1. Acceptance of Terms

By downloading or using this application, you agree to be bound by:

The Apple Standard End User License Agreement; and

These supplemental Terms of Service (“Terms”), which apply specifically to the App.

If these supplemental Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls to the extent of the conflict.

If you do not agree to these Terms, do not use the App.

2. Use of the App

The App is licensed for personal, non-commercial use. You may not copy, modify, reverse engineer, distribute, abuse, or attempt to bypass any security, subscription, or usage limits.

You must only upload images that you own or have permission to use. Do not upload illegal, harmful, confidential, or privacy-infringing content.

3. AI Identification

The App uses Google Gemini artificial-intelligence models to analyze submitted images and generate identification results. Requests are currently routed through OpenRouter, an AI infrastructure provider.

AI results may be inaccurate, incomplete, or outdated and are provided for general informational purposes only. We do not guarantee the identification of any plant, object, antique, mountain, condition, authenticity, origin, or value.

Do not rely on the App for medical, veterinary, poisoning, navigation, safety, legal, financial, or professional decisions. Important results should always be verified with a qualified professional.

4. Images and Privacy

You retain ownership of your submitted images. You give us permission to transmit and process them only as reasonably necessary to provide the requested identification, maintain security, and comply with legal obligations.

Images and related information may be processed by our servers, OpenRouter, and the provider operating the Google Gemini model. Other service providers, including Firebase and RevenueCat, may process account, security, usage, or subscription information.

5. Subscriptions and Payments

The App may offer auto-renewing subscriptions for premium features. Purchases are managed through RevenueCat and processed by the Apple App Store, Google Play, or the applicable marketplace.

Subscriptions automatically renew unless canceled before the renewal deadline shown by the marketplace. Payment is charged to your marketplace account. You can manage or cancel subscriptions through your account settings.

Deleting the App does not cancel a subscription. Refunds and free trials are subject to the rules of the marketplace and applicable consumer law.

6. Intellectual Property

The App, including its software, design, branding, text, graphics, and developer-provided content, is owned by us or our licensors and is protected by intellectual-property laws.

These Terms do not transfer ownership of the App or its technology to you.

7. Third-Party Services

The App relies on third-party services, including Google Gemini, OpenRouter, Firebase, RevenueCat, Apple, and Google Play. These services may be governed by their own terms and privacy policies.

We are not responsible for third-party outages, changes, restrictions, or discontinued services.

8. Disclaimers

The App and all identification results are provided “as is” and “as available,” without warranties of accuracy, reliability, availability, fitness for a particular purpose, or non-infringement.

Plant results must not be used to determine whether something is safe to eat or touch. Antique results are not certified appraisals or authenticity guarantees. Mountain results must not be used for navigation or emergency decisions.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages resulting from the use of, inability to use, or reliance on the App or its AI-generated results.

Nothing in these Terms limits consumer rights or liability that cannot legally be excluded.

10. Suspension and Termination

We may restrict or terminate access if you violate these Terms, misuse the App, create a security risk, or attempt to bypass subscription or usage restrictions.

Termination of App access does not automatically cancel an active marketplace subscription.

11. Changes to These Terms

We may update these Terms to reflect changes to the Apps, services, or legal requirements. Continued use after updated Terms take effect signifies acceptance, except where additional consent is legally required.
