Kaiyuan Watermark Terms of Use

1. Introduction
These Terms of Use (the “Terms”) apply to the Kaiyuan Watermark iOS and Android application operated by Xiaoyu Li as an individual developer (“Kaiyuan Watermark” or the “App”).
By downloading, installing, accessing, or using Kaiyuan Watermark, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of the Service
Kaiyuan Watermark is a watermark camera app for iPhone, iPad, and Android phones and tablets. Depending on the specific version, it may provide the following features:
Taking photos
Recording videos
Watermark rendering
Customizable watermark styles
Optional location and weather overlays
Saving generated content to your device photo library
Some features depend on device permissions and platform availability.
Kaiyuan Watermark is licensed to you, not sold. If you obtain Kaiyuan Watermark through the App Store, your use of the App is also subject to Apple’s applicable App Store terms and usage rules. If you obtain Kaiyuan Watermark through Google Play, your use of the App is also subject to Google’s applicable Google Play terms, usage rules, and, where applicable, related end-user license terms.
3. Eligibility and Acceptable Use
You may use Kaiyuan Watermark only if you have the legal capacity to agree to these Terms and you comply with applicable laws and regulations.
You agree not to:
Use the App for illegal, fraudulent, or abusive purposes
Interfere with the normal operation of the App
Use exported images, videos, or watermark content in ways that violate the law or infringe others’ rights
Use the App to infringe intellectual property, privacy, publicity, or other legal rights
Reverse engineer, decompile, disassemble, attempt to obtain source code, modify, or create derivative works of the App, except where expressly permitted by applicable law
Use third-party services accessed through the App in violation of applicable third-party terms
4. Permissions and Device Access
Some features require access to device capabilities, including:
Camera
Microphone
Photo library
Location
Motion and orientation (used to rotate the watermark with the device)
If you deny or revoke these permissions, some features may be unavailable or may not work properly.
5. User Content
You are responsible for content you create, capture, import, edit, save, or share through Kaiyuan Watermark, including:
Photos
Videos
Custom text
Selected images used for watermark customization
You represent and warrant that you have the rights necessary to use the relevant content in the App.
Kaiyuan Watermark primarily processes user content locally on your device. These Terms do not transfer ownership of your user content to us.
6. Intellectual Property
The App’s software, app name, interface elements, and original materials we provide are protected by applicable intellectual property laws.
These Terms do not transfer ownership of the App or its underlying software to you. We grant you only a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for its intended purpose and in accordance with applicable app store usage rules.
7. Third-Party Services
Some optional features may rely on third-party or platform services.
For example:
When location watermarks are enabled, map services may be used to turn coordinates into address text
Weather text is entered on the device; the current version does not rely on third-party weather providers
For China Android distribution builds, after you agree, analytics services such as Umeng may be used for limited app usage analysis
Apple / App Store and Google / Android platform services may be involved in app distribution, permission handling, photo library access, and related device features
Third-party services may be unavailable, delayed, limited, or changed depending on your region, network environment, or third-party provider policies. We do not control third-party services and are not responsible for third-party services, third-party content, or third-party policies.
8. Privacy
Your use of Kaiyuan Watermark is also governed by our Privacy Policy, which explains how permissions, local settings, location data, map address lookup, and (for applicable distribution builds) analytics services are handled.
9. Disclaimer
To the maximum extent permitted by applicable law, Kaiyuan Watermark is provided on an “as is” and “as available” basis.
We do not warrant that:
The App will be uninterrupted or error-free at all times
Every generated watermark, export result, timestamp, coordinate, weather value, or saved file will be absolutely accurate in every scenario
Third-party services, analytics, or map address requests will always be available or successfully delivered
The App will meet all of your requirements for legal evidence, business records, or professional use
Kaiyuan Watermark is not a certified timekeeping, attendance, evidence-preservation, or professional record-keeping system. Before relying on generated results, you are responsible for verifying the relevant outputs and retaining any other records you may need.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Loss of data
Loss of profits
Business interruption
Inaccurate outputs
Export failures
Disputes arising from content created or shared by users
If applicable law does not allow limitation of certain liabilities, some of the above limitations may not apply to you.
11. Termination
To the extent permitted by applicable law, we may modify, suspend, or discontinue all or part of the App’s features at any time.
You may stop using the App at any time by uninstalling it.
If you materially breach these Terms, your right to use the App may terminate.
12. Changes to the App or These Terms
We may update the App and may revise these Terms from time to time to reflect product, legal, or operational changes. When we do, we will update the “Last updated” date above.
Your continued use of the App after updated Terms take effect constitutes acceptance of the revised Terms.
13. App Store and Google Play Terms
If you obtain Kaiyuan Watermark through the Apple App Store, you acknowledge that:
These Terms are between you and Xiaoyu Li, not between you and Apple
Apple is not responsible for providing maintenance or support for Kaiyuan Watermark
Except as required by applicable law, Apple is not responsible for claims related to Kaiyuan Watermark
If you obtain Kaiyuan Watermark through Google Play, you acknowledge that:
These Terms are between you and Xiaoyu Li, not between you and Google
Google is not responsible for providing maintenance or support for Kaiyuan Watermark
Except as required by applicable law, Google is not responsible for claims related to Kaiyuan Watermark
These Terms do not limit any rights you may have under Apple’s or Google’s applicable terms or mandatory consumer protection laws.
14. Governing Law
These Terms are governed by the laws applicable to the operator of Kaiyuan Watermark, subject to any mandatory consumer protection laws in your jurisdiction.
