TERMS OF USE – AI Video Generate: Video Maker

Welcome to AI Video Generate: Video Maker (“App”). By downloading, accessing, or using the App, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.

1) About the App

The App provides AI-assisted video generation features. The App may offer pre-made templates/themes. You may upload image(s) and request generation of a video output.

2) Eligibility

The App is not intended for children under the age of 13. By using the App, you confirm you are at least 13 years old.

3) License

We grant you a non-exclusive, non-transferable, revocable, limited license to use the App for personal, non-commercial purposes, subject to these Terms and applicable laws.

Store / platform terms:

- If you access the App on Apple platforms, Apple’s Standard End User License Agreement (EULA) may apply unless a custom EULA is provided through App Store Connect.

- If you access the App via Google Play, Google Play’s applicable terms (and any EULA shown in Google Play listing) may also apply.

In case of conflict, these Terms govern your use of the App to the extent permitted by law.

4) Subscriptions and Payments

The App may offer optional subscriptions or in-app purchases.

- Payment will be charged to your account through the app marketplace you use (for example, Apple App Store or Google Play).

- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

- You can manage or cancel your subscription in your account settings within the marketplace you used to purchase it.

5) User Content

“User Content” means any photo, image, video, text, prompt, or other content you upload, submit, or create using the App.

5.1 Ownership

You retain ownership of your User Content. We do not claim ownership over your photos or videos.

5.2 Permission to Process User Content

To provide the App’s features (including generating a video from your selected template and uploaded images), you grant us a limited, non-exclusive, worldwide license to:

- upload, transmit, host, process, reproduce, and create derivatives of your User Content

only as necessary to operate the App, deliver the generated output to you, and maintain the service (e.g., debugging, security, and abuse prevention).

This license ends when your content is deleted from our systems in accordance with our Privacy Policy.

5.3 Your Responsibilities

You are responsible for your User Content and confirm you have all necessary rights, permissions, and consents to upload and use it (including for any person’s image/likeness).

You must not use the App to create, upload, or share content that is unlawful, abusive, defamatory, sexually explicit, invasive of privacy, or that violates intellectual property or other rights.

5.4 Prohibited Uses (Examples)

You agree not to use the App for:

- impersonation, fraud, or misleading/deceptive deepfakes,

- harassment, hate, or exploitative content,

- content that violates any third party’s rights,

- illegal activities.

6) Third-Party Services (including AI Processing)

The App uses third-party services to provide functionality. These services may have their own terms and policies.

6.1 AI Processing

When you request generation, the App may transmit your uploaded image(s) and generation parameters to third-party AI services to produce the requested output. We currently use:

- fal.ai (Features & Labels, Inc.), and models/providers accessed through fal.ai (for example, Kling and Vidu).

6.2 Analytics and Crash Reporting

The App may use:

- Firebase Analytics (Google) and Firebase Crashlytics (Google) for usage analytics and crash reporting.

6.3 Subscription Management

The App may use:

- RevenueCat (RevenueCat, Inc.) to help manage subscription entitlements and purchase state across supported platforms.

Important: Your use of these third-party services may be subject to their own terms and policies. Please review our Privacy Policy for details about data sharing and processing.

7) Privacy & Explicit Permission for AI Data Sharing

Your privacy is important. Our Privacy Policy explains what data is collected, how it is used, and who it is shared with.

Before sending your uploaded image(s) for AI processing, the App will provide a clear disclosure and request your explicit permission. If you do not consent, generation will not start.

8) Service Availability and Internet Access

Some features require an active internet connection. You are responsible for any data charges or carrier fees you may incur.

9) Disclaimer

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free, or that generated results will meet your expectations.

10) Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

11) Termination

We may suspend or terminate your access if you violate these Terms or misuse the App. You may stop using the App at any time.
