"Perspectives from Outside" and "Book Spots"

Writers from other jurisdictions or from disciplines outside of German public law often have interesting perspectives on German public law which are, however, not always represented in German debates. The series "Perspectives from Outside" seeks to offer a digital forum for discussion of such outside perspectives. We began in 2021 with Justin Collings' Scales of Memory. Complementing our "Perspectives from outside" series, the sibling series "Book Spots" would like to throw the spotlight on recent publications from the German legal discourse that aspire to transcend it at the same time in some respect. This series wants to enrich the debate – online for now – by pitting new books against challenging perspectives.

In diesem Webinar der deutschen Sektion von ICON•S wollen wir völkerrechtliche Fragen behandeln, die sich im Zusammenhang mit dem Verfahren im Fall Südafrika v. Israel und der Anordnung vorläufiger Maßnahmen durch den Internationalen Gerichtshof (IGH) am 26. Januar 2024 stellen. Das Webinar richtet sich an Studierende und alle anderen Interessierten. Es adressiert insbesondere die Zuständigkeit des IGH, mögliche Auslegungen des Beschlusses vom 26.1. sowie mögliche Konsequenzen und Wirkungen des Verfahrens.

Nächster Book Spot mit Autor:innen und Kommentator:innen zu "(Post)Koloniale Rechtswissenschaft" am 14.6., 14:00 Uhr

Die Rolle des Rechts und der Umgang der Rechtswissenschaften mit dem deutschen Kolonialismus spielten in den rechtswissenschaftlichen Debatten der Nachkriegszeit lange Zeit keine herausragende Rolle, trotz zahlreicher historischer Kontinuitäten zwischen den Verbrechen und der rassistischen Ideologie des Kolonialismus und des Nationalsozialismus. Next Book Spot with authors and commentators on "(Post)Koloniale Rechtswissenschaft" on 6/14, 2:00 p.m.

For a long time, the role of law and how legal scholarship dealt with German colonialism did not figure prominently in postwar jurisprudential debates, despite numerous historical continuities between the crimes and racist ideology of colonialism and National Socialism. In their volume "(Post)Koloniale Rechtswissenschaft - Geschichte und Gegenwart des Kolonialismus in der deutschen Rechtswissenschaft" a number of authors under the editorship of Philipp Dann, Isabel Feichtner, and Jochen von Bernstorff turn to the question of the role German colonialism and postcolonialism played in the jurisprudential literature of its time. We look forward to discussing the book and the questions it raises with four commentators on June 14 at 2:00 pm: Prof. Dr. Thomas Duve (Co-Direktor des Max Planck Instituts für Rechtsgeschichte in Frankfurt), Dr. Elisabeth Kaneza (Deutsches Zentrum für Integrations- und Migrationsforschung), Prof. Dr. Frank Schorkopf (Universität Göttingen) as well as Amadou Sow (Viadrina University) and Prof. Dr. Philipp Dann (HU) and Dr. Alexandra Kemmerer (Max Planck Institut Heidelberg) will respond.

Next Online „Book Spot“ with Matthias K. Klatt on his new book “Das Sondervotum beim Bundesverfassungsgericht“ (The Dissenting Opinion at the German Federal Constitutional Court) – comments by Gertrude Lübbe-Wolff

In his recently published dissertation “Das Sondervotum beim Bundesverfassungsgericht“ (The Dissenting Opinion at the German Federal Constitutional Court) Dr. Matthias K. Klatt (Hamburg) explores the practice of dissenting opinions at the German Federal Constitutional Court (GFCC) comprehensively; he carves out crucial functions of this display of dissent vis-à-vis the majority opinion. We will be discussing his insights on 27 June at 6 pm with Prof. Gertrude Lübbe-Wolff (Bielefeld). Prof. Lübbe-Wolff not only held the office of Judge at the GFCC and was one of the more active dissenters at the court, but has also extensively researched the comparative deliberative practices of constitutional courts. This matchup bodes well for an interesting discussion.

"Patterns of Legitimacy" - June 24-25, 2022 - University of Jena

Am 24. - 25. Juni fand die Konferenz "Patterns of Legitimacy" an der Universität Jena statt, bei der Prof. Anika Klafki mit dem deutschen ICON-S Chapter kooperiert. Thematisch ging es darum, unterschiedliche Legitimitätsvorstellungen in unterschiedlichen nationalen und internationalen Kontexten auszuloten und auf den Prüfstand zu stellen. Vortragende waren u.a. Prof. Anika Klafki organized the conference "Patterns of Legitimacy" at the University of Jena from June 24-25 in cooperation with German ICON-S chapter. The conference explored and critically analyzed different ideas and understandings of legitimacy in different contexts. Abstract: This article presents a cultural study of proportionality in German public law. ‘Cultural study’ is used to indicate an approach that looks not so much at proportionality and its – cultural, social, political – contexts and implications, but that rather tries to develop a sense of proportionality’s character as itself a cultural artifact: as a ‘way of doing legal knowledge’ in German public law. The setting for this study is an area of legal education that is pervasive, although rarely analyzed, in Germany: the classes and materials offered by commercial providers, called Repetitoren, that aim to prepare students for the all-important ‘First Juridical Examination’. Based principally on close readings of teaching materials and on classroom observations, I develop an account of the ways in which proportionality’s ‘success’ is produced and experienced.

"Book Spot" with Sigrid Boysen

Wir begannen unsere Reihe der "Book Spots" am 13. Juli um 18 Uhr s.t. (CEST) mit Prof. Sigrid Boysen, Professorin für Öffentliches Recht, Völker- und Europarecht an der Helmut-Schmidt-Universität Hamburg, die mit „Die postkoloniale Konstellation" (Mohr Siebeck, 2021) eine faszinierende Genealogie des internationalen Umweltrechts vorgelegt hat. Prof. Pascale Cancik und Prof. Markus Krajewski (Erlangen-Nürnberg) kommentierten Sigrid Boysens jüngstes Buch.

We start our "Book Spots" on July 13, at 6.00 pm (CEST) with Prof. Sigrid Boysen, Professor of Public Law, International and European Law at the Helmut Schmidt University in Hamburg, who has recently put out a fascinating genealogy of international environmental law: "Die postkoloniale Konstellation" (Mohr Siebeck, 2021). "Perspectives from outside" with Justin Collings

We began the series "Perspectives from outside" on May 31 , at 2.15 pm (CET) with Prof. Justin Collings, Associate Dean for Research and Academic Affairs and Professor of Law at Brigham Young University whose earlier work "Democracy’s Guardians: A History of the German Federal Constitutional Court, 1951-2001, (Oxford University Press 2015)" has enriched our understanding of the court. Prof. Collings presented his newest book "Scales of Memory: Constitutional Justice and Historical Evil", with Prof. Christoph Schönberger commenting.

“Thinking of A Book Project in Law? From Research Design to Publication”

Zoom-Workshop with J.H. H. Weiler, 3 December, 1-4 pm CET

The workshop addresses doctoral students in law, legal scholars writing a habilitation in law or, more generally, early career professors embarking on a book project.

The casualty rate among legal doctorates and other book projects is high. For doctorates, on some counts, it is more than 50%. A high number of manuscripts remain incomplete and time is inefficiently employed leading to an unnecessary prolongation of the period it takes to complete the manuscript. Most troubling are those completed books, which do not reflect the true intellectual potential of the authors. Very often the process of writing is remembered as a period of frustration and even misery.

The questions that will be addressed in the workshop include the following: How does one identify a promising research topic? How does one narrow it down to viable research questions? These are just some of the questions one faces in the early stages of the process, questions to which often answers are not easy to come by. The same wilderness exists during the process of research and writing. Sometimes the questions are prosaic – but no less crucial. Here are some examples: How much to read before one can start writing? How to handle Writer’s Block? How to deal with negligent, indifferent or inappropriate supervision? Should I be worried by discovering that someone else is working on the same topic?

The workshop will be held via zoom for three hours with two 15 minute breaks between the hours. All participants will be required to have their cameras on, but can create virtual backgrounds to address privacy concerns.

Participation is only possible upon registration and admission. The number of participants is limited. If you would like to participate, please send an email to iconsdeutschland@gmail.com, indicating your institutional affiliation, what kind of project you are working on (doctoral thesis, habilitation or other) and which stage of your project you see yourself at. Registration ends on Nov. 20, 2020.

J. H. H. Weiler served as President of the European University Institute in Florence – an institution focused entirely on research and doctoral studies. He also served as Chair of the Graduate Program at the University of Michigan Law School, as Co-Chair of the Graduate Program at Harvard Law School and currently is Director of doctoral studies at NYU School of Law. He serves, too, as Co-Editor in Chief of EJIL and ICON. Joseph Weiler successfully defended his Ph.D.in 1985.

Wie geht es mit dem Veröffentlichen in Deutschland und im Ausland? Wer wählt eigentlich aus, welche Texte in welchen Zeitschriften veröffentlicht werden. Was ist eigentlich Peer Review und wie geht man mit einem "revise und resubmit" um? Wie und wo kann man ein Buch auf Deutsch oder Englisch veröffentlichen?

Die Coronakrise hat in vielen bestehende Ungleichheiten deutlich gemacht oder vertieft. Kann und sollte sie deshalb ein Anstoß für eine neue Diskussion über fundamentale Gerechtigkeitsfragen in unserer Gesellschaft sein?

Tim Wihl, FU Berlin, moderiert hierzu unsere Diskussion mit Prof. Anuscheh Farahat (FAU Erlangen), Alexander Graser (Uni Regensburg), Silke Laskowski (Uni Kassel) und Mehrdad Payandeh (Bucerius Law School), die Themen wie Solidarität in Europa, soziale Fragen, Geschlechtergerechtigkeit und Rassismus miteinbezieht.
