HOME EATS TERMS AND CONDITIONS

Home Eats is an online food-ordering and delivery platform that connects customers with participating restaurants and delivery drivers.
By accessing or using Home Eats, customers agree to these Terms and Conditions.
1. ORDERS
Customers are responsible for checking their order, delivery address, contact details and special instructions before confirming an order.
Orders are subject to restaurant acceptance, product availability and delivery-driver availability.
Home Eats or the participating restaurant may contact the customer when clarification is required.
2. PRICES AND PAYMENTS
All prices displayed on Home Eats are shown in South African rand.
The total amount payable may include the food cost, delivery fee and any clearly displayed platform or service fees.
Payments must be made using the payment methods available through Home Eats.
Customers must check the total amount before confirming payment.
3. CANCELLATION POLICY
Customers may request cancellation before the restaurant begins preparing the order.
Once food preparation has started, cancellation may not be possible because the order is prepared specifically for the customer.
Where a cancellation is accepted, any refund will be processed through the original payment method, subject to the processing times of the applicable bank or payment provider.
Home Eats or a participating restaurant may cancel an order when:
• An ordered item is unavailable.
• The restaurant cannot fulfil the order.
• The delivery address is outside the service area.
• No delivery driver is available.
• The customer cannot be contacted.
• There is a suspected fraudulent or unlawful transaction.
Where payment has already been made and the cancellation was not caused by the customer, an appropriate refund will be arranged.
A reasonable cancellation fee may apply where the restaurant has already incurred costs in preparing the order.
4. REFUND POLICY
Customers must report incorrect, missing, damaged, spoiled or materially unsatisfactory items as soon as reasonably possible after delivery.
The customer may be required to provide:
• The order number.
• Photographs of the affected items.
• A description of the problem.
• Any other information reasonably required to investigate the complaint.
After reviewing the complaint with the restaurant and delivery driver, Home Eats may approve:
• A full refund.
• A partial refund.
• Replacement of the affected item.
• Account credit, where accepted by the customer.
Approved refunds will be returned through the original payment method where possible.
Bank and payment-provider processing times may apply.
Refunds will not normally be provided where:
• The customer provided an incorrect or incomplete delivery address.
• The customer was unavailable to receive the order.
• The customer could not be contacted.
• The complaint is based only on personal taste.
• The restaurant correctly prepared the order according to the information supplied.
• The customer changed their mind after food preparation began.
• The customer failed to disclose an allergy or special requirement.
Nothing in this policy removes any rights customers may have under applicable South African consumer-protection laws.
5. DELIVERY POLICY
Home Eats delivers orders to addresses located within its active service areas.
Estimated delivery times are estimates only. Delivery may be affected by:
• Restaurant preparation times.
• Traffic conditions.
• Weather conditions.
• High order demand.
• Restaurant delays.
• Delivery-driver availability.
• Incorrect or incomplete delivery information.
Customers must provide:
• A complete and accurate delivery address.
• A working telephone number.
• Clear access or delivery instructions where required.
Customers must remain available to receive telephone calls and collect their order when the driver arrives.
Where delivery cannot be completed because the address is incorrect, access is denied, the customer is unavailable or the customer cannot be contacted, additional charges may apply and a refund may not be available.
6. FOOD ALLERGIES AND SPECIAL INSTRUCTIONS
Customers must clearly state any allergies, dietary requirements and preparation instructions when placing an order.
Home Eats will pass the customer’s instructions to the restaurant.
Participating restaurants may prepare food in environments where allergens are present. Home Eats cannot guarantee that any meal will be completely free from allergens or cross-contamination.
Customers with serious allergies should contact the restaurant directly before placing an order.
7. RESTAURANT RESPONSIBILITIES
Participating restaurants are responsible for:
• Preparing orders correctly.
• Maintaining appropriate food-safety and hygiene standards.
• Providing accurate menu information.
• Informing Home Eats when an item is unavailable.
• Considering reasonable customer preparation instructions.
Food quality and preparation remain the responsibility of the participating restaurant.
8. CUSTOMER CONDUCT
Customers must not:
• Provide false or misleading information.
• Misuse the Home Eats platform.
• Submit fraudulent refund claims.
• Threaten, harass or abuse restaurants, drivers or Home Eats staff.
• Use Home Eats for unlawful purposes.
• Attempt to interfere with the operation or security of the platform.
Home Eats may suspend or close an account where fraud, abuse or misuse is reasonably suspected.
9. DELIVERY DRIVERS
Delivery drivers are responsible for collecting and delivering orders with reasonable care.
Customers must treat drivers respectfully and provide safe and reasonable access to the delivery location.
Drivers may contact customers for assistance with locating the delivery address or completing the delivery.
10. LIMITATION OF LIABILITY
Home Eats will take reasonable steps to provide a reliable ordering and delivery service.
Home Eats is not responsible for delays or failures caused by circumstances outside its reasonable control, including traffic, weather, internet failures, power interruptions, restaurant delays or driver unavailability.
Nothing in these Terms and Conditions excludes liability that cannot legally be excluded under South African law.
11. CHANGES TO THESE TERMS
Home Eats may update these Terms and Conditions when necessary.
The updated version will be published on the Home Eats website with a revised “Last updated” date.
Continued use of Home Eats after an update means that the customer accepts the updated Terms and Conditions.
