Welcome to InstaKeys, a mobile application developed by jiayi sun (“InstaKeys,” “we,” “us,” or “our”). InstaKeys is designed to help users improve piano sight-reading, note recognition, keyboard understanding, and ear-training skills through structured and interactive practice.

By downloading, accessing, or using InstaKeys, you agree to these Terms of Use. If you do not agree to these Terms, please do not use the app.

1. Acceptance of Terms

By using InstaKeys, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.

If you are using InstaKeys on behalf of a minor, or if you are under the age required to enter into a binding agreement in your jurisdiction, a parent or legal guardian must review and agree to these Terms on your behalf where required by applicable law.

2. Description of the Service

InstaKeys provides practice tools and learning features for piano sight-reading and ear training. Depending on the version of the app and the features available, the app may include:

- note-reading and sight-reading exercises

- ear-training exercises

- MIDI keyboard input support

- on-screen keyboard practice

- interactive lessons

- practice statistics and progress-related features

- premium features available through subscription or one-time purchase options

We may add, modify, suspend, or remove features from time to time.

3. Eligibility and Use by Minors

InstaKeys may be used by a broad audience, including students and younger users. If you are under 18, or under the age of digital consent or legal majority in your jurisdiction, you should use the app with the permission, involvement, or supervision of a parent or legal guardian where required by applicable law.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use InstaKeys for personal, non-commercial use.

You may not:

- copy, reproduce, distribute, publicly display, or create derivative works from the app except as permitted by applicable law

- reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent such restriction is prohibited by law

- use the app for unlawful, fraudulent, harmful, or abusive purposes

- interfere with or disrupt the integrity, performance, or security of the app

- attempt to gain unauthorized access to the app or related systems

5. Purchases, Subscriptions, and Billing

InstaKeys may offer premium features through one-time purchases and/or auto-renewable subscriptions.

If you purchase a subscription or other in-app product through Apple:

- payment will be charged through your Apple account in accordance with Apple’s payment process

- subscription pricing, billing periods, and available purchase options are presented in the app before purchase

- auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period, subject to Apple’s billing rules

- you can manage or cancel subscriptions in your Apple account settings after purchase

- refunds, billing disputes, and payment issues are handled by Apple in accordance with Apple’s applicable policies

We do not control Apple’s billing systems and are not responsible for payment processing performed by Apple.

6. Educational Purpose Only

InstaKeys is provided for educational, training, and informational purposes only. We do not guarantee any specific learning outcomes, performance improvements, examination results, or musical achievements from use of the app.

Your progress depends on many factors, including your effort, consistency, prior experience, and practice habits.

7. Intellectual Property

The app and all related content, features, functionality, text, graphics, designs, interfaces, logos, software, and other materials made available through InstaKeys are owned by jiayi sun or licensed to us and are protected by applicable intellectual property and proprietary rights laws.

Except as expressly permitted in these Terms, you may not use, reproduce, modify, distribute, sell, license, or otherwise exploit any part of InstaKeys without prior written permission.

8. Feedback

If you choose to provide suggestions, ideas, comments, or other feedback regarding InstaKeys, you agree that we may use such feedback without restriction or compensation to you. This does not require you to provide any confidential information.

9. Acceptable Use

You agree not to use InstaKeys to:

- violate any applicable law or regulation

- infringe the rights of others

- upload, transmit, or introduce malicious code or harmful material

- misuse the app in a way that could damage, disable, overburden, or impair the app

- attempt to bypass technical limitations, security measures, or purchase mechanisms

10. Availability and Changes to the App

We may change, update, suspend, or discontinue any part of InstaKeys at any time, with or without notice, to the extent permitted by law.

We do not guarantee that the app, or any feature or content, will always be available, uninterrupted, secure, or error-free.

11. Termination

We may suspend or terminate your access to InstaKeys if:

- you violate these Terms

- your use of the app creates legal, security, or operational risk

- we are required to do so by law

- we discontinue the app or a relevant feature

You may stop using the app at any time.

Sections that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitations of liability, governing law, and dispute-related provisions.

12. Disclaimers

To the fullest extent permitted by applicable law, InstaKeys is provided on an “as is” and “as available” basis.

We disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted operation.

We do not warrant that:

- the app will be error-free or uninterrupted

- defects will be corrected

- the app will meet your expectations or requirements

- any content, results, or training outcomes will be accurate, complete, or suitable for your particular goals

13. Limitation of Liability

To the fullest extent permitted by applicable law, jiayi sun shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, use, or other intangible losses arising out of or related to your use of, or inability to use, InstaKeys.

Where applicable law does not permit certain exclusions or limitations, some of the above limitations may not apply to you.

14. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless jiayi sun from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

- your misuse of the app

- your violation of these Terms

- your violation of any law or the rights of any third party

15. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the developer’s principal place of residence or business, unless otherwise required by applicable consumer protection law.

If you reside in a jurisdiction that provides you with non-waivable consumer rights, nothing in these Terms limits those rights.

16. Changes to These Terms

We may update these Terms of Use from time to time for operational, legal, regulatory, or product-related reasons. When we do, we will update the Effective Date above. Your continued use of InstaKeys after the updated Terms become effective means that the updated Terms will apply, to the extent permitted by law.
