These Terms of Use (“Terms”) constitute a legal agreement between you (“User,” “you,” or “your”) and hiSpy (“hiSpy,” “we,” “us,” or “our”) regarding your access to and use of the hiSpy mobile application (the “App”) and related services (collectively, the “Services”).
By downloading, installing, accessing, purchasing a subscription to, or using hiSpy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the App.
hiSpy provides tools intended to assist users in analyzing their surroundings and local network using capabilities available on supported mobile devices.
Depending on the device, operating system, permissions granted, and version of the App, features may include:
camera-based scanning and detection tools;
infrared-related camera detection assistance;
magnetic field detection using supported device sensors;
scanning for devices connected to the same local network;
identifying or categorizing devices detected on a local network;
security and privacy-related informational tools; and
other related detection, scanning, and analysis features.
Features may be modified, added, limited, or removed at any time.
hiSpy is an assistance and informational tool. It is not professional surveillance-detection equipment, a security system, an anti-spy device, or a substitute for professional security inspection services.
The App does not guarantee that it will detect every hidden camera, surveillance device, recording device, network device, security threat, or other device.
Results generated by hiSpy may include false positives or false negatives.
For example, an object or device identified as “suspicious” by the App is not necessarily a hidden camera, surveillance device, malicious device, or security threat. Similarly, a device or object that is not identified as suspicious may still present a risk.
Detection capabilities can be affected by factors including, but not limited to:
device hardware and sensor quality;
environmental conditions;
lighting conditions;
magnetic interference;
network configuration;
operating system restrictions;
device permissions;
hardware compatibility;
network visibility; and
the technical characteristics of the device being detected.
You should not make safety, legal, financial, or other significant decisions solely based on results provided by hiSpy.
If you believe that you are being illegally monitored, recorded, tracked, or surveilled, you should consider contacting an appropriate qualified security professional or relevant authority.
Certain features may require access to hardware or system functionality on your device, including the camera, magnetic sensors, or local network.
You may be asked to grant the App permission to access these capabilities.
Camera-based features are designed to analyze information necessary to provide the requested functionality.
Magnetic sensor measurements used by the magnetic detection functionality are processed on the user's device.
Sensor readings can vary significantly between devices and environments and should not be interpreted as definitive evidence of the presence or absence of surveillance equipment.
hiSpy may provide functionality that scans your local network to identify devices that are visible or discoverable on that network.
Network scanning is intended only for networks that you own or are authorized to access and analyze.
You agree not to use hiSpy to:
access networks without authorization;
attempt to gain unauthorized access to another device;
interfere with network operations;
bypass security mechanisms;
perform malicious network reconnaissance;
collect information unlawfully; or
engage in any activity prohibited by applicable law.
Network scan results may be incomplete or inaccurate because some devices, routers, operating systems, firewalls, or network configurations may prevent devices from being discovered or correctly identified.
A device categorized as “suspicious” should not automatically be considered malicious or dangerous. Such classifications are informational indicators only.
Camera-related analysis and local network scan results used for the relevant detection functionality are not transmitted to our servers for processing.
Magnetic sensor data used by the magnetic detector functionality is processed locally on your device.
However, the App uses third-party services for purposes such as analytics, application performance, subscription management, attribution, and crash reporting.
These services may collect certain technical, diagnostic, device, usage, subscription, or attribution information in accordance with their respective policies and our Privacy Policy.

hiSpy may use third-party services and software development kits to provide, maintain, analyze, improve, monetize, and measure the Services.
These may include:
Firebase — for application infrastructure and analytics-related functionality.
Firebase Crashlytics — for crash reporting, diagnostics, and application stability monitoring.
Adapty — for subscription management and related functionality.
Adjust — for attribution, measurement, and analytics functionality.
These third parties may process certain information according to their respective terms and privacy policies.
Your use of certain functionality may therefore also be subject to the applicable terms and policies of these third-party providers.
hiSpy may offer premium functionality through automatically renewing subscriptions.

The exact price of each subscription is displayed in the App before purchase and may vary depending on your country, region, currency, applicable taxes, and App Store pricing.
Payment will be charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.
Your account may be charged for renewal within 24 hours prior to the end of the current subscription period.
You can manage or cancel your subscription through your Apple ID subscription settings.
Deleting the App does not automatically cancel an active subscription.
Any free trial or promotional offer, if offered, will be subject to the conditions displayed at the time of the offer.
Purchases made through Apple's App Store are processed by Apple and are subject to Apple's applicable payment, subscription, cancellation, and refund policies.
hiSpy does not directly control Apple's billing or refund decisions.
If you wish to cancel an active subscription, you must manage the subscription through your Apple ID/App Store subscription settings.
Refund requests for purchases made through the App Store should generally be submitted through Apple's applicable refund process.
Nothing in these Terms limits any mandatory refund or consumer rights that you may have under applicable law.
Subject to your compliance with these Terms, hiSpy grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App for your personal and lawful purposes.
You may not:
copy or redistribute the App except as permitted by applicable law;
modify, reverse engineer, decompile, or attempt to extract the source code of the App except where such restriction is prohibited by law;
sell, rent, lease, sublicense, or commercially redistribute the App;
circumvent subscription, payment, security, or access-control mechanisms;
use automated systems to abuse or disrupt the Services;
use the App for unlawful surveillance or unauthorized monitoring; or
use the App in violation of applicable laws or the rights of another person.
All intellectual property rights relating to hiSpy, including its software, design, branding, graphics, interfaces, databases, and other content, remain the property of hiSpy or its applicable licensors.
You are responsible for ensuring that your use of hiSpy complies with all applicable federal, state, local, and international laws.
You must not use the App to violate another person's privacy, gain unauthorized access to networks or devices, harass another person, conduct unlawful surveillance, or otherwise engage in illegal activity.
You are solely responsible for obtaining any permissions or authorizations required before scanning, inspecting, accessing, or analyzing property, networks, or devices that do not belong solely to you.
We may use automated or manual mechanisms to protect the App and related infrastructure from misuse, abuse, fraud, excessive requests, automated attacks, or activities that could negatively affect the Services or other users.
We reserve the right to apply reasonable usage limitations, temporarily restrict functionality, suspend access, or take other appropriate measures when activity appears abusive, fraudulent, unlawful, or harmful to the Services.
Where reasonably possible and appropriate, restrictions may be temporary. Serious or repeated violations may result in longer restrictions or termination of access.
We strive to keep hiSpy available and functional, but we do not guarantee that the App or any particular feature will always be available, uninterrupted, secure, or error-free.
Features may depend on:
your internet connection;
device hardware;
operating system capabilities;
permissions;
third-party services; and
services operated by Apple or other providers.
We may update, modify, discontinue, or replace features when necessary for technical, security, legal, commercial, or operational reasons.
Updates may be required to continue using certain features.
To the maximum extent permitted by applicable law, hiSpy and the Services are provided on an “AS IS” and “AS AVAILABLE” basis.
We make no warranty that:
the App will detect all hidden cameras or surveillance devices;
detection results will always be accurate;
all devices on a network will be discovered;
device classifications will always be correct;
magnetic or camera-based analysis will produce definitive results;
the App will identify every security or privacy threat; or
the App will operate without interruption or error.
No result produced by hiSpy should be considered a professional security assessment or guarantee of safety.
Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.
To the maximum extent permitted by applicable law, hiSpy and its owners, affiliates, licensors, service providers, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the App.
This includes, without limitation, losses resulting from reliance on detection results, failure to detect a device, incorrect classification of a device, network scanning results, data loss, interruption of service, or unauthorized activity by third parties.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Your privacy is important to us.

By using the App, you acknowledge that you have been provided access to our Privacy Policy.
hiSpy is not intended for children under the age of 13.
We do not knowingly seek to collect personal information from children under 13.
If applicable law in your jurisdiction requires a higher minimum age for use of certain digital services, you must satisfy that requirement or have any legally required authorization from a parent or legal guardian.
You may stop using hiSpy at any time.
We may suspend or terminate access to the Services where reasonably necessary if you materially violate these Terms, use the App unlawfully, abuse the Services, threaten the security or operation of the Services, or where termination is required by law.
Termination of access to the App does not necessarily cancel an App Store subscription. Subscription cancellation must be performed through the applicable Apple subscription management process.
Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, and applicable legal provisions, will survive termination.
We may update these Terms from time to time to reflect changes to the App, our business practices, legal requirements, or third-party services.
When these Terms are updated, the “Last Updated” date at the top of this document will be revised.
Where required by applicable law, we will provide additional notice or obtain consent before materially changed Terms become effective.
Your continued use of the App after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
These Terms are intended to be governed by applicable laws of the United States and, where applicable, the laws of the state in which hiSpy is legally established, without regard to conflict-of-law principles.
Nothing in these Terms deprives you of mandatory consumer protections or other rights that cannot be waived under the laws applicable to you.
If you download or use hiSpy through the Apple App Store, you acknowledge that these Terms are between you and hiSpy, and not with Apple Inc. (“Apple”).
hiSpy, not Apple, is solely responsible for the App and its content, except to the extent otherwise required by applicable law or Apple's applicable terms.
Your use of the App must comply with the applicable App Store terms and policies.
Apple has no obligation to provide maintenance or support services for the App except as required by applicable law.
To the extent permitted by applicable law, Apple is not responsible for warranties relating to the App or for claims arising from your possession or use of the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the App distributed through the Apple App Store and, upon your acceptance of these Terms, may have the right to enforce applicable provisions against you.
Where applicable, your use of hiSpy through the Apple App Store is also subject to Apple's Standard Licensed Application End User License Agreement (“Standard EULA”).

If there is a conflict between these Terms and mandatory terms applicable through the Apple App Store, the applicable mandatory terms will control.
These Terms, together with our Privacy Policy and any additional terms presented to you in connection with specific features or purchases, constitute the agreement governing your use of hiSpy.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
