Terms & Conditions

These terms and conditions apply to the Influencer Kit app (hereby referred to as the "Application") for mobile devices that was created by MUHARREM KOROGLU (hereby referred to as the "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

1. Use of the Application

Unauthorized copying, modification of the Application, any part of the Application, or the Service Provider’s trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted.

All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for its services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

2. AI-Powered Features

The Application includes AI-powered functionality, including but not limited to:

- Video analysis

- Content insight generation

- Thumbnail generation

- Optional thumbnail consistency support using user-provided references

To provide these features, the Application may process content submitted by you, including uploaded videos, selected frames, user-selected content details, and optional face, object, and style references.

By using these features, you acknowledge that your submitted content may be temporarily processed by third-party infrastructure and AI services used by the Application, including Google Gemini via Firebase AI Logic and related Firebase services.

The Service Provider does not guarantee that AI-generated outputs will be accurate, complete, commercially successful, platform-compliant, or suitable for any particular purpose. AI-generated suggestions, analyses, and thumbnails are provided for informational and creative assistance only.

You are solely responsible for reviewing, approving, editing, and deciding whether to use any AI-generated output.

3. User Content and Responsibility

You retain responsibility for the content you upload or submit to the Application, including videos, thumbnails, and optional reference images.

You agree that you will not upload, submit, or request processing of content that:

- infringes the intellectual property rights of others;

- violates any law or regulation;

- is unlawful, abusive, defamatory, fraudulent, hateful, or deceptive;

- contains malicious code or attempts to interfere with the operation of the Application;

- violates the privacy or publicity rights of any third party.

If you upload a face-containing image, object image, or style reference, you represent that you have the right to use and submit that content for processing.

The Service Provider reserves the right to restrict or terminate access to the Application if submitted content violates these Terms or applicable law.

4. Temporary Media Processing

The Application may temporarily store uploaded media and processing assets, including uploaded videos and optional references, in order to provide requested features.

Uploaded videos are stored temporarily in Firebase Storage and are automatically deleted after approximately 24 hours. Optional face, object, and style references are processed only as needed for thumbnail generation and are deleted after processing or within a short temporary retention period.

The Application is not intended to function as a permanent cloud storage or archival system.

5. Subscriptions, Credits, and Paid Features

The Application may offer free and paid functionality, including subscription-based access and/or credit-based usage.

The availability of certain features, credits, upload limits, or usage limits may vary depending on whether you are using the free or paid version of the Application.

Where applicable, purchases, subscriptions, and renewals are handled through Apple’s in-app purchase system and may also be managed through third-party subscription infrastructure such as RevenueCat.

You are responsible for reviewing the pricing, billing terms, and renewal conditions presented to you before completing any purchase.

Unless otherwise required by applicable law or platform policy, all purchases are final and non-refundable except as determined by Apple’s applicable purchase and refund policies.

6. Device and Account Security

The Application stores and processes certain information that you provide in order to provide the Service. It is your responsibility to maintain the security of your device and your access to the Application.

The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions may expose your device to malware, viruses, malicious programs, compromise your device’s security features, and may result in the Application not functioning correctly or at all.

7. Third-Party Services

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions or service terms of third-party service providers used by the Application:

- Google Analytics for Firebase

- Firebase Crashlytics

- RevenueCat

- Firebase

- Google AI / Gemini

The Service Provider is not responsible for the practices, content, or availability of third-party services.

8. Internet Connectivity and Charges

Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider.

The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi, mobile data, or other connectivity issues.

If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider’s agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the Application, including roaming data charges if you use the Application outside of your home territory without disabling data roaming.

By using the Application, you accept responsibility for any such charges.

9. No Warranty

While the Service Provider strives to ensure that the Application is useful, current, and functional, the Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.

The Service Provider does not guarantee that:

- the Application will always be available or error-free;

- AI-generated outputs will be accurate or suitable;

- the Application will meet your expectations or business goals;

- the Application will be compatible with all devices or operating system versions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, business opportunity, goodwill, data, or use arising out of or related to your use of the Application.

This includes, without limitation, any reliance on AI-generated analysis, thumbnail suggestions, or content recommendations.

11. Updates and Termination

The Service Provider may wish to update the Application at some point. The Application is currently available on iOS, and system requirements may change over time.

You agree to accept updates to the Application when offered.

The Service Provider may also cease providing the Application and may terminate its use at any time without providing prior termination notice. Unless otherwise stated, upon any termination:

- the rights and licenses granted to you under these Terms will end;

- you must cease using the Application; and

- if necessary, delete it from your device.

12. Changes to These Terms and Conditions

The Service Provider may periodically update these Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify users of any changes by posting the updated Terms and Conditions on this page.
