Terms of Use

These Terms of Use (“Terms”) govern your use of the Gym Mouse iOS application (“Gym Mouse” or the “App”), which is developed and operated by Christopher Cantrell (“I,” “me,” or “my”).

By downloading, accessing, or using Gym Mouse, you agree to these Terms. If you do not agree to these Terms, do not use the App.

Your use of Gym Mouse is also subject to the applicable terms governing applications distributed through Apple’s App Store, including Apple’s Standard End User License Agreement where applicable.

1. About Gym Mouse

Gym Mouse is a fitness planning and workout-tracking application. The App may allow you to:

• Plan and organize workouts.

• Create and save exercises and workout templates.

• Use built-in exercises and templates.

• Organize favorites and playlists.

• Record exercises, sets, repetitions, weight, time, distance, and other workout information.

• Track workout history, performance trends, personal records, and workout scores.

• Use workout timers, notifications, widgets, and Live Activities.

• Optionally synchronize Gym Mouse data through iCloud.

• Optionally write completed workouts to Apple Health.

• Optionally create workout events in Calendar.

• Export Gym Mouse data.

• Purchase additional features through Gym Mouse Pro.

Features may change, be added, or be removed over time.

2. Fitness and Medical Disclaimer

Gym Mouse is intended solely as a fitness planning, tracking, and informational tool.

Gym Mouse does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation advice, or personalized medical or fitness advice.

Information provided through the App, including exercises, workout templates, workout scores, estimated workout durations, progress information, and other fitness-related content, is general information and should not be treated as a substitute for advice from a qualified healthcare, medical, or fitness professional.

Before beginning or changing an exercise program, you should consult an appropriate healthcare professional if you have questions or concerns regarding your health, physical condition, injuries, pregnancy, medications, ability to exercise, or any other medical issue.

If you experience pain, dizziness, shortness of breath, faintness, unusual discomfort, or other concerning symptoms while exercising, stop exercising and seek appropriate medical attention.

Gym Mouse is not intended for emergencies. If you believe you are experiencing a medical emergency, contact emergency services.

3. Assumption of Exercise Risk

Physical exercise involves inherent risks, including the possibility of injury, illness, disability, and, in rare circumstances, death.

You are responsible for:

• Choosing exercises appropriate for your abilities and circumstances.

• Selecting appropriate weight, resistance, duration, intensity, repetitions, and rest periods.

• Using proper technique and equipment.

• Maintaining a safe exercise environment.

• Obtaining professional instruction or supervision when appropriate.

• Deciding whether a workout, exercise, or activity is appropriate for you.

The inclusion of an exercise or workout in Gym Mouse does not mean that it is safe, suitable, or appropriate for every person.

You voluntarily assume the risks associated with exercises and workouts you choose to perform.

4. Built-In Exercises and Workout Content

Gym Mouse may include a library of exercises, workout templates, exercise descriptions, categories, muscle classifications, suggested structures, or other fitness-related content.

This content is provided for general informational and organizational purposes.

Built-in content:

• Is not individualized to your medical history, experience, fitness level, or physical abilities.

• Does not constitute a recommendation that you perform any particular exercise.

• May not address every possible variation, contraindication, technique consideration, or safety issue.

• May contain errors or omissions.

You are responsible for evaluating whether any exercise or workout is appropriate for you.

You may also create or modify your own exercises, workouts, templates, favorites, playlists, notes, and other content. 

You are solely responsible for content and training choices you create or modify.

5. Workout Scores, Estimates, Trends, and Progress Information

Gym Mouse may calculate or display information such as:

• Workout scores.

• Estimated workout durations.

• Personal records.

• Training volume.

• Performance trends.

• Exercise progress.

• Completion statistics.

• Weekly or historical summaries.

These values are intended to help you organize and review your activity. They are estimates or computational outputs based on information available to the App and may be incomplete or inaccurate.

They are not medical measurements, clinical assessments, guarantees of fitness improvement, or professional evaluations of your health or physical performance.

You should not make medical or safety decisions based solely on metrics generated by Gym Mouse.

6. Your Workout Data

Gym Mouse may allow you to enter and store information relating to your workouts and training.

You are responsible for the accuracy of information you enter.

Gym Mouse does not guarantee that workout records, personal records, plans, history, exports, synchronization, or other data will always be available, complete, accurate, or recoverable.

You should maintain independent copies of information that is especially important to you.

The handling of your information is further described in the Gym Mouse Privacy Policy.

7. iCloud Synchronization

Gym Mouse may offer optional synchronization through Apple’s iCloud and CloudKit services.

If you enable iCloud synchronization:

• Synchronization depends on Apple services, your Apple Account, your device settings, network connectivity, available storage, and other factors outside my control.

• Synchronization may be delayed, interrupted, duplicated, incomplete, or unavailable.

• Changes or deletions made on one device may synchronize to other devices.

Gym Mouse does not guarantee uninterrupted or error-free synchronization.

You are responsible for maintaining appropriate backups of information you consider important.

Apple’s terms and privacy practices also apply to your use of iCloud.

8. Apple Health Integration

Gym Mouse may optionally write completed workout information to Apple Health if you enable the feature and grant the required permission.

Gym Mouse does not represent that information written to Apple Health will always be complete, accurate, accepted, retained, or displayed in a particular manner.

You are responsible for reviewing information stored in Apple Health if accuracy is important to you.

Turning off Gym Mouse’s Apple Health integration or deleting Gym Mouse may not remove records previously written to Apple Health. You may need to manage those records through Apple’s Health app or system settings.

Gym Mouse is not affiliated with or endorsed by Apple.

9. Calendar Integration

Gym Mouse may optionally create, update, or remove Calendar events relating to planned workouts.

Calendar functionality depends on system permissions, Apple platform behavior, Calendar availability, and other factors outside my control.

You are responsible for reviewing Calendar events and verifying dates, times, workout information, or other details before relying on them.

Gym Mouse is not responsible for missed workouts, scheduling conflicts, deleted events, duplicate events, or other consequences resulting from Calendar synchronization errors.

10. Notifications, Timers, Widgets, and Live Activities

Gym Mouse may provide workout timers, reminders, notifications, widgets, and Live Activities.

These features may be delayed, interrupted, suppressed, or unavailable because of:

• Device settings.

• Focus modes.

• Battery conditions.

• Background execution limits.

• Operating system behavior.

• Notification permissions.

• Network conditions.

• Other technical factors.

Do not rely on Gym Mouse notifications or timers where failure or delay could create a safety risk.

11. Gym Mouse Pro

Gym Mouse may offer optional premium functionality under the name Gym Mouse Pro.

Gym Mouse Pro may include features such as expanded planning tools, additional templates, unlimited or increased limits for certain organizational features, extended progress information, and optional integrations.

The specific features included in Gym Mouse Pro may evolve over time.

One-Time Purchase

Gym Mouse Pro is currently offered as a one-time in-app purchase rather than an automatically renewing subscription.

The current purchase price is displayed through Apple’s App Store purchase system and may vary based on storefront, currency, taxes, pricing changes, or other factors.

Purchases are processed by Apple and are subject to Apple’s applicable payment and refund terms.

“Lifetime Access”

Where Gym Mouse describes Gym Mouse Pro as providing “lifetime access,” that phrase means that the purchase does not require a recurring subscription payment for continued access to the purchased Gym Mouse Pro entitlement.

It does not guarantee that:

• Gym Mouse will be developed or supported indefinitely.

• Every current feature will remain available forever.

• Gym Mouse will remain compatible with all future hardware or operating systems.

• Third-party or Apple services will remain available indefinitely.

I may modify the App as technology, platform requirements, legal requirements, or product functionality change.

Restore Purchases

Eligible purchases may generally be restored using Apple’s purchasing systems while signed in with the Apple Account associated with the original purchase, subject to Apple’s rules and technical availability.

12. Pricing and Refunds

Purchases made through Gym Mouse are processed by Apple.

I do not directly collect or process your App Store payment information.

Requests for refunds are generally handled through Apple according to Apple’s policies and applicable law.

Nothing in these Terms limits any refund, cancellation, consumer-protection, or other rights that cannot legally be waived.

13. License and Permitted Use

Subject to these Terms and the applicable App Store license terms, you may use Gym Mouse for your personal, noncommercial use on supported devices you own or control.

You may not:

• Copy, reproduce, distribute, sell, sublicense, or commercially exploit the App except as permitted by law.

• Reverse engineer, decompile, disassemble, or attempt to derive Gym Mouse source code except where applicable law expressly permits it.

• Circumvent purchase, entitlement, security, or access-control systems.

• Use the App to violate applicable law.

• Interfere with the operation, security, or integrity of the App or related services.

• Misrepresent Gym Mouse as your own product or falsely imply affiliation with Gym Mouse.

All rights not expressly granted are reserved.

14. Intellectual Property

Gym Mouse, including its software, design, user interface, branding, graphics, text, original exercise organization, templates, and other original content, is protected by applicable intellectual-property laws.

“Gym Mouse” and associated branding may not be used in a manner that suggests sponsorship, affiliation, or endorsement without permission.

You retain ownership of original information and content you create in the App, such as your custom workout plans, notes, or custom exercise information.

By using the App, you do not transfer ownership of your user-created workout data to me.

15. Third-Party Services

Gym Mouse relies on or interacts with third-party platforms and services, including Apple technologies such as:

• The App Store.

• StoreKit.

• iCloud and CloudKit.

• Apple Health and HealthKit.

• Calendar and EventKit.

• Notifications.

• Widgets and Live Activities.

Your use of those services may also be governed by terms and policies provided by Apple or other applicable service providers.

I am not responsible for outages, changes, restrictions, discontinuation, errors, or other issues caused by third-party services.

16. Availability and Changes to Gym Mouse

I may modify, update, improve, suspend, discontinue, or remove features from Gym Mouse.

I do not guarantee that:

• Gym Mouse will always be available.

• Gym Mouse will operate without interruption or error.

• Gym Mouse will remain compatible with every device or operating system.

• Any particular feature or integration will remain available indefinitely.

• Errors will always be corrected.

Updates may be required to continue using some functionality.

17. Software Errors and Data Loss

Software can fail.

Gym Mouse may contain bugs, errors, inaccuracies, synchronization problems, compatibility issues, or other defects.

To the extent permitted by law, I am not responsible for loss resulting from:

• Lost or corrupted workout records.

• Failed synchronization.

• Deleted information.

• Incorrect calculations.

• Calendar errors.

• Notification failures.

• Apple Health synchronization failures.

• Export failures.

• Device loss or damage.

• Operating-system changes.

• Third-party service outages.

You should maintain appropriate independent records or backups of information that is particularly important to you.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GYM MOUSE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

I DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY, AND ERROR-FREE OPERATION, TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

I DO NOT WARRANT THAT:

• THE APP WILL MEET YOUR PARTICULAR FITNESS OR TRAINING NEEDS.

• USE OF THE APP WILL PRODUCE ANY PARTICULAR HEALTH, FITNESS, STRENGTH, WEIGHT, OR PERFORMANCE RESULT.

• EXERCISE OR WORKOUT INFORMATION WILL BE APPROPRIATE FOR YOU.

• ALL DATA, CALCULATIONS, SYNCHRONIZATION, OR METRICS WILL BE ACCURATE OR COMPLETE.

• THE APP WILL OPERATE WITHOUT INTERRUPTION, LOSS, OR ERROR.

Some jurisdictions do not permit the exclusion of certain warranties, so portions of this section may not apply to you.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO GYM MOUSE, INCLUDING DAMAGES ARISING FROM:

• PERSONAL INJURY OR EXERCISE ACTIVITIES.

• LOST OR CORRUPTED DATA.

• LOST PROFITS OR REVENUE.

• BUSINESS INTERRUPTION.

• RELIANCE ON WORKOUT SCORES, ESTIMATES, TRENDS, TIMERS, NOTIFICATIONS, OR OTHER APP INFORMATION.

• THIRD-PARTY OR APPLE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY TOTAL LIABILITY ARISING OUT OF OR RELATING TO GYM MOUSE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID FOR GYM MOUSE OR GYM MOUSE PRO DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

2. US $100.

These limitations do not apply where prohibited by law and do not limit liability that legally cannot be excluded or limited.

20. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any statutory warranty, consumer guarantee, refund right, privacy right, or other legal protection that applicable law does not permit to be excluded, restricted, or modified.

If applicable consumer law gives you rights that conflict with a provision of these Terms, those mandatory rights control.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Christopher Cantrell and Gym Mouse from third-party claims, liabilities, damages, and reasonable expenses arising from:

• Your unlawful use of Gym Mouse.

• Your violation of these Terms.

• Content you create or distribute through use of the App.

• Your infringement of another person’s rights.

This section does not require you to indemnify me for conduct for which indemnification cannot legally be required.

22. Children and Minors

Gym Mouse is a general-audience fitness application and is not directed to children under 13.

If you are under the age of legal majority where you live, you should use Gym Mouse only with the permission and supervision of a parent or legal guardian where required.

Parents and guardians are responsible for determining whether Gym Mouse and any exercise activity undertaken using it are appropriate for a minor.

23. Privacy

Your use of Gym Mouse is subject to the Gym Mouse Privacy Policy, which explains how information is handled when you use the App.

The Privacy Policy is available through Gym Mouse and the Gym Mouse website.

Do not send sensitive medical or health information in a support email unless it is necessary for your request.

25. Apple

Gym Mouse is distributed through Apple’s App Store.

Apple is not responsible for Gym Mouse’s fitness content, workout information, support, maintenance, or claims arising from your use of Gym Mouse, except to the extent Apple separately assumes obligations under its own agreements or applicable law.

Your use of the App Store and Apple services remains subject to Apple’s applicable terms.

Nothing in these Terms is intended to conflict with rights or obligations imposed by Apple’s applicable App Store terms or Standard End User License Agreement.

26. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where mandatory consumer-protection law requires otherwise.

Subject to any rights you may have under applicable consumer law, disputes relating to these Terms or Gym Mouse may be brought in courts having jurisdiction in the State of Maryland.

Nothing in this section prevents you from exercising rights to bring a claim in another jurisdiction where applicable law gives you that right.

27. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be enforced to the maximum extent permitted by law or modified as necessary to make it enforceable, and the remaining provisions will remain in effect.

28. No Waiver

A failure to enforce a provision of these Terms does not waive the right to enforce that provision later.

29. Entire Agreement

These Terms, together with the Gym Mouse Privacy Policy and applicable App Store license terms, constitute the agreement governing your use of Gym Mouse with respect to the matters addressed here.

If there is a conflict between these Terms and a mandatory provision of applicable law, the applicable law controls.

If there is a conflict between these Terms and an applicable Apple license term concerning the license or permitted use of the App, the applicable Apple license term controls to the extent required.

30. Changes to These Terms

I may update these Terms to reflect changes to Gym Mouse, legal requirements, platform requirements, or business practices.

The effective date at the top indicates the most recent version.

If a change is material, I may provide notice through the App, the Gym Mouse website, or another reasonable method.

Your continued use of Gym Mouse after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
