CONDIZIONI DI VENDITA E REGOLAMENTO D’ASTA (Informazioni per i Compratori e i Venditori)

1. [rapporto giuridico] Gutenberg Casa d’Aste, marchio registrato di Gutenberg al Colosseo srl, con sede legale ed operativa in Roma, Via di San Giovanni in Laterano, 110-112, di seguito denominata per brevità Gutenberg, nello svolgere l’attività di vendita all’asta, agisce quale mandataria in esclusiva in nome proprio e per conto di ciascun Venditore, il cui nome viene trascritto negli appositi registri di Pubblica Sicurezza, tenuti presso Gutenberg.

2. [soggettività e responsabilità] Ciascuna vendita deve considerarsi intervenuta tra il Venditore e l’Acquirente, più oltre denominato Aggiudicatario. Pertanto, Gutenberg non assume in proprio alcuna responsabilità, salvo quella ad essa derivante dalla propria qualità di mandataria. Le vendite si effettuano al maggior offerente e si intendono immediatamente regolate per cassa.

3. [controversie sull’Aggiudicatario] Durante lo svolgersi di un’asta potrebbe sorgere controversia sull’Aggiudicatario. In tal caso, il Banditore potrà, a propria discrezione, rimettere l’oggetto in vendita all’asta e procedere a nuova aggiudicazione.

4. [facoltà di variazione] Gutenberg si riserva la facoltà di ritirare dall’asta qualsiasi lotto, a propria discrezione e senza alcun preavviso. Durante la sessione d’asta, il Banditore potrà, a propria discrezione, variare l’ordine di vendita, abbinare o separare lotti. Gutenberg si riserva, altresì, di non procedere all’aggiudicazione e ritirare i lotti per i quali le offerte non raggiungano il prezzo di riserva concordato con il Venditore.

5. [rilancio minimo e riserva] Il rilancio minimo in aumento delle offerte è fissato nella misura del 10% del prezzo base d’asta, salvo diverse comunicazioni da parte del Banditore. Il prezzo base d’asta corrisponde al prezzo di riserva, al di sotto del quale l’aggiudicazione non ha luogo.

6. [obbligazioni dell’Aggiudicatario] L’offerente, con la formulazione della propria offerta, si impegna a corrispondere a Gutenberg il prezzo di aggiudicazione del lotto oltre alla commissione per i diritti d’asta, imposte ed altri oneri applicabili alla vendita ed alla commissione.

7. [passaggio della proprietà e modalità di pagamento] La proprietà dei lotti aggiudicati passa all’Aggiudicatario solo previo pagamento integrale del prezzo di aggiudicazione e delle commissioni per i diritti d’asta, di cui appresso. Si accettano le seguenti modalità di pagamento: a) in contanti fino ad Euro 3.000,00; b) a mezzo carta di credito o bancomat, con maggiorazione del 2% dell’importo dovuto; c) mediante assegno circolare non trasferibile intestato a Gutenberg al Colosseo srl; d) mediante bonifico bancario su ccb n. 2694901 intestato a Gutenberg al Colosseo srl, ed esistente presso Banca Monte dei Paschi di Siena, Agenzia n. 12, Via di San Giovanni in Laterano, 7, 00184 Roma, coordinate bancarie: codice IBAN: IT64P0103003212000002694901; codice BIC / SWIFT: PASCITM1R12 . Nel caso di pagamento con assegni o bonifici bancari, il pagamento s’intende efficacemente effettuato solo dopo il buon esito dell’assegno e/o dell’accredito.

8. [diritti d’asta] Le commissioni per i diritti d’asta dovute a Gutenberg dall’Aggiudicatario sono le seguenti: 25% del prezzo di aggiudicazione, fino ad un importo di Euro 100.000,00. 18% del prezzo di aggiudicazione, sulla misura dell’importo eccedente Euro 100.000,00.

9. [modalità di partecipazione] Coloro che desiderano partecipare ad un’asta, dovranno preliminarmente compilare e sottoscrivere una scheda di partecipazione, indicando tutti i loro dati personali e le loro referenze bancarie. Tali dati saranno trattati in conformità alla vigente normativa italiana ed europea in materia di tutela della riservatezza dei dati personali (c.d. privacy), come da informativa che verrà consegnata ai partecipanti. Gutenberg si riserva la facoltà di rifiutare offerte provenienti da persone non registrate ed identificate o che non abbiano presentato adeguate referenze bancarie. I partecipanti già personalmente noti presso Gutenberg sono esonerati dalle referenze bancarie.

10. [prevalere dell’offerta sulla base di mandato d’acquisto] Gutenberg si riserva la facoltà di accettare mandati per l’acquisto di determinati lotti, da parte di clienti ad essa noti, nel qual caso il Banditore effettuerà rilanci sulla base delle istruzioni ricevute dal cliente in competizione con le offerte formulate in sala e/o ai telefoni. In caso di offerte del medesimo importo, prevarrà l’offerta comunicata dal Banditore su quella dell’offerente in sala e/o ai telefoni.

11. [esonero di responsabilità] Gutenberg agisce in qualità di mandataria del Venditore e declina qualsiasi responsabilità in ordine alla descrizione degli oggetti contenuta nei cataloghi, negli opuscoli ed in qualsiasi altro materiale illustrativo. Siffatte descrizioni, così come ogni altra indicazione o illustrazione, dovranno considerarsi puramente indicative e non possono generare affidamenti di alcun tipo negli Aggiudicatari. Tutte le aste saranno precedute da un’esposizione al fine di permettere un esame approfondito circa l’autenticità, lo stato di conservazione, la provenienza, il tipo e la qualità degli oggetti. Dopo l’aggiudicazione né Gutenberg né i Venditori potranno essere ritenuti responsabili per i vizi relativi allo stato di conservazione, per l’errata attribuzione, l’autenticità, la provenienza, il peso o la mancanza di qualità degli oggetti. Né Gutenberg né il personale incaricato da Gutenberg potranno rilasciare una qualsiasi garanzia in tal senso, salvi i casi previsti dalla legge. Fermo quanto sopra e quanto previsto da norme inderogabili di legge, qualsiasi richiesta risarcitoria sia nei confronti di Gutenberg sia del Venditore non potrà eccedere l’importo di aggiudicazione del relativo lotto.

12. [stime e descrizioni dei lotti] Le stime relative al prezzo base di ciascun lotto, espresse in Euro, sono stampate sotto la descrizione dei lotti riportata nel catalogo e non includono i diritti d’asta dovuti dall’Aggiudicatario. Tali stime possono essere soggette a revisione in qualsiasi momento, per cui i lotti potranno essere offerti all’asta ad un prezzo base diverso da quello indicato nel catalogo. Anche le descrizioni dei lotti nel catalogo potranno essere soggette a revisione mediante comunicazioni al pubblico durante l’asta.

13. [esecuzione della prestazione dell’Aggiudicatario] L’Aggiudicatario dovrà corrispondere a Gutenberg il prezzo di aggiudicazione più i diritti d’asta immediatamente dopo la conclusione dell’asta e, comunque, entro sette giorni lavorativi, salvo diverso preventivo accordo scritto con Gutenberg.

14. [ritardo nel pagamento] In caso di ritardo nel pagamento del prezzo di aggiudicazione e dei diritti d’asta, Gutenberg potrà addebitare all’Aggiudicatario una penale nella misura del 12% annuo computato per i giorni di ritardo nel pagamento, salvo il diritto della stessa, decorsi sette giorni dalla data dell’asta, di considerare revocata l’aggiudicazione e di procedere alla vendita dei lotti a trattativa privata, oppure in una successiva asta, in danno dell’Aggiudicatario, trattenendo, comunque, a titolo di penale, eventuali acconti ricevuti. Gli oggetti di cui sopra verranno custoditi da Gutenberg a rischio e spese dell’Aggiudicatario, fino a quando non saranno venduti, come previsto al precedente paragrafo, oppure restituiti al Venditore su richiesta del medesimo, fermo restando che, fino alla data di restituzione o di vendita, l’Aggiudicatario sarà tenuto a corrispondere a Gutenberg la penale sopra menzionata.

15. [consegna dei lotti] L’Aggiudicatario, dopo aver saldato il prezzo e le commissioni per i diritti d’asta, dovrà ritirare a propria cura, rischio e spese i lotti acquistati, contestualmente alla tornata d’asta e, comunque, entro sette giorni dall’aggiudicazione. Decorso tale termine, Gutenberg è esonerata da ogni responsabilità nei confronti dell’Aggiudicatario in relazione alla custodia, all’eventuale deterioramento o deperimento degli oggetti ed avrà diritto a trasferire i lotti non ritirati, a spese e rischio dell’Aggiudicatario, presso i propri uffici o magazzini pubblici o privati. Gutenberg potrà organizzare l’imballaggio ed il trasporto dei lotti a spese e rischio dell’Aggiudicatario, su espressa richiesta di quest’ultimo e previo pagamento dei relativi costi.

16. [casi di notifica] Gli Aggiudicatari saranno tenuti, per gli oggetti sottoposti dalla Legge alla notifica all’Autorità amministrativa competente per materia e/o per territorio, all’osservanza di tutte le disposizioni di cui al D. Lgs. 22 gennaio 2004 n. 42 (c.d. Codice dei Beni Culturali). L’esportazione di oggetti da parte di Aggiudicatari, residenti o non residenti in Italia, sarà regolata dalla suddetta normativa nonché dalle leggi doganali, valutarie e tributarie in vigore. Gutenberg non assume alcuna responsabilità nei confronti degli Aggiudicatari in ordine ad eventuali restrizioni all’esportazione dei lotti aggiudicati né in ordine ad eventuali licenze od attestati che l’Aggiudicatario di un lotto debba ottenere, in base alla legge italiana. L’Aggiudicatario, in caso di esercizio del diritto di prelazione da parte dello Stato, non potrà pretendere da Gutenberg e/o dal Venditore alcun rimborso di eventuali interessi sul prezzo e/o sulle commissioni d’asta già corrisposte.

17. [contestazioni - decadenza] In caso di contestazioni ritenute fondate da Gutenberg per oggetti contraffatti o falsificati o recanti vizi sostanziali, a patto che la relativa comunicazione scritta pervenga a Gutenberg entro trenta giorni dalla data di aggiudicazione, a pena di decadenza, quest’ultima potrà, a propria discrezione, annullare la vendita o rivelare all’Aggiudicatario che lo richieda, l’identità del Venditore, dandone preventiva comunicazione a quest’ultimo.

18. [aste di libri] Per quanto attiene alle aste di libri, non saranno accettate contestazioni relative a danni alla legatura, macchie, fori di tarlo, carte o tavole rifilate e ogni altro difetto che non leda la completezza del testo e/o dell’apparato illustrativo; mancanza di indici di tavole, fogli bianchi, inserzioni, supplementi e appendici successivi alla pubblicazione dell’opera. Non saranno, inoltre, accettate contestazioni relative a libri non descritti in catalogo.

19. [diritti di terzi] Nel caso in cui Gutenberg sia stata resa edotta o venga a conoscenza di un’eventuale pretesa o diritto di terzi inerente alla proprietà, possesso o detenzione di uno o più lotti, essa potrà, a propria discrezione, trattenere in custodia tali lotti nelle more della composizione della controversia o per tutto il periodo ritenuto ragionevolmente necessario a tale composizione.

20. [diritto di seguito] Con il D. Lgs. 13 febbraio 2006 n. 118, attuazione della direttiva 2001/84/CE, relativa al diritto dell’autore di un’opera d’arte sulle successive vendite dell’originale, pubblicato sulla G.U. serie generale n. 71 del 25/3/2006 e in vigore dal 9/4/2006, è stato introdotto nella normativa italiana il diritto di seguito (right to follow - droit de suite), ossia il diritto dell’autore di opere delle arti figurative e dei manoscritti a percepire una percentuale sul prezzo di vendita degli originali delle proprie opere, in occasione delle vendite successive alla prima. E’ stato così modificato il R.D. 18 maggio 1942 n. 1369 nella parte relativa alle norme che tutelano il diritto d’autore. Con la pubblicazione del Regolamento di attuazione di tale norma, pubblicato sulla G.U. n. 42 del 19 febbraio 2008, a mezzo del D.P.R. 29 dicembre 2007 n. 275, il Legislatore ha stabilito il diritto dell’autore vivente di opere di arti figurative e di manoscritti, ovvero dei suoi eredi, se l’autore è deceduto da meno di 70 anni, a percepire un compenso calcolato in forma percentuale sul prezzo di vendita degli originali delle proprie opere, in occasione delle vendite successive alla prima. Tale diritto è a carico del venditore ed è calcolato sul prezzo di aggiudicazione uguale o superiore a Euro 3.000. Tale diritto non potrà comunque essere superiore a Euro 12.500 per ciascun lotto. L’importo del diritto da versare alla SIAE è calcolato secondo la seguente tabella:

4% per la parte del prezzo di aggiudicazione compresa tra Euro 3.000 ed Euro 50.000

3% per la parte del prezzo di aggiudicazione compresa tra Euro 50.000,01 ed Euro 200.000

1% per la parte del prezzo di aggiudicazione compresa tra Euro 200.000,01 ed Euro 350.000

0.50% per la parte del prezzo di aggiudicazione compresa tra Euro 350.000,01 ed Euro 500.000

0,25% sul prezzo di aggiudicazione superiore a Euro 500.000

Le vendite, soggette al diritto di seguito, sono quelle successive alla prima (effettuata direttamente dall’autore) di importo pari o superiore a Euro 3.000,00.

21. [modi di partecipazione] Per ragioni di limitatezza dei posti a sedere in sala, si suggerisce a chi desidera partecipare all’asta di iscriversi tempestivamente alla medesima, presso la sede di Gutenberg oppure via fax o posta elettronica, indicando le proprie generalità, copia di un documento valido d’identità, le proprie referenze bancarie. I dati personali saranno trattati da Gutenberg con la riservatezza prevista dalla già citata normativa in materia. Sarà data precedenza in sala ai partecipanti secondo la data di iscrizione all’asta. E’ anche possibile partecipare all’asta mediante la presentazione o l’invio di offerte massime segrete, fino al giorno che precede la prima sessione d’asta. A tale scopo potrà essere utilizzato l’apposito modulo per le offerte collocato al termine del catalogo. L’eventuale partecipazione telefonica sarà possibile solo se il partecipante, che abbia comunque adempiuto alla regolare iscrizione all’asta, ne abbia fatto richiesta scritta almeno due giorni prima della data di inizio dell’asta e, comunque, a discrezione di Gutenberg.

22. [presunzione di conoscenza e accettazione - Foro competente] Le presenti Condizioni di Vendita si intendono integralmente lette, ben conosciute e tacitamente accettate da quanti concorrono all’asta e sono a disposizione di qualsiasi interessato che ne faccia richiesta. Per qualsiasi controversia relativa alle presenti condizioni di vendita ed allo svolgimento dell’asta, si applicherà la legge italiana e sarà competente in via esclusiva il Foro di Roma, salva la facoltà di Gutenberg di agire innanzi al Foro del convenuto.

Chi lo desidera può partecipare all’asta anche con offerta massima segreta o per telefono, dopo aver presentato od inviato la scheda di registrazione, anche via posta elettronica o fax, contenente le proprie generalità, l’indirizzo completo, i dati fiscali e le referenze bancarie, la copia d’un documento d’identità valido, precisando il numero dei lotti per i quali intende partecipare ed, eventualmente, l’offerta massima per ciascun lotto. Nel caso si desiderasse partecipare per telefono, saremo noi a chiamare qualche lotto prima della presentazione di quello cui si desidera concorrere. Per chi partecipasse per la prima volta ad una vendita all’asta, si precisa che l’offerta massima - nel caso di aggiudicazione - implica l’applicazione del solo primo incremento sulla maggiore offerta in sala o ai telefoni.

SALE CONDITIONS AND AUCTION REGULATION (Infos for Buyers and Sellers)

1. [legal relationship] Gutenberg Casa d’Aste, registered trade mark of Gutenberg al Colosseo srl, with legal and operational Headquarters in Roma, Via di San Giovanni in Laterano, 110-112, hereinafter shortly called Gutenberg, in carrying out the activities of auction sale, acts as an appointed exclusive purchasing agent in its own name and on behalf of each Seller, whose names are to be transcribed within the appropriate registers of Public Security, kept at Gutenberg’s.

2. [legal subjectivity and responsibilities] Each sale must be considered as performed between Seller and Buyer, hereinafter denominated Highest bidder. Therefore, Gutenberg does not assume any responsabilities on its own, except those originating from its quality of purchasing agent. The Auction sales are carried out to the highest bidder and must immediately be Cash-settled.

3. [disputes about Highest bidder] During an auction sale, a dispute may arise about the highest bidder. In such case, the auctioneer will be able, at his own discretion, to put again the object in auction sale and proceed to a new adjudication.

4. [discretion of variation] Gutenberg reserves for itself the right to withdraw any lots from the auction, at its own discretion and without any previous notices. During an auction session, the Auctioneer will be able, at his own discretion, to vary the order of sale, to couple or divide lots. Gutenberg reserves for itself, besides, the right not to proceed to awarding and withdraw lots for which bids do not reach the reserve price, as agreed with the seller.

5. [minimum bid and reserve price] The minimum bid to increasing offers in auction is fixed at 10% of the base price, except for different notices of the Auctioneer. The base price in auction is the same reserve price, below which, the adjudication does not take place.

6. [obligations of the Highest bidder] The Highest bidder, with his own bidding, assumes obligation to pay to Gutenberg the hammer-price of the lot plus auction fees, taxes and other financial burdens, applicable to each lot sale and to auction fees.

7. [transfer of ownership and payment methods] The property of awarded lots switches to the Highest bidder only after payment of the full amount of the hammer-price plus auction fees, as follows. Gutenberg accepts the following payment methods: a) by cash, up to € 3.000,00 ; b) by credit card or bancomat, increasing 2% of full amount due; c) by cashier’s check non-transferable, payable to Gutenberg al Colosseo srl; d) by bank transfer money order to bank account: ccb. n. 2694901, payable to Gutenberg al Colosseo srl, and existing at Banca Monte dei Paschi di Siena, agency n. 12, Via di San Giovanni in Laterano, 9, 00184 Roma, bank details: iban code: IT64P0103003212000002694901; BIC / SWIFT code: PASCITM1R12. In case of payment by allowance or bank transfer, the payment is meant to be well realized only after successful accreditation of the amount described in allowance or in money order.

8. [auction fees] Auction fees due to Gutenberg by the contractor are as follows: 25% of the hammer price, up to an amount of Euros 100.000,00. 18% of the hammer price, on the amount exceeding Euros 100.000,00.

9. [how to participate] Those who wish to participate in an auction, will have preliminarily to fill in the registration form and subscribe it, indicating all their personal data, and their banking references. Those data will be processed in accordance with current Italian and European regulations in the field of personal data protection (s.c. privacy policy), as indicated in details which will be delivered to the participants. Gutenberg reserves for itself the right to refusing bids coming from non registered and identified customers or who have not submitted adequate bank references. Customers already personally known at Gutenberg, are relieved from bank references.

10. [about prevailing bids based on purchase mandate] Gutenberg reserves for itself the right to accept mandates to purchase certain lots, coming from known customers, in which case the Auctioneer will offer raises based on the informations received by the customer, in competition with offers, bidding in the saleroom and by the telephone. In case of bids of the same amount, the prevailing offer will be the one communicated by the Auctioneer against the offers coming from the saleroom and by the phone.

11. [disclaimer] Gutenberg acts as a purchasing agent of the Seller and declines all responsibilities in relation to the description of the objects contained in the catalogues, brochures and in any other kind of literature. Such a description, as well as any other indication or illustration, must be considered purely indicative and cannot produce any kind of reliance in the successful bidder. All auctions will be preceded by shows in order to allow an in-depth examination about authenticity, state of preservation, provenance, the kind and quality of the objects. After the award, neither Gutenberg nor the Sellers could be held responsible for defects related to the state of preservation, misattribution, authenticity, provenance, weight, or lack of quality in the objects. Neither Gutenberg nor staff in charge by Gutenberg will release any kind of warranty in such a meaning, except all cases required by law. Except that, any kind of claim for damages directed both to Gutenberg or the Seller cannot exceed the amount of Highest bid of the lot.

12. [estimations and descriptions of lots] The estimations connected with the base price of each lot, expressed in Euros, are printed under description of lots mentioned in the catalog and do not include auction fees due by the Awarded bidder. These estimations may be subject to revision whenever, therefore the lots will be offered in auction at a base price other than indicated in the catalogue. Also the descriptions of the lots in the catalogue may be subject to revision through communications to the public during the auction.

13. [performance of the service of Highest bidder] The Highest bidder must pay to Gutenberg the hammer-price plus auction fees immediately after the end of the auction and, anyway, within seven working days, unless different previous written agreement with Gutenberg.

14. [delay in payment] In case of delay in payment of the hammer-price and of the auction fees, Gutenberg may charge a penalty to the Highest bidder for the amount of annual 12% computed on the days of delay in payment, unless the right of Gutenberg, after seven days from the date of the auction, to consider cancelled the adjudication and proceed selling the lots in a private deal or in a subsequent auction, to the detriment of Highest bidder, holding, anyway, as penalty, any payment in account. The above mentioned objects, will be saved by Gutenberg, at risk and costs of Highest bidder, till the date of restitution or sale, as considered in the previous paragraph, or returned to the Seller, on request of the same, on the understanding that, until the date of the return or sale, the Highest bidder shall pay to Gutenberg the above mentioned penalty.

15. [delivery of lots] The Highest bidder, after having paid the price and the auction fees, must pick up the lots purchased, on his own care, risk and expenses, contextually with auction session and, anyway, within seven days from the adjudication date. After this deadline, Gutenberg is exempted from any responsibilities towards the Highest bidder, in relation with the care keeping, with the possible decline or deterioration of the objects and will have the right to transfer the lots not withdrawn, at costs and risks of the Highest bidder, at its own offices or public or private warehouses. Gutenberg will carry out the packaging and transport of lots at costs and risks of the Highest bidder, at his express request and after payment of related costs.

16. [cases of notification] The Highest bidders will be requested, for the objects submitted by Law to notify to the administrative public authority, competent by subject and/or territory, to the compliance of all provisions whereof to the Legislative Decree. 22 January 2004 n. 42 (Code of Cultural Heritage). The exportation of objects by Highest bidders, resident in Italy or not, will be ruled by the same Law and also by customs, currency and tax current regulations. Gutenberg does not assume any responsibilities in front of Highest bidders neither with regards to eventual restrictions to the export of the awarded lots nor in order to any licenses or certificates that the Highest bidder of one lot should be obliged to get, according to italian Law. The Highest bidder, in case of exercising the preemption right by the State, cannot claim by Gutenberg and/or by the Seller any repayment of eventual interests on price and/or on auction fees already paid.

17. [disputes - forfeiture] In case of disputes considered well founded by Gutenberg for counterfeit or falsified objects or embodying substantive defects, provided that its written communication be received by Gutenberg within thirty days from the date of adjudication, under penalty of expiration, the latter will, at its discretion, cancel the sale or reveal to the Highest bidder who requests it, the identity of the Seller, giving prior notification to the latter.

18. [auctions of books] With regard to auctions of books, Gutenberg will not accept any objections related to damage of bookbindings, spots, wormholes, cards or trimmer boards and any other defects which would not violate the completeness of the text and/or of the illustrations; lack of indexes of tables, white leaves, advertisements, supplements and appendixes, subsequent to the publication of the book. Gutenberg, besides, will not accept, also, disputes related to books not described in the catalogue.

19. [rights of third parties] In the event that Gutenberg be made aware or becomes aware of a possible claim or rights of third parties pertinent to property, possession or detention of one or more lots, the Auction House may, at its own discretion, hold in custody such lots pending the composition of the dispute throughout the period of time or for as long as is deemed necessary to such composition.

20. [right to follow] By the Legislative Decrete, 2006 February 13, n. 118, implementation of the Directive 2001/84/CE about the author’s right of a work of art on subsequent sales as the original, published on G.U.,general series n. 71, of the 25/3/2006 and into force from 9/4/2006, it was introduced in Italian legislation the right to follow, namely the author’s right of works of the visual arts and of the manuscripts to receive a percentage on the selling price of the originals of their works during the sale subsequent to the first. It has been so modified the R.D. 1942 May 18 n. 1369 in the part concerning the rules that protect the copyright. By the publication of the Regulation of performance of such a law, published on G.U. n.42 of the 2008 February 19, by D.P.R. 2007 December 29 n. 275, the Legislator established the right of the living author of the works of arts and of manuscripts, or his heirs, if the author is died less than 70 years ago, to receive a fee, to be calculated as a percentage on the selling price of the originals of his works, in case of sales successive to the first. This right is charged to the seller and is calculated on hammerprice equal or higher to € 3.000,00. This right, however, may not be superior to €12.500,00 for each lot. The amount of the fee to be paid to the S.I.A.E (The Italian Society of Authors and Editors) will be calculated according to the following table:

4% for the part of the hammer price between Euro 3.000,00 and Euro 50.000,00

3% for the part of the hammer price between Euro 50.001,00 and Euro 200.000,00

1% for the part of the hammer price between Euro 200.001,00 and Euro 350.000,00

0.50% for the part of the hammer price between Euro 350.001,00 and Euro 500.000,00

0.25% for the part of the hammer price higher than Euro 500.000,00

The sales, subject to the right to follow, are those after the first (done directly by the author) amounting to or higher than Euro 3.000,00.

21. [how to participate] For reasons of narrowness of seats in the hall, we propose to anybody who wishes to take part to the auction, to promptly register to the same, at the seat of Gutenberg or by fax or by mail, indicating their personal details, copy of a valid identity document, and bank references. The personal data will be treated by Gutenberg in a confidential way, following the previously mentioned regulations on the subject. Priority will be given to the participants in room according to the date of registration to the auction. It is also possible to take part to the auction by direct presentation or sending us highest sealed bid, till the day before the first auction session. For this purpose may be used a special form for tenders located at the end of catalogue. The participation by telephone call will be possible only if the participant, that has anyway already registered to the auction, has also submitted a written request, at least two days before of the starting date of the auction and, anyway, at the discretion of Gutenberg.

22. [presumption of knowledge and acceptance - competent Court] The present Conditions of sale mean fully read, well-known and tacitly accepted by all participants to the auction and are available to any interested person, asking for it. For any dispute relative to these conditions of sale and to the auction, it will apply the Italian law and The Court of Rome will have exclusive jurisdiction, except for the discretion of Gutenberg to act before the Court of defendant.

Those who wish, may partecipate to auction also by highest sealed bid or by telephone call, after registering, by e mail or fax, declaring their personal details, full address, fiscal data and bank references, copy of a valid identity document, declaring the numbers of lots in which one intends to partecipate and, eventually, the highest bid for each lot one is interested in. For beginners in participating to auctions, we specify that highest sealed bid - in case of successful bidding – implies the increase of the first increment only on last highest bid in salesroom or by telephone.
