1. Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hassan Ahmad Babar ("Developer," "we," "our," or "us") regarding your use of our iOS and macOS applications ("Apps").
By downloading, installing, accessing, or using our Apps, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Apps.
2. License Grant
Scope of License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
Download and install the Apps on Apple-branded devices you own or control
Use the Apps for personal, non-commercial purposes
Use the Apps in accordance with Apple's App Store Terms of Service
All rights not expressly granted are reserved.
3. License Restrictions
You agree not to:
Copy, modify, adapt, translate, or create derivative works
Reverse engineer, decompile, or attempt to extract source code
Rent, lease, sell, sublicense, or distribute the Apps
Circumvent security features
Use the Apps unlawfully
Attempt unauthorized access to systems or servers
Interfere with backend infrastructure or APIs
4. User Content
Certain features of the Apps may allow you to upload or submit content, including images, videos, audio, or text ("User Content"). You acknowledge and agree that:
You retain ownership of your User Content.
You grant us a limited license to process, transmit, analyze, and temporarily store User Content solely to provide App functionality.
You are solely responsible for the content you submit.
You represent and warrant that the content you submit does not violate any laws, does not infringe intellectual property, privacy, or publicity rights, and does not contain unlawful, harmful, abusive, or prohibited material.
We reserve the right to refuse or limit processing of content that violates these Terms.
5. AI Processing and Automated Services
Certain features of the Apps may use artificial intelligence systems, machine learning models, cloud computing infrastructure, or third-party APIs. By using these features, you acknowledge that:
Your submitted content may be securely transmitted to third-party service providers for processing.
Processing may occur on servers located outside your country of residence.
AI-generated outputs are automated predictions, classifications, or estimations and may not be accurate, complete, or error-free.
You use AI-generated outputs at your own discretion and risk.
The Apps do not perform facial recognition, biometric identification, or identity verification unless explicitly stated.
6. Acceptable Use
You agree to use the Apps in compliance with all applicable laws and regulations, Apple's App Store policies, and these Terms. You are solely responsible for your conduct and any consequences arising from your use of the Apps.
7. Intellectual Property
The Apps, including all code, design, trademarks, logos, and content, are owned by Hassan Ahmad Babar or licensed to us. These Terms do not grant you any ownership rights.
8. Third-Party Services
The Apps may rely on third-party infrastructure providers, AI services, analytics tools, or cloud platforms. We are not responsible for service interruptions, data transmission delays, third-party errors, or availability of external services. Your use of such services may be subject to their own terms and policies.
9. Updates and Modifications
We may release updates or patches, modify or discontinue features, or restrict availability in certain regions. We are not obligated to maintain backward compatibility.
10. Disclaimer of Warranties
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI outputs, and continuous or error-free operation. We do not warrant that the Apps will meet your expectations, that AI results will be correct, or that errors will be fixed.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for loss of data, loss of revenue or profits, business interruption, device damage, security incidents, decisions made based on AI-generated outputs, or failures of third-party services. Total liability shall not exceed the amount you paid for the App (if any) or $50 USD, whichever is less.
12. Indemnification
You agree to indemnify and hold harmless Hassan Ahmad Babar from any claims arising from your submitted content, your misuse of the Apps, your violation of laws, or your violation of third-party rights.
13. Termination
We may suspend or terminate access at any time for violation of these Terms. Upon termination, your license ends immediately and you must stop using the Apps. Relevant provisions survive termination.
14. Geographic Restrictions
The Apps are operated from Pakistan. Access from jurisdictions where the Apps are illegal is prohibited.
15. Apple-Specific Terms
You acknowledge that these Terms are between you and Hassan Ahmad Babar, not Apple. Apple has no obligation to provide support. Apple is a third-party beneficiary of these Terms.
16. Export Compliance
You agree to comply with all applicable export laws and sanctions regulations.
17. Governing Law and Disputes
These Terms are governed by the laws of Pakistan. Before filing a legal claim, you agree to attempt informal resolution by contacting: muhammadhassanmughal82@gmail.com
18. Changes to These Terms
We may update these Terms at any time. Changes become effective upon posting with a revised "Last Updated" date.
