control

24. GOVERNING LAW

These Terms are governed by Indian law.

28. ENTIRE AGREEMENT

These Terms, along with the Privacy Policy, form the complete agreement between you and us.
