These Terms of Use (“Terms”) govern access to and use of all websites, platforms, applications, and digital services operated by Jabchristi Synagogue Corp (“Jabchristi,” “we,” “us,” or “our”), including all related services and websites (collectively, the “Site”).

By accessing or using the Site, you affirmatively agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use.

IMPORTANT: THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. PLEASE READ CAREFULLY.

1. ELIGIBILITY & ELECTRONIC ASSENT

You represent and warrant that you are legally capable of entering into binding agreements.

You expressly agree that:

• You have affirmatively assented to these Terms (e.g., clickwrap, checkbox, or equivalent electronic confirmation where presented)
• Electronic acceptance constitutes a valid, enforceable signature
• All records of acceptance may be stored and used as proof of assent

Where presented, users must affirmatively assent (e.g., checkbox or clickwrap). If no such mechanism is presented, continued use of the Site constitutes acceptance to the maximum extent permitted by law.

2. LICENSE & ACCESS RIGHTS

Jabchristi grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.

You agree not to:

• Use bots, scrapers, or automated systems
• Reverse engineer or extract source code
• Circumvent security or access controls
• Interfere with Site operation or performance
• Use the Site for unlawful or prohibited purposes

Jabchristi reserves the right to suspend, restrict, or terminate access immediately, with or without notice, in its sole discretion.

3. INTELLECTUAL PROPERTY

All Content is owned or licensed by Jabchristi Synagogue Corp and protected under applicable intellectual property laws.

No rights are granted except as expressly stated. All rights not expressly granted are reserved.

4. USER ACCOUNTS

You are solely responsible for maintaining confidentiality of credentials and all activity under your account.

Jabchristi may:

• Terminate or suspend accounts immediately and without notice
• Remove content or restrict access at sole discretion
• Refuse service to any user

You agree that Jabchristi is not responsible for unauthorized account use.

5. ACCEPTABLE USE

You agree not to:

• Violate any law or regulation
• Infringe intellectual property or privacy rights
• Attempt unauthorized system access
• Disrupt Site operations or security
• Impersonate any person or entity
• Use the Site for harmful, fraudulent, or abusive purposes

Jabchristi may investigate and cooperate with law enforcement without notice.

6. DONATIONS, PAYMENTS & DIGITAL SERVICES

All donations and transactions are:

• Voluntary
• Processed via third-party providers (including Zeffy and Every.org)
• Non-refundable unless explicitly stated

Contributions may include credit card payments, ACH/bank transfers, Qualified Charitable Distributions (QCDs) from Individual Retirement Accounts (IRAs), stock donations, cryptocurrency donations, donor-advised fund grants, mutual fund donations, or other supported charitable contribution methods.

You acknowledge that:

• We do not store full payment credentials, banking information, brokerage account information, or cryptocurrency wallet credentials
• We may reject or cancel transactions at any time
• Digital services and courses may be modified, suspended, or discontinued without liability

Certain contribution methods may involve additional third-party financial institutions, custodians, exchanges, or processing providers associated with Every.org or related services.

Certain contribution methods, including Qualified Charitable Distributions (QCDs), may be initiated through financial institutions, brokerage firms, retirement account custodians, donor-advised fund sponsors, or other third-party intermediaries. Jabchristi Synagogue Corp is not responsible for delays, errors, processing decisions, reporting obligations, or actions taken by such third parties.

Jabchristi Synagogue Corp does not guarantee tax deductibility of any contribution. Donors are solely responsible for determining tax treatment.

Jabchristi Synagogue Corp does not provide legal, financial, investment, accounting, retirement, or tax advice. Donors are encouraged to consult their own professional advisors regarding any contribution.

7. NO RELIANCE / NO WARRANTIES OF INFORMATION

All Content is provided for general informational and spiritual purposes only.

You expressly agree:

• You do not rely on the Site for legal, financial, medical, or professional advice, including spiritual, religious, or philosophical guidance
• Any reliance is strictly at your own risk
• No fiduciary, advisory, or special relationship is created

8. PRIVACY & DATA CONSENT

Your use of the Site is subject to our Privacy Policy.

You acknowledge:

• Electronic communications are not fully secure
• Data may be collected, processed, and stored as described in the Privacy Policy
• Cookies, analytics, and tracking technologies may be used
• We may retain communications for operational, security, and legal purposes

9. THIRD-PARTY SERVICES

The Site may integrate or link to third-party services including:

• Zeffy (donations and payment processing)
• Every.org (donation facilitation and charitable contribution processing)
• Google (hosting, analytics, infrastructure)

We are not responsible for third-party services and disclaim all liability arising from them.

10. DISCLAIMER OF WARRANTIES

THE SITE AND ALL CONTENT ARE PROVIDED STRICTLY ON AN “AS IS” AND “AS AVAILABLE” BASIS.

To the maximum extent permitted by law, Jabchristi disclaims all warranties, including:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS
• UNINTERRUPTED OR ERROR-FREE OPERATION

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Jabchristi shall not be liable for any:

• Indirect, incidental, consequential, special, exemplary, or punitive damages
• Loss of profits, data, goodwill, or business interruption
• Damages arising from third-party services

Even if advised of the possibility of such damages.

TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• $100 USD, OR
• Amount actually paid to Jabchristi in the transaction giving rise to the claim

If the claim does not arise from a transaction, the liability cap shall be $100 USD.

12. INDEMNIFICATION

You agree to fully indemnify, defend, and hold harmless Jabchristi Synagogue Corp, its officers, volunteers, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and litigation costs) arising from:

• Your use or misuse of the Site
• Your violation of these Terms
• Your violation of law or third-party rights

13. TERMINATION & ACCESS CONTROL

We may:

• Suspend or terminate access immediately, without notice
• Block IP addresses or accounts
• Remove content at sole discretion

You agree that termination may occur without liability or obligation to provide explanation.

14. MODIFICATIONS

We may:

• Modify, suspend, or discontinue the Site at any time
• Update these Terms at any time

We will post updates with a revised date. Continued use after posting constitutes binding acceptance.

15. FORCE MAJEURE

We are not liable for any failure or delay caused by events beyond reasonable control, including:

• Natural disasters
• Cyberattacks
• Infrastructure failures
• Government actions
• War, terrorism, or civil unrest

16. ASSIGNMENT

Jabchristi may freely assign or transfer these Terms in connection with merger, acquisition, restructuring, or asset transfer.

You may not assign your rights without prior written consent.

17. BINDING ARBITRATION AGREEMENT

Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively by binding individual arbitration, except where prohibited by law.

This agreement is governed by the Federal Arbitration Act (FAA), and to the extent it conflicts with state law, the FAA controls.

You agree:

• To waive trial by jury
• To waive participation in class or collective actions
• That arbitration is the exclusive dispute resolution mechanism

Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or equivalent nationally recognized provider.

Arbitration shall take place in Delaware unless otherwise required by law.

Either party may seek temporary or injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent unauthorized access or misuse of the Site.

Each party shall bear its own costs unless otherwise required by applicable arbitration rules.

18. CLASS ACTION WAIVER

You agree that:

• Claims must be brought individually
• No class, consolidated, or representative actions are permitted

If this clause is found unenforceable, the arbitration agreement remains enforceable to the maximum extent permitted.

19. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any permitted non-arbitration claims shall be brought exclusively in courts located in Delaware.

20. TIME LIMITATION ON CLAIMS

Any claim must be brought within one (1) year of accrual or is permanently barred.

21. ATTORNEYS’ FEES

The prevailing party in any permitted legal action or arbitration shall be entitled to recover reasonable attorneys’ fees and costs.

22. SEVERABILITY

If any provision is found invalid or unenforceable:

• The remaining provisions remain in full force
• The invalid provision shall be modified to the minimum extent necessary to make it enforceable

23. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Jabchristi Synagogue Corp.

24. FEEDBACK

Any feedback submitted is non-confidential and may be used without restriction or compensation.

25. EXPORT COMPLIANCE

You agree not to use or export any Content in violation of applicable laws.
