General Terms and Conditions for On-Site Dog Accommodation, Care and/or Other Dog-Specific Services


1. Scope


1.1 These Terms and Conditions apply to contracts for the accommodation and/or care of dogs by Zavod za zdravo in aktivno pasje življenje Octarine, Trdobojci, Trdobojci 44, 2285 Zgornji Leskovec, as well as all other services and deliveries provided by Zavod Octarine Trdobojci for the customer.


2. Conclusion of Contract, Contracting Parties


2.1 The contract is concluded upon Zavod Octarine Trdobojci's acceptance of the customer's application. Zavod Octarine Trdobojci is free to confirm the booking in writing or by email.


2.2 The contracting parties are Zavod Octarine Trdobojci and the customer. If a third party has booked on behalf of the customer, they are jointly and severally liable to Zavod Octarine Trdobojci for all obligations arising from the respective contract, provided that Zavod Octarine Trdobojci has received a corresponding declaration from the third party.


3. Customer's Obligation to Cooperate


3.1. To stay at the dog lodge, recent physical examination report for the dog is required. Zavod Octarine Trdobojci is entitled to examine the condition of the dog upon arrival in case the owner doesn´t provide veterinarian examenation report older no more than 7 days. If the examination will be done by Zavod Octarine Trdobojci and there is a suspicion for health issues, we can request visit at the veterinarian in order to accept the dog.


3.2 If special dog food and/or medication is to be administered as part of accommodation, care, the customer must provide sufficient quantities. If the quantity is insufficient, Zavod Octarine Trdobojci is entitled to procure the required food/medication without consultation and invoice the dog owner. An additional flat rate of €2.50 per kilometer traveled will be charged for the transport and collection of the required food/medication.


4. Dog Illnesses


4.1 If veterinary treatment is required during a dog's stay and the customer, the contact person in the absence of the dog owner, or the usual veterinarian cannot be reached, Zavod Octarine Trdobojci is entitled to initiate or arrange for the appropriate veterinary treatment, even without the owner's consent. This also applies if notification is not possible because the dog's health does not permit it (e.g., in emergencies). The resulting treatment costs are to be borne by the customer. An additional flat rate of €50 will be charged for travel and accompaniment to the veterinarian or veterinary clinic.


4.2 In the event of a contagious illness of a customer's dog, the resulting costs (treatment of other dogs and disinfection of the accommodation) are also to be borne by the customer.


4.3 Protection against inner and outer parasites is obligatory. In case the examenation of the dog that will take place upon arrival to the hotel would reveal parasite infection, Zavod Octarine Trdobojci is entitled to refuse the dog without reimbursment.


5. Zavod Octarine Trdobojci`s Services, Prices, Payment, Offsetting


5.1 Zavod Octarine Trdobojci is obligated to provide the dog accommodation and/or care booked by the customer and/or to provide other agreed services.


5.2 The customer is obligated to provide the information requested during each booking process truthfully and completely on the form provided for this purpose. Furthermore, the customer must pay the applicable or agreed prices for the dog accommodation and/or care and any other services used. This also applies to services and expenses incurred by Zavod Octarine Trdobojci for third parties at the request of the customer.


5.3 The agreed prices include the applicable statutory VAT. If the period between conclusion of the contract and fulfillment exceeds four months and the price generally charged by Zavod Octarine Trdobojci for such services increases, Zavod Octarine Trdobojci may increase the contractually agreed price appropriately, but by no more than 10%.


5.4 Invoices from Zavod Octarine Trdobojci without a due date are payable without deduction within 10 days of receipt of the invoice. Zavod Octarine Trdobojci is entitled to declare accrued claims due at any time and demand immediate payment. In the event of late payment, Zavod Octarine Trdobojci is entitled to charge default interest at the statutory rate (5% above the applicable base interest rate). 


5.5 Zavod Octarine Trdobojci is entitled to demand an appropriate advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates can be agreed upon in writing in the contract.


5.6 The customer may only offset or reduce a claim against a claim from Zavod Octarine Trdobojci with an undisputed or legally binding claim.


6. Customer Withdrawal, Cancellation Fees


6.1 Any withdrawal by the customer from the contract concluded with Zavod Octarine Trdobojci requires the written consent of Zavod Octarine Trdobojci. If this consent is not obtained, the agreed price under the contract must be paid even if the customer does not use the contractual services. This does not apply in cases of delay in performance by Zavod Octarine Trdobojci or an impossibility of providing the service for which Zavod Octarine Trdobojci is responsible.


6.2 If a date for withdrawal from the contract has been agreed in writing between Zavod Octarine Trdobojci and the customer, the customer may withdraw from the contract up to that date without triggering any payment or damage claims from Zavod Octarine Trdobojci. The customer's right of withdrawal expires if they do not exercise their right of withdrawal in writing to Zavod Octarine Trdobojci by the agreed date, unless there is a case of delay in performance by Zavod Octarine Trdobojci or an impossibility of providing the service for which Zavod Octarine Trdobojci is responsible.


6.3 If the customer cancels booked services, the following applies: If the cancellation occurs


at least 60 days before the agreed date, no cancellation fee will be charged;


30 to 59 days before the agreed date, the customer is obligated to pay 50% of the contractually agreed price for dog accommodation, care, and/or other services as cancellation fees;


less than 30 days before the agreed date, the customer is obligated to pay 100% of the contractually agreed price for dog accommodation, care, and/or other services as cancellation fees.


The customer is free to provide evidence that no damage has been incurred or that the damage incurred by Zavod Octarine Trdobojci is less than the requested flat rate.


7. Withdrawal by Zavod Octarine Trdobojci


7.1 If the customer's right of withdrawal within a certain period has been agreed in writing, Zavod Octarine Trdobojci is entitled to withdraw from the contract during this period if other customers request the contractually booked services and the customer does not waive their right of withdrawal upon Zavod Octarine Trdobojci's request.


7.2 If an agreed advance payment is not made even after the expiration of a reasonable grace period set by Zavod Octarine Trdobojci with a threat of rejection, Zavod Octarine Trdobojci is also entitled to withdraw from the contract.


7.3 Furthermore, Zavod Octarine Trdobojci is entitled to withdraw from the contract for good cause for objectively justified reasons, for example, if force majeure or other circumstances beyond Zavod Octarine Trdobojci's control make fulfillment of the contract impossible.


7.4 Zavod Octarine Trdobojci must notify the customer immediately of the exercise of the right of withdrawal.


7.5 In the event of a justified withdrawal by Zavod Octarine Trdobojci, the customer is not entitled to compensation.


8. Provision of Accommodation, Handover, and Return


8.1 Unless otherwise agreed, the customer has no right to a specific accommodation for their dog(s).


8.2 When booking Overnight Care or Day Care, booked accommodations are available to the customer from 6:00 a.m. on the agreed arrival date. The customer has no right to earlier availability.


8.3 On the agreed departure date, dogs accommodated at Zavod Octarine Trdobojci must be picked up by 9:00 p.m. at the latest for Day Care and by 11:00 a.m. for Overnight Care. In the event of late pick-up, Zavod Octarine Trdobojci is entitled to re-invoice the corresponding rate for the booked service.


9. Liability of Zavod Octarine Trdobojci


9.1 Zavod Octarine Trdobojci is liable to the customer in the event of intent or gross negligence, as well as in the event of a culpable breach of essential contractual obligations in a manner that jeopardizes the purpose of the contract (cardinal obligation). 


9.2 If Zavod Octarine Trdobojci is liable for the breach of cardinal obligations without intent or gross negligence, Zavod Octarine Trdobojci's liability is limited to the extent of the damage that could be expected at the time of conclusion of the contract, based on the circumstances known at that time.


9.3 The limitations of liability do not apply to any claims for damages due to injury to human life, body, or health.


10. Final Provisions


10.1 Amendments or additions to the contract, the acceptance of the application, or these General Terms and Conditions must be made in writing. Unilateral amendments or additions by the customer are invalid.


10.2 The place of performance and payment is the registered office of Zavod Octarine Trdobojci.


10.3 Slovenian law applies.


10.4 Should individual provisions of these Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. Otherwise, the statutory provisions shall apply.
