Hummet - Terms Of Use

1. Overview

These Terms of Service ("Terms", "Agreement") govern your use of our services ("Services", "Hummet Services"), including the Hummet application, a video social platform developed by us. You are one party and the other party is Hummet Team ("we" or "Hummet").

When using the Hummet Services, you will be subject to the Hummet Privacy Policy, and you will be subject to additional guidelines or rules posted on or made available to you on the Hummet Services, or applicable to specific services and features disclosed to you.

We may modify these Terms from time to time at our sole discretion, and by continuing to use our Services, you agree to be bound by the revised Terms. By using our Services, you agree to all terms of these Terms.

Individuals or entities in Cuba, Iran, North Korea, Sudan, Syria and Crimea are not allowed to use Hummet services. We currently do not accept payments from individuals or entities in the above regions, nor do we conduct business in these regions.

2. Content

Hummet allows users to use chat, video services, etc., and engage in content, messages, text, sounds, images, applications, code or other data or materials that you may create, post, transmit, perform or store on the Services ("User Content" ). Users of the Hummet Services may also overlay virtual items and other features provided by Hummet ("Hummet Features") onto that User Content and have that User Content transmitted through the Hummet Services. The opinions expressed by other users on the Hummet Service do not represent our opinions or values.

In order to operate our global services, we need to store and distribute content and data in data centers and systems around the world, including outside your country of residence.

3. Account

You are solely responsible for maintaining your Hummet account and password. All actions and activities conducted through your Hummet account will be deemed actions and activities for which you are solely responsible. Please ensure that the information you provide to Hummet when registering and at any other time is true, accurate, current and complete to the best of your knowledge.

We may allow you to register and log into the Hummet Service through certain third-party services. The collection, use and disclosure of your information by a third party will be subject to the privacy policy of that third party service.

We reserve the right to disable your user account at any time, including if you fail to comply with any provision of these Terms or if activity occurring on your account (in our sole discretion) will or may cause harm or damage to the Hummet Service or infringe or violate any third party rights, or violate any applicable laws or regulations.

If you no longer want to use our services and wish to delete your account, we can handle this for you. Please contact us at hummet.userfeedback@proton.me and we will provide you with further assistance and guide you through the process. 4. Age

Our services are only accessible to adults aged 18 and over. If you are under 18, please do not use our services.

5. Use of services

Your access to and use of the Hummet Services is subject to these Terms and all applicable laws and regulations. You agree to abide by the Hummet Terms of Service and Hummet Community Guidelines, and will not:

i. Create, upload, transmit, distribute or store any content that is inaccurate, illegal, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory or otherwise objectionable;

ii. Defame, harass, abuse, threaten or deceive Hummet users, or collect or attempt to collect personal information about users or third parties without their consent;

iii. Impersonate any person or entity, misrepresent your affiliation with any person or entity, or access another person’s Hummet account without permission, falsify another person’s identity or the content of information transmitted through the Hummet Service, or engage in any other similar fraudulent activity;

iv. Remove, circumvent, disable, damage or otherwise interfere with security-related features of the Hummet Services or User Content, features that prevent or restrict the use or copying of any content accessible through the Hummet Services, features that impose restrictions on the Hummet Services, use Hummet Services or User Content, or remove copyright or other proprietary notices on Hummet Services or User Content;

v. Interfere with or disrupt the operation of the Hummet Services or any user's enjoyment of the Hummet Services in any way, including by uploading or otherwise transmitting viruses, adware, spyware, worms or other malicious code;

vi. Modify, adapt, translate or create derivative works based on the Hummet Live Services or any part thereof, except and only to the extent expressly permitted by applicable law notwithstanding this limitation;

vii. Reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Hummet Service or any part thereof, except and only to the extent expressly permitted by the laws of the jurisdiction in which you reside;

viii. Attempt to circumvent any content filtering technology we employ, or attempt to access any service or area of the Hummet Service that you are not authorized to access;

ix. Interfere with or disrupt the Hummet Live Service or servers or networks connected to the Hummet Live Service, or violate any requirements, procedures, policies or regulations of networks connected to the Hummet Live Service; in any manner that may interfere with, disrupt, negatively affect or prevent other Use the Hummet Services in a manner that allows the User to fully enjoy the Hummet Services, or in any manner that could damage, disable, overburden, or impair the functionality of the Hummet Services;

x. Manipulate identifiers to obscure the origin of any User Content transmitted through the Twitch Service.

Hummet is not responsible for any statements or representations contained in User Content. Hummet does not endorse any User Content, opinions, recommendations or suggestions expressed therein, and Hummet expressly disclaims any and all liability related to User Content. To the fullest extent permitted by applicable law, Hummet reserves the right to remove, screen or edit any User Content posted or stored on the Hummet Services at any time and without notice, including if such User Content violates

6. Privacy

Hummet takes your privacy seriously, please see our Privacy Policy to learn more about how we collect, use and disclose your personal information.

7. Virtual Items

You may only purchase diamonds ("Diamonds") and virtual gifts ("Gifts") and send gifts to others if you are 18 years of age or older (or the legal age of majority).

The price of the diamond will be displayed at the time of purchase. You will be responsible for paying for any diamonds you purchase. Once the purchase is completed, your user account will be credited with Diamonds. Diamonds can be used to purchase gifts. Diamonds cannot be exchanged for cash, legal tender, currency of any country, region or political entity, or any other form of credit.

Unless otherwise stated in these Terms, all sales of diamonds and gifts are final and we will not provide refunds for any diamonds and gifts purchased. Diamonds and gifts cannot be converted or exchanged for cash for any reason and cannot be refunded or reimbursed.

8. Termination of service

To the fullest extent permitted by applicable law, Hummet reserves the right, in its sole discretion and without notice, to terminate your use of the Hummet Services and to block or prevent your future access to and use of the Hummet Services, including if we reasonably believe that:

- (a) your use of the Hummet Services violates these Terms or applicable law;

- (b) your fraudulent use or abuse of the Hummet Services;

- (c) We are unable to continue to provide the Hummet Services to you due to technical or legitimate business reasons.

This includes terminating or suspending your ability to access any purchased products or services.

9. Intellectual Property Rights

By using and/or uploading any live content or other content to a publicly accessible area of the Hummet Site through the Hummet Service, you grant Hummet and its sublicensees a free, perpetual, irrevocable, non-exclusive and fully sublicensable grant. the right and license, without any territorial or time restrictions, without any approval and/or compensation, to use, reproduce, modify, adapt, publish, translate, edit, dispose of, create derivative works from, distribute, perform and publicly display such content ( in whole or in part), and/or to incorporate such content into existing or future forms of works, media or technology.

All text, data, images, graphics, audio and/or video information and other materials provided by Hummet on the Hummet Services are the property of Hummet and protected by copyright, trademark and/or other property rights laws. Nothing in these Terms shall be construed as Hummet granting you any license to any intellectual property rights or such materials.

10. Disclaimer

You assume full responsibility for any risks involved in using the Hummet Services. Your use of or reliance on the Hummet Services is entirely at your own risk.

Under no circumstances does Hummet guarantee that the Services will fully meet your requirements or that the Hummet Services will not be interrupted. The timeliness, security and accuracy of the Hummet Video Services are also not guaranteed. The Hummet Services are provided as is and Hummet makes no representations or warranties of any kind, express or implied, as to the operation and provision of such Hummet Services or any part thereof. Hummet is not responsible for the quality, timeliness, accuracy or completeness of the Hummet Services or for any consequences that may arise from your use of such Hummet Services.

Hummet does not guarantee the accuracy and completeness of any external links accessed through the use of the Hummet Services and is not responsible for the content of any external links placed as a convenience to you. You should understand that Hummet has no control over the content of web pages to which external links point, which is not under its jurisdiction.

Hummet assumes no liability for interruptions or other defects in Hummet's services due to force majeure or circumstances beyond Hummet's control. Nevertheless, Hummet will try its best to reduce the loss and impact caused to you.

11. Guarantee

You hereby agree to indemnify and hold us and our licensors, partners, and our respective affiliates, officers, directors, employees, contractors and suppliers (individually and collectively) harmless from and against any and all claims, actions, liabilities and We hold you harmless from damages, losses and expenses, including reasonable attorneys' fees incurred by such party due to:

-your breach or violation of any provision of these Terms or of any applicable law or regulation, whether or not referenced herein;

-your violation of any rights of any third party;

-your use or misuse of the product; or

-Your content or other communications displayed or transmitted through the Products.

The foregoing indemnification shall apply even if a court, administrative agency or any other dispute resolution or investigative body determines that we are liable and/or imposes sanctions against us.

If you download the App from the App Store, you acknowledge that if any third party claims that the Product or your possession and use of the Product infringes any intellectual property right, we alone will be responsible for the investigation, defense, settlement and discharge of such claim. We may, exclusively at your expense, defend and control any matter for which you indemnify us. You agree to cooperate with our defense of these claims and will not resolve any matter without our prior written consent.

12. Legal jurisdiction

Any dispute arising out of or in connection with these Terms, including questions regarding their existence, validity or termination, shall be submitted to and finally resolved by arbitration at the Singapore International Arbitration Centre. The Center's rules for the time being in force are deemed to be incorporated by reference into these Terms. 13. Prohibition of Child Sexual Abuse Exploitation(CSAE) Content

13.1 Prohibition of CSAE Content/Behavior

Users are prohibited from uploading, distributing, or sharing any content related to CSEA. This includes but is not limited to child pornography, explicit descriptions of minors, exploitation, abuse, and any other forms of sexual exploitation or harm to minors. This ban applies to all forms of content, including text, images, videos, and any information that directly or indirectly promotes, encourages, or glorifies CSAE behavior.

13.2 Removal of CSAE Content The platform employs a combination of technical detection and manual review. Upon discovering CSEA content, the platform will immediately delete such content to prevent further dissemination. Whether identified through automatic review tools or reported by users, the content will be promptly removed.

13.3 User Responsibilities

Users have a duty to report CSEA (Child Sexual Exploitation and Abuse) content, and by using this platform, they agree to comply with this policy. Users should adhere to the platform's rules and report any suspicious CSEA content. Active user participation helps maintain a safe, positive, and healthy online environment, ensuring that all users can safely use the platform.

13.4 Account Suspension and Legal Cooperation

For users who upload, distribute, or share CSEA content, their accounts will be immediately suspended. For users who violate the regulations, the platform reserves the right to permanently ban their accounts without prior notice to ensure the safety and compliance of the platform environment. In cases where CSAE-related content or behavior is discovered, the platform will actively cooperate with law enforcement agencies, providing technical support and assisting in investigations. Users suspected of CSEA behavior may be reported to relevant law enforcement agencies.
