Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the AI Home Decor mobile application (the "Service") operated by ARK studio llc ("us," "we," or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. In-App Purchases and Subscriptions
The Service may offer features accessible through in-app purchases, including automatically renewing subscriptions ("Subscriptions").
Billing: Subscriptions are managed and billed through the platform on which you downloaded the Service (e.g., the Apple App Store or Google Play Store). Payment will be charged to your app store account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew for the same duration (e.g., weekly or yearly) unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can manage or cancel your Subscriptions by going to your app store account settings after purchase. Cancellation of the current active subscription period is not allowed.
Usage Limits: Subscriptions grant you a specific number of image generations for the subscription period (e.g., per week for weekly plans, per month for yearly plans). Unused generations do not roll over to the next period and are forfeited if not used.
Third-Party Processor: We use RevenueCat to facilitate and validate purchases. Your purchase is subject to RevenueCat's terms and privacy, as well as those of your respective app store.
2. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of ARK studio llc and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ARK studio llc.
3. User Content and Generated Images
Our Service allows you to upload certain information, text, graphics, photos, or other material ("User Content") to generate new images ("Generated Content").
User Content: You are responsible for the User Content that you upload to the Service, including its legality, reliability, and appropriateness. By uploading User Content, you represent and warrant that: (i) you own the User Content or have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the uploading of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.
Generated Content: The AI-powered features of the Service will generate new images (Generated Content) based on your User Content. Subject to these Terms and the terms of our third-party AI provider (Google Gemini), you are the owner of the Generated Content you create. You are responsible for the use of Generated Content, and you agree to use it in accordance with all applicable laws and regulations.
License Grant for User Content: You retain any and all of your rights to any User Content you submit. However, to provide the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, modify, process, and transmit your User Content solely for the purpose of operating the Service and generating your requested Generated Content. We do not store your User Content on our servers after the generation process is complete.
4. AI-Generated Content Disclaimer
The Generated Content produced by the Service is created by an artificial intelligence model (Google Gemini API). You acknowledge and agree that:
For Informational and Inspirational Purposes Only: Generated Content is provided for informational and inspirational purposes only and should not be considered as professional interior design, architectural, or engineering advice.
No Guarantees: We make no guarantees as to the accuracy, quality, reliability, or suitability of the Generated Content. The AI may produce results that are inaccurate, unexpected, or do not match your prompt or reference.
Use at Your Own Risk: Any reliance on or use of Generated Content is solely at your own risk. ARK studio llc is not liable for any actions you take or decisions you make based on the Generated Content.
Third-Party Terms: Your use of the AI features is also subject to the terms of the Google Gemini API, which may include their own use policies and restrictions on generated content.
5. Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:
Systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Reverse engineer, decompile, or disassemble any part of the Service, including the API calls.
Use the Service in any way that is unlawful, fraudulent, or harmful, or in connection with any unlawful, fraudulent, or harmful purpose or activity.
Upload any User Content that infringes on any third party's intellectual property rights or privacy rights.
Use the Service to generate content that is hateful, harassing, violent, sexually explicit, or otherwise objectionable.
6. Third-Party Services
The Service uses third-party services to provide its functionality. You acknowledge that these Terms do not apply to such third-party services.
Google Gemini API: For AI image generation.
RevenueCat: For processing in-app purchases and subscriptions.
Google Analytics: For anonymous app usage and diagnostic data.
These services are governed by their own terms and privacy policies. We are not responsible or liable for the content, policies, or practices of any third-party services.
7. Privacy Policy
Our Privacy Policy, which describes how we collect and use your information, is incorporated into these Terms. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.
8. Term and Termination
These Terms shall remain in full force and effect while you use the Service. We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Service without notice at any time.
We cannot guarantee the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.
10. Disclaimer
THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE GENERATED CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SERVICE.
11. Limitations of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your User Content; (2) your use of the Service; (3) your breach of these Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.
