CHILDHOOD PRIVACY AND PROTECTION ACT (CPPA) 2025

An Act to Prohibit Access to Commercial Social Media Platforms for Persons Under the Age of 13, to Protect the Digital Privacy and Mental Well-being of Children, and for Related Purposes.

PREAMBLE
WHEREAS the healthy cognitive, emotional, and social development of children is a foundational priority of the Commonwealth of Greenwick;
AND WHEREAS compelling scientific evidence links premature and unsupervised exposure to commercial social media platforms to increased risks of anxiety, depression, sleep deprivation, cyber-bullying, and data exploitation among children;
AND WHEREAS it is the duty of the Government to create a safe environment for its youngest citizens to grow, learn, and play;
AND WHEREAS existing parental controls are insufficient against platforms designed to maximize engagement and data collection;
NOW, THEREFORE, be it enacted by the Parliament of the Commonwealth of Greenwick as follows:

PART 1: PRELIMINARY
1. Short Title
This Act may be cited as the Childhood Privacy and Protection Act 2025.
2. Commencement
This Act shall come into force on January 1, 2026, providing a transition period for compliance.
3. Definitions
In this Act, unless the context otherwise requires:
- "Child" means a person under the age of 13 years.
- "Commercial Social Media Platform" means any publicly or privately accessible online service, website, or application (including mobile applications) that:
(a) allows users to create, share, and interact with user-generated content in a public or semi-public feed,
(b) utilizes algorithmic systems to curate, prioritize, or recommend content based on user data,
(c) derives significant revenue from advertising, data monetization, or subscription models, and
(d) is not a Designated Exempt Service.
- "Designated Exempt Service" means:
(a) Educational platforms used under the direct supervision of a school or recognized educational body within Greenwick.
(b) Services designed specifically for children under 13 that are certified by the Digital Safety Commissioner as complying with strict data privacy and content standards (e.g., no advertising, no external messaging, full parental dashboard).
(c) Simple private messaging or video communication tools used for one-to-one or family-group communication without public feeds or algorithmic content.
- "Operator" means any entity that owns, operates, or controls a Commercial Social Media Platform accessible within the jurisdiction of Greenwick.
- "Digital Safety Commissioner (DSC)" means the officer appointed under Part 3 of this Act.

PART 2: PROHIBITIONS AND OBLIGATIONS
4. Core Prohibition
It shall be unlawful for any Operator to:
(a) knowingly permit a Child to create an account or maintain a profile on a Commercial Social Media Platform.
(b) collect, process, store, or sell the personal data of a Child obtained through a Commercial Social Media Platform.
5. Age Verification & Compliance Mechanisms
(1) Every Operator must implement a reasonable age assurance mechanism for all users attempting to access their platform from within Greenwick. Approved mechanisms will be outlined in regulations set by the DSC and may include:
(a) Secure, privacy-preserving third-party verification services.
(b) Other methods deemed robust and minimally intrusive by the DSC.
(2) Operators must clearly state in their Terms of Service that access is prohibited for users under 13 within the Commonwealth of Greenwick.
6. Parental Responsibility & Education
(1) This Act does not criminalize a Child's attempt to access a platform. The primary legal duty rests with the Operator.
(2) The Ministry of Community & Family shall, in coordination with the Ministry of Education, launch a public information campaign, "Greenwick Grows First," to educate parents on the rationale of the Act and to promote safe, alternative activities for children.

PART 3: ADMINISTRATION & ENFORCEMENT
7. Appointment of Digital Safety Commissioner
(1) The Office of the Digital Safety Commissioner (DSC) is hereby established within the Ministry of Digital Governance.
(2) The DSC shall be responsible for:
(a) Maintaining a public register of Designated Exempt Services.
(b) Issuing compliance guidelines to Operators.
(c) Investigating credible complaints of violations.
(d) Imposing sanctions as per Section 8.
8. Penalties for Non-Compliance
(1) Upon first violation and following an investigation, the DSC may issue a Compliance Order and a fine not exceeding GWP 10,000 (Greenwick Pounds).
(2) For repeated or wilful violations, the DSC may:
(a) Impose a fine not exceeding GWP 50,000 per violation.
(b) Issue an order to internet service providers within Greenwick to block access to the non-compliant platform until the Commissioner certifies compliance.
(3) All fines collected shall be directed to the Youth Mental Health & Digital Literacy Fund.

PART 4: FINAL PROVISIONS
9. Review Clause
This Act shall be reviewed by a Select Committee of Parliament three (3) years after its commencement, assessing its impact on child well-being, technology adoption, and its efficacy.
10. Consistency with Other Laws
This Act is intended to operate concurrently with, and not override, any existing laws of the Commonwealth relating to privacy, child protection, or telecommunications, except where explicitly stated.
