Terms of Use (User Agreement)

Important: Please read these Terms of Use ("Terms") carefully before using Image Converter ("App", "Service"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User", "you", "your") and the developer and operator of Image Converter ("we", "us", "our").

By using the App, you confirm that:

You are at least 13 years of age (or the minimum age in your jurisdiction).
If you are under 18 (or the age of majority in your jurisdiction), you have obtained parental or guardian consent.
You have the legal capacity to enter into this agreement.
Your use of the App complies with all applicable laws and regulations.

2. Description of Service

Image Converter is a multi-format file converter that processes files entirely on your device. The App provides:

Image Conversion: Convert between PNG, JPEG, HEIC, GIF, TIFF, BMP, WEBP, ICO, AVIF, and more.
Video Conversion: Convert between MP4, MOV, AVI, WMV, WEBM, FLV, MKV formats.
Audio Conversion: Convert between MP3, AAC, M4A, WAV, FLAC, WMA, OGG formats.
Document Conversion: Convert between PDF, TXT, RTF, HTML, Markdown, DOCX, SVG formats.
Image Editing Tools: Compression, resizing, watermarking, cropping, rotation, metadata removal, GIF creation, photo collage, and filters.
Batch Processing: Convert multiple files simultaneously and merge photos into PDF.
Conversion History: Track and review past conversions.

3. App Versions & Subscription Plans

3.1 Free Version

The Free version of Image Converter provides:

Access to core conversion features with daily usage limits.
Limited batch processing capabilities.
Basic image editing tools.
Ad-supported experience (banner, interstitial, and rewarded video ads).

3.2 Premium / Pro Version

The Premium version is available through in-app purchases and provides:

Unlimited daily conversions across all formats.
Unlimited batch processing and PDF creation.
Full access to all editing tools and features.
Ad-free experience.
Import from URL functionality.
Priority feature updates.

4. In-App Purchases & Payment Terms

4.1 Payment Processing

All purchases are processed through the Apple App Store.
Payment is charged to your Apple ID account upon confirmation of purchase.
Prices are displayed in your local currency and include applicable taxes.
We reserve the right to modify pricing; existing subscriptions will not be affected until renewal.

4.2 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in your Apple ID Account Settings.

4.3 Free Trials

Certain subscription plans may include a free trial period.
During the trial, you have full access to Premium features.
The trial converts to a paid subscription automatically unless canceled before the trial ends.
Any unused portion of a free trial period is forfeited when you purchase a subscription.

4.4 Refunds

Refund requests must be directed to Apple, as Apple handles all payment processing.
To request a refund, visit reportaproblem.apple.com or contact Apple Support.
We cannot process refunds directly.

4.5 Paid App Version

If you have purchased the paid version of Image Converter (one-time purchase from the App Store), you are entitled to all Premium features without subscription. This entitlement is tied to your Apple ID and can be restored on any device signed in with the same Apple ID.

5. Advertising (Free Version)

By using the Free version of Image Converter, you agree that:

Advertisements will be displayed within the App, including banner ads, interstitial ads, native ads, and rewarded video ads.
Ad content is provided by third-party ad networks and is not controlled by us.
We are not responsible for the content, accuracy, or availability of third-party advertisements.
You may interact with ads at your own discretion; any transactions with advertisers are between you and the advertiser.
You may opt out of personalized advertising through iOS privacy settings.
Rewarded video ads may offer temporary access to Premium features or additional conversion credits.

6. User Conduct & Acceptable Use

You agree to use Image Converter only for lawful purposes. You shall NOT:

Use the App to convert, process, or distribute illegal, obscene, defamatory, or infringing content.
Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
Circumvent, disable, or interfere with any security, licensing, or DRM features.
Use the App to process files that violate third-party intellectual property rights.
Use automated systems, bots, or scripts to access or interact with the App.
Redistribute, sublicense, rent, lease, or loan the App.
Remove, alter, or obscure any proprietary notices, labels, or marks.
Use the App in any manner that could damage, disable, or impair its functionality.
Attempt to bypass usage limits in the Free version through any unauthorized means.

7. Intellectual Property

7.1 Our Rights

The App, including its design, code, graphics, user interface, algorithms, and all related intellectual property, is owned by Image Converter and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain all ownership rights to the files you process through Image Converter. We claim no ownership over your input or output files. Since all processing occurs locally on your device, your files never leave your control.

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and commercial purposes (e.g., converting files for your business), subject to these Terms. This license does not include the right to modify, distribute, or create derivative works of the App itself.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, error-free, or free of harmful components.
Conversion results will meet your specific requirements or expectations.
All file formats will be supported on all devices (some formats depend on hardware capabilities).
Output file quality will be identical to or better than the original in all cases.
The App will be compatible with all future iOS versions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, revenue, or business opportunities.
Our total aggregate liability for any claims arising from or relating to the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim, or $50 USD, whichever is greater.
We are not responsible for any data loss resulting from file conversion, device malfunction, or user error.
We are not liable for the content, quality, or legality of files you process through the App.

10. Indemnification

You agree to indemnify, defend, and hold harmless Image Converter, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from:

Your use or misuse of the App.
Your violation of these Terms.
Your violation of any third-party rights.
Content you process through the App that infringes on intellectual property rights.

11. Third-Party Services

The App may integrate or interact with third-party services:

Apple App Store: Governed by Apple's Terms of Service and Apple Media Services Terms and Conditions.
Ad Networks (Free version): Governed by their respective terms and privacy policies.
Open-Source Libraries: The App incorporates open-source components (e.g., FFmpeg) under their respective licenses. FFmpeg is licensed under LGPL 2.1.

We are not responsible for the availability, content, or practices of third-party services.

12. Termination

You may terminate this agreement at any time by uninstalling the App.
We may suspend or terminate your access to the App if you violate these Terms.
Upon termination, your license to use the App ceases immediately.
Active subscriptions must be canceled through Apple to prevent further charges.
Sections regarding Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law survive termination.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App or on our website.

Material changes will be communicated through an in-app notification.
Continued use of the App after modifications constitutes acceptance.
If you disagree with updated Terms, you should discontinue use and uninstall the App.

14. Modifications to the App

We reserve the right to:

Modify, update, or discontinue any feature or the entire App at any time.
Change the availability of free or premium features.
Adjust usage limits for the Free version.
Add or remove supported file formats.

We will endeavor to provide advance notice of significant changes when possible.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the App developer is incorporated, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation first.
If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration authority.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Apple-Specific Terms (EULA)

As the App is distributed through the Apple App Store, the following Apple-specific terms apply:

These Terms are between you and Image Converter, not Apple Inc. Image Converter is solely responsible for the App and its content.
The license granted herein is limited to a non-transferable license to use the App on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
Image Converter (not Apple) is responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
Apple has no obligation to provide maintenance or support for the App.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Image Converter regarding the use of the App and supersede all prior agreements, understandings, and communications.

These Terms of Use are available in multiple languages within the App. In case of any discrepancy between translated versions, the English version shall prevail.
