Terms and Conditions — Hush

Welcome to Hush. These Terms and Conditions ("Terms") govern your use of the Hush mobile application ("App"), operated by [Your Company Name] ("we", "us", or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms
   By using Hush, you accept and agree to these Terms and our Privacy Policy. We may modify these Terms at any time; we will post updates in the App or provide notice as required. Continued use after changes constitutes acceptance.

2. Eligibility
   You must be at least 13 years old to use the App. If you are under the legal age for your jurisdiction, you may use the App only with the involvement and permission of a parent or guardian.

3. No User Accounts / Local Credits

• Hush does not require or maintain user accounts. You can use the App without registering an account.

• Purchases of credits are processed through the relevant platform store (Apple App Store or Google Play) and are stored locally on your device. Locally stored credits are not linked to an account on our servers.

• IMPORTANT: If you delete or uninstall the App, or clear its data, locally stored credits will be lost and cannot be recovered. If you change devices, credits do not automatically transfer. Keep purchase receipts from the platform in case you need to contact platform support.

4. Purchases, Billing and Refunds

• All purchases are subject to the terms of the platform (App Store / Google Play). Pricing, billing, and payment processing are handled by those platforms or third-party payment processors.

• We do not have access to your raw payment card details. For refunds, transaction disputes, or billing issues, you should contact the platform where you made the purchase. We may assist where possible.

5. License and Use of the App

• Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App on your compatible device.

• You agree not to: reverse engineer, decompile, disassemble, copy, modify, or create derivative works of the App, except to the extent permitted by law.

6. Intellectual Property

• All content, logos, trademarks, and materials in the App are owned by us or our licensors. You may not use any of our intellectual property without prior written permission.

7. User Content and Conduct

• If the App allows you to submit content (e.g., profile images or posts), you represent that you own or have rights to that content and you grant us a license to use it as described in the Privacy Policy.

• You agree not to upload unlawful, infringing, abusive, or objectionable content.

8. Microphone, Audio and Permissions

• Some features of the App may require microphone access. The App will request permission before accessing your microphone. Use of the microphone is subject to your consent.

• Microphone access is used only for the stated feature; unless explicitly stated, audio captured is not stored permanently or transmitted without notice. If the App records or uploads audio, those behaviors will be clearly described in-app and in the Privacy Policy.

9. Disclaimers and Limitations of Liability

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• WE ARE NOT RESPONSIBLE FOR LOSS OF CREDITS OR DATA CAUSED BY UNINSTALLATION, DEVICE FAILURE, OR ACTIONS BY THE APP PLATFORMS.

• TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE APP DURING THE PAST 12 MONTHS (IF ANY). WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.

10. Termination

• We may suspend or terminate your access to the App for violation of these Terms or for any lawful reason. You may also stop using the App at any time by uninstalling it.

11. Changes to the App

• We may modify, suspend, or discontinue the App or any features at any time without liability.

12. Governing Law and Dispute Resolution
