Welcome to the games from Ice Labs ("we," "us," or "our")! These Terms of Service ("Terms") govern your access to and use of our virtual reality games ("the Games") on the Meta Horizon Store and related Meta Platforms Technologies. By downloading, installing, or using any of our Games, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Games.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Games for your personal, non-commercial use on a compatible Meta device, subject to these Terms. You may not:
Redistribute, sell, or rent the Games.
Reverse engineer, decompile, or disassemble the Games.
Modify the Games or create derivative works.
Use the Games for any illegal or unauthorized purpose.
Circumvent any technical protection measures in the Games.
To use our Games, you must have a valid Meta Horizon Profile. You are responsible for all activity that occurs under your profile while using our Games. You agree not to:
Harass, bully, or threaten other users.
Use offensive, discriminatory, or inappropriate language.
Cheer or exploit bugs to gain an unfair advantage.
Upload or transmit any harmful content, including viruses, malware, or spam.
Impersonate any person or entity, including an Ice Labs employee.
We reserve the right to suspend or terminate your access to our Games at any time, with or without notice, for any violation of these Terms.
Our Games may include virtual items or content ("Virtual Items") that can be purchased with real money or earned in-game. Virtual Items are a limited license right, have no monetary value, and cannot be redeemed for real money or goods of monetary value. You may not sell, trade, or transfer Virtual Items outside of the Games. All purchases are final and non-refundable, except as required by law.
All content, features, and functionality within our Games, including but not limited to graphics, audio, user interfaces, code, and design, are the exclusive property of Ice Labs or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use any of our intellectual property without our prior written consent.
THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAMES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ICE LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAMES.
These Terms shall be governed by the laws of the State of [State, e.g., California], without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in [City and State, e.g., San Francisco, California].
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page. Your continued use of our Games after the effective date of the new Terms constitutes your acceptance of the new Terms.
These Terms constitute the entire agreement between you and Ice Labs regarding the use of our Games. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
