Terms of Use — Gym Synchronicity

These Terms of Use (“Terms”) govern your use of the Gym Synchronicity mobile application (“the App”). The App is operated by Ashok Kumar (“we”, “us”, “our”), based in England, United Kingdom. By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and the relevant app store’s terms.
2. Health & fitness disclaimer (please read)
Gym Synchronicity provides general training, exercise and supplement information for educational purposes only. It is not medical advice and is not a substitute for professional guidance. Always consult a qualified physician or healthcare professional before starting any exercise programme, changing your diet, or taking any supplement, particularly if you have a medical condition, are pregnant, or take medication. You use the App and act on its information at your own risk. We are not responsible for any injury, loss or harm resulting from your use of the App or reliance on its content. Supplement information does not constitute a recommendation, and supplement laws and product safety vary by country.
3. Subscriptions & billing
● The App offers a 14-day free trial, followed by a monthly or annual subscription.
● Subscriptions are sold and billed through the Apple App Store or Google Play, under their terms. We do not process payments and do not receive your card details.
● Unless cancelled, subscriptions renew automatically at the end of each period. Manage or cancel your subscription in your Apple or Google account settings.
● Cancel at least 24 hours before a renewal to avoid being charged for the next period.
● Refunds are handled by Apple or Google under their refund policies, not by us.
Cancelling if your device is lost, broken, or unavailable — please read.
Your subscription is billed and managed by Apple (App Store) or Google (Google Play), not by Gym Synchronicity, and it is linked to your Apple Account or Google Account — not to your phone. You can therefore cancel it at any time from any web browser on any computer (for example at a library, at work, or on a friend’s device), even if your own device is lost, stolen, damaged, switched off, or away for repair. You do not need the app, and you do not need your phone, to cancel:
● Apple / App Store — go to account.apple.com, sign in with the Apple Account you used to subscribe, open Subscriptions, select Gym Synchronicity, and tap Cancel Subscription.
● Google Play — go to play.google.com/store/account/subscriptions, sign in with the Google Account you used to subscribe, select Gym Synchronicity, and tap Cancel subscription.
Because cancellation is always available this way, it is your responsibility to cancel before your next renewal date if you no longer wish to be billed. Uninstalling the app does NOT cancel your subscription. Once a renewal payment has been taken, that billing period is not refunded on the basis of non-use, and any refund is granted solely at the discretion of Apple or Google under their own policies. As we do not process store payments, we cannot issue or guarantee refunds for amounts billed by the App Store or Google Play.
When you cancel, you keep full access until the end of the period you have already paid for. Nothing in this section affects your statutory rights under applicable consumer law.
4. Acceptable use
You agree not to: copy, modify, reverse-engineer or redistribute the App; use it unlawfully; attempt to circumvent subscription or security controls; or use it in any way that could damage or impair the App or others’ use of it.
5. Intellectual property
The App, its content, design, logos and the name “Gym Synchronicity” are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer any ownership to you. Your on-device training data remains yours.
6. Availability
We aim to keep the App working but provide it “as is” and “as available”. We do not guarantee it will be uninterrupted, error-free, or compatible with every device, and we may update, change or withdraw features.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, loss of data, or loss arising from your use of or inability to use the App. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence). Your statutory consumer rights are not affected.
8. Termination
We may suspend or end your access if you breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive (e.g. disclaimers, IP, liability) continue after termination.
9. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows the latest version; continued use after changes means you accept them.
10. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction.
