Terms of Use – HueWeave

HueWeave is a product of SourSpark (“SourSpark,” “we,” “our,” or “us”).

These Terms of Use (“Terms”) govern your access to and use of the HueWeave mobile application and related services collectively referred to as the “Service.”

By downloading, accessing, or using HueWeave, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

If you are not legally able to agree to these Terms in your country, you may use HueWeave only with the permission and supervision of a parent or legal guardian.

A parent or legal guardian who allows a minor to use HueWeave accepts responsibility for the minor’s use of the Service, including any in-app purchases.

2. About HueWeave

HueWeave is a colour-path puzzle game that allows users to:

• Connect matching colour dots

• Complete puzzle grids

• Browse and play available levels

• Earn stars, achievements, and diamonds

• Use hints, restarts, and undo controls

• Review progress, activity, and streaks

• Purchase optional consumable diamond packs

• Configure language, sound, haptics, and reminders

Some features, including in-app purchases, require an internet connection and access to Apple App Store or Google Play services.

Features may vary depending on your device, operating system, country, app version, store availability, or granted permissions.

3. Licence to Use HueWeave

Subject to these Terms, SourSpark grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to download and use HueWeave for personal, non-commercial purposes.

HueWeave is licensed, not sold.

You may not:

• Copy, sell, rent, lease, sublicense, or distribute the Service

• Modify or create derivative works from the Service

• Reverse engineer, decompile, or attempt to obtain source code, except where applicable law expressly permits it

• Remove copyright, trademark, or ownership notices

• Use HueWeave to build or assist a competing product

• Access the Service through unauthorised automated methods

• Exploit bugs, vulnerabilities, or unintended game behaviour

• Interfere with the operation or security of the Service

All rights not expressly granted under these Terms are reserved by SourSpark.

4. Accounts and Local Progress

HueWeave does not require an account, user name, email address, password, or sign-in.

Game progress is stored locally on your device. This may include:

• Current and completed levels

• Stars and achievements

• Moves and hints used

• Activity and streak information

• Diamond balance

• Hint and restart inventory

• Language and gameplay preferences

You are responsible for maintaining access to your device and protecting it from unauthorised use.

Deleting HueWeave, clearing its data, resetting progress, restoring a device, or changing devices may permanently remove locally stored progress, diamonds, and power-up inventory.

SourSpark does not guarantee that locally stored progress or consumable items can be recovered.

5. Gameplay

The objective of HueWeave is to connect matching colour dots, fill the puzzle grid, and complete levels without crossing paths or leaving empty cells.

Level difficulty, grid size, colour count, rewards, star calculations, achievements, and progression requirements may vary.

SourSpark does not guarantee:

• That every user will complete every level

• That hints will provide a complete solution

• That a particular score, star rating, or achievement will be awarded

• That progress will transfer between devices

• That all levels will remain unchanged

• That a specific number of levels will always be available

We may correct, replace, rebalance, reorder, add, or remove levels when reasonably necessary.

6. Diamonds and Virtual Items

HueWeave includes virtual diamonds, hints, restarts, stars, achievements, and other game-related items collectively referred to as “Virtual Items.”

Virtual Items:

• Exist only within HueWeave

• Have no real-world monetary value

• Cannot be exchanged for cash

• Cannot be sold or transferred to another user

• Are not personal property

• Are provided as a limited licence to use within the Service

• May be modified when required to operate or balance the game

Diamonds may be earned through gameplay or obtained through optional in-app purchases.

Diamonds can be exchanged for gameplay assistance such as hints and restarts. Once diamonds or power-ups have been used, they cannot be returned to the in-game balance unless required by applicable law.

SourSpark may adjust future reward amounts, power-up costs, bonuses, or the availability of Virtual Items. Any changes will be applied in accordance with applicable law and platform requirements.

7. In-App Purchases

HueWeave offers optional consumable diamond packs through the Apple App Store and Google Play.

All purchases are processed by the applicable app store. SourSpark does not directly receive or store your payment card number, bank account information, or store password.

Product availability and prices may vary by country, currency, tax requirements, store, and platform.

Before completing a purchase, the applicable store will display the final price and request confirmation.

Consumable purchases may include:

• 1,200 Diamonds

• 3,000 Diamonds

• 8,000 Diamonds

Purchased diamonds are added to the local game balance after a successful transaction.

Consumable products may not be restorable after they have been delivered, used, lost through deletion of local data, or removed during a device change.

Refund requests must be submitted to Apple or Google and are governed by the applicable store’s refund rules and mandatory consumer law. SourSpark cannot independently issue refunds for transactions processed by Apple or Google.

If a purchase is delayed, cancelled, declined, interrupted, or not delivered, contact the applicable store or SourSpark support.

You are responsible for securing your device and store account. Parents and legal guardians should use the parental controls and purchase approval settings provided by Apple or Google.

8. Purchase Services

HueWeave uses Adapty to display in-app purchase products, validate transactions, receive purchase status, and deliver purchased diamonds.

Availability of the Store may depend on Adapty, Apple, Google, network connectivity, store configuration, and regional availability.

Third-party purchase services are governed by their own terms and privacy policies.

9. Fair Use

You must use HueWeave fairly and through its intended interface.

You may not:

• Manipulate diamond balances, stars, rewards, or progress

• Create or use fraudulent purchase transactions

• Modify game files or locally stored data

• Use scripts, bots, emulators, or unauthorised tools to exploit the Service

• Bypass purchase validation or security controls

• Exploit bugs to obtain Virtual Items

• Distribute modified or unauthorised versions of HueWeave

• Attempt to access another user’s device or information

• Interfere with app store or Adapty services

We may correct invalid balances, remove improperly obtained Virtual Items, disable affected features, or restrict access where reasonably necessary to protect the Service.

10. Prohibited Conduct

You must not use HueWeave to:

• Violate any law, regulation, court order, or third-party right

• Introduce malware or harmful code

• Disrupt or overload the Service

• Circumvent security or access controls

• Probe or test vulnerabilities without written authorisation

• Scrape, harvest, index, or extract information through automated means

• Resell or commercially exploit the Service

• Misrepresent your relationship with SourSpark

• Infringe intellectual property rights

• Engage in fraudulent or abusive activity

11. Notifications

HueWeave may provide optional local puzzle reminders.

Notifications may be delayed, incomplete, or unavailable because of device settings, battery restrictions, operating-system behaviour, or other factors.

Notifications are not essential to gameplay. You can disable them through HueWeave or your device settings at any time.

12. Third-Party Services

HueWeave may depend on or interact with third-party services, including:

• Apple App Store

• Google Play

• Adapty

• Device notification services

• External websites and support services

Third-party services are governed by their own terms and privacy policies.

SourSpark does not control and is not responsible for the availability, security, content, accuracy, or operation of third-party services.

13. Privacy

Our handling of information is described in the HueWeave Privacy Policy:

By using HueWeave, you acknowledge that you have read the Privacy Policy.

14. Intellectual Property

HueWeave, SourSpark, and all related software, puzzle content, level data, designs, interfaces, graphics, logos, icons, text, audio, visual effects, features, and other materials are owned by SourSpark or its licensors and are protected by applicable intellectual property laws.

The HueWeave and SourSpark names, logos, designs, and branding may not be copied or used without prior written permission.

Third-party names and trademarks remain the property of their respective owners.

15. Service Availability and Changes

We aim to keep HueWeave available and reliable, but we do not guarantee uninterrupted or error-free operation.

We may:

• Add, remove, or modify features

• Add, remove, reorder, or correct puzzle levels

• Adjust gameplay rules or rewards

• Release updates

• Perform maintenance

• Limit access to parts of the Service

• Stop supporting certain devices or operating systems

• Suspend or discontinue the Service

Some updates may be required to continue using HueWeave or its online features.

We are not responsible for losses caused by maintenance, service outages, device incompatibility, network failure, app store issues, third-party service interruptions, or changes to the Service, except where applicable law provides otherwise.

16. Ending Use of the Service

You may stop using HueWeave at any time by deleting the application.

We may restrict or terminate access to online features if we reasonably believe that:

• You violated these Terms

• A purchase or transaction is fraudulent

• You manipulated Virtual Items or local game data

• Your activity creates a security or legal risk

• Restriction is required by law

• Action is necessary to protect SourSpark, users, or the Service

Sections that by their nature should continue after termination, including intellectual property, disclaimers, liability limitations, and dispute provisions, will remain effective.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, HueWeave is provided “as is” and “as available.”

SourSpark disclaims all express, implied, and statutory warranties, including warranties of:

• Availability

• Reliability

• Accuracy

• Fitness for a particular purpose

• Merchantability

• Non-infringement

• Satisfactory quality

• Security

• Compatibility

We do not warrant that:

• The Service will always be available

• Every error will be corrected

• Game progress will never be lost

• Purchased consumable items will transfer between devices

• Every device will support all features

• The Service will meet every user’s expectations

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, SourSpark and its owners, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes loss or damage arising from:

• Loss of game progress or local data

• Loss of diamonds, hints, restarts, stars, or achievements

• Service interruption

• Device incompatibility

• Network or app store failure

• Delayed or failed purchase delivery

• Unauthorised device or store account access

• Third-party services

• Lost profits, opportunities, or reputation

Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law or mandatory consumer protection rules.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless SourSpark and its representatives from claims, losses, liabilities, and reasonable expenses arising from:

• Your unlawful use of the Service

• Your violation of these Terms

• Your infringement of third-party rights

• Fraudulent purchases or transactions

• Manipulation or unauthorised modification of the Service

This section does not apply where prohibited by mandatory consumer law.

20. Governing Law and Disputes

These Terms are governed by the laws applicable to SourSpark’s principal place of business, without regard to conflict-of-law principles.

Any dispute will be submitted to the courts having jurisdiction under applicable law.

If you are a consumer, this section does not remove any mandatory rights or protections provided by the laws of your country of residence.

Before filing a formal claim, please contact us at info@sourspark.com and attempt to resolve the dispute informally.

21. App Store Terms

If you downloaded HueWeave through the Apple App Store or Google Play, your use of the application is also subject to the applicable store’s terms.

For HueWeave downloaded through the Apple App Store:

• These Terms are between you and SourSpark, not Apple

• SourSpark, not Apple, is responsible for HueWeave and its content

• Apple has no obligation to provide maintenance or support for HueWeave

• Apple and its subsidiaries are third-party beneficiaries of these Terms

• Apple may enforce these Terms against you as a third-party beneficiary

If these Terms conflict with mandatory Apple App Store or Google Play requirements, the applicable store requirements will control to the extent of the conflict.

22. Changes to These Terms

We may update these Terms to reflect changes to HueWeave, applicable law, platform requirements, service providers, or our business practices.

Updated Terms will be published with a revised Effective Date. Where required, we may provide additional notice through the application.

Your continued use of HueWeave after updated Terms become effective means you accept the revised Terms. If you do not accept them, you must stop using the Service.

23. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

The invalid provision will be interpreted or limited only to the extent necessary to make it enforceable where permitted by law.

24. Entire Agreement

These Terms and the HueWeave Privacy Policy constitute the entire agreement between you and SourSpark regarding your use of HueWeave, except where additional terms are expressly provided.
