Welcome to HappyLeaf: Plant Identifier & Care Guide, an application provided by Deniz Ozagac (the “Developer,” “we,” “us,” or “our”).

The following Terms of Use (“Terms”) apply when you use the HappyLeaf app (the “App”) and the services provided via the App (the “Service”). Please read these Terms carefully. By accessing or using the App, you agree to these Terms. If you do not agree, you may not use the App.

About the App

The App provides plant, tree, mushroom, and flower identification and care guidance for informational and reference purposes only. The information provided (including plant care suggestions and health diagnoses) is not a substitute for professional horticultural or agricultural advice. The Developer disclaims any liability for reliance on the information provided through the App.

Please note that the App is under continuous development. New features may be added or changed, so you should check back to this page for updates.

Third-Party Services

Our App uses Kindwise and Google services to process images for identification and diagnosis. By using the scanning feature, you agree that:

• Images captured through our App will be temporarily shared with Kindwise and Google for processing.

• The processing of your data by these providers is subject to their respective terms of service and privacy policies.

• We are not responsible for the data practices of these third parties.
  
  

Additionally, the App may provide links to third-party resources such as Wikipedia, GBIF, and iNaturalist for informational purposes. We do not:

• Share your personal data with these sites.

• Receive commissions from any of these links.

• Track your activity on these external websites.
  
  

Content and Restrictions

Any content you create within the App (such as your saved garden or collections) is stored locally on your device. The Developer does not store or have access to your personal collections. You are responsible for maintaining backups of your data.

You agree that you will not:

• Attempt to reverse engineer, decompile, or disassemble any part of the App.

• Use the App or our trademarks without our express written permission.

• Probe, scan, or test our systems for vulnerabilities.

• Bypass or interfere with security features.

• Remove copyright or proprietary notices from App materials.

• Impersonate others or misrepresent your affiliation.

• Use the App for unlawful purposes or to promote illegal activities.

• Harass, abuse, or harm others through the App.

• Post offensive, obscene, or infringing content.

• Take automated actions that impose an unreasonable load on our systems.
  
  

Monitoring and Compliance

We are not obligated to monitor access or use of the App. However, we reserve the right to review and remove content or restrict access to the App at our discretion if we believe these Terms have been violated.

Intellectual Property

Unless otherwise indicated, the App and all source code, designs, software, text, images, and graphics (the “Content”), as well as trademarks and logos (the “Marks”), are owned or licensed by us and are protected under copyright and trademark laws.

Warranty Disclaimer

THE APP AND SERVICE ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OR INABILITY TO USE THE APP.

Modification of Terms

We may update these Terms from time to time. Any changes will be posted in the App. Continued use of the App after changes indicates your acceptance of the updated Terms.

Please refer to our [Privacy Policy] for details on how we collect, use, and protect your information. By using the App, you also agree to our Privacy Policy.

General Terms

If any part of these Terms is found invalid, the remaining provisions will continue in effect. Our failure to enforce any right or provision is not a waiver of that right.
