Welcome to Kapsa ("the App"), operated by Bagasy Studio ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By accessing or using Kapsa, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2. Description of Service
Kapsa is an AI-powered study companion application that provides tools including, but not limited to, AI-generated flashcards, quizzes, study notes, audio transcription, and chat-based study assistance. The App is designed as an educational aid and is not a substitute for professional academic instruction.
3. AI-Generated Content Disclaimer
The App uses artificial intelligence to generate study materials, answers, and recommendations. AI-generated content may contain errors, inaccuracies, or outdated information. We make no representations or warranties regarding the accuracy, completeness, or reliability of any AI-generated content. You acknowledge and agree that:
AI-generated content should not be relied upon as the sole source of information for academic, professional, or any other decisions.
We are not responsible for any consequences arising from your reliance on AI-generated content.
You are solely responsible for verifying the accuracy of any information provided by the App.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Subscriptions and Payments
Kapsa offers subscription plans ("Kapsa Pro") that provide access to premium features. By subscribing:
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Prices are in USD and may vary by region. Applicable taxes may apply.
All purchases are processed by Apple through the App Store. We do not directly handle any payment information. Refund requests must be directed to Apple.
6. Acceptable Use
You agree not to:
Use the App for any unlawful purpose or in violation of any applicable laws.
Attempt to reverse engineer, decompile, or disassemble the App.
Use the App to generate harmful, abusive, or inappropriate content.
Interfere with or disrupt the App's servers or networks.
Share your account credentials with third parties.
Use automated systems or bots to access the App.
7. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of Bagasy Studio and are protected by intellectual property laws. Study materials you create using the App remain yours, but you grant us a limited license to process them for the purpose of providing the service.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY SPECIFIC ACADEMIC RESULTS OR OUTCOMES FROM USING THE APP.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAGASY STUDIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, ACADEMIC PERFORMANCE, GRADES, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;
ANY AI-GENERATED CONTENT OBTAINED FROM THE APP;
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
ANY ERRORS, MISTAKES, OR INACCURACIES IN THE CONTENT PROVIDED.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Bagasy Studio and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after any changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Argentina, without regard to its conflict of law provisions.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
