Grand Duchy of Mabruenia Constitution
The people of Mabruenia, to form an adjusted country with the era's standards, will establish justice, give for the defense of the country, and improve the standard of life for the citizens involved, and secure our liberty. Do follow this constitution to the fullest, and establish this constitution for The Grand Duchy of Mabruenia.
Article 1: The Monarchy
Role of the Monarch: The monarch is the head of state and has limited government powers within the Grand Assembly and the parliament. The monarch has the power to dissolve parliament and do elections, if necessary. This power is only to be used in times of crisis, or, if the Parliament was to become too corrupt.
Lines of succession: Children born by biological means are the first, then if the current monarch has an adopted child only, biological siblings are second, and finally, it would be distant relatives. If there are no direct biological or adoptive heirs, then the throne would be given to a willing relative.
Regency: If the next monarch is not over 16, or if the current monarch is incapacitated, a trusted advisor would step in. The trusted advisor would be an individual closest to the family, or the monarch.
Article 2: Parliamentary Branch
The Parliamentary branch is what drafts and proposes laws, confirms or denies the monarch's picks for ministries and the prime minister, along with the supreme court.
Article 3: Grand Assembly
The Grand Assembly is what will carry out and enforce laws, this includes the monarch and the Prime Minister, advisory cabinet, ministries, and other institutions. Mabruenian citizens will have the right to vote in the prime minister and parliament through free, confidential ballots. The Prime Minister would be selected through elections within the Duchy, and the Advisory cabinet would consist of the Ministers for the ten ministries known as: Defense, Foreign Affairs, State Affairs, Agriculture, Navy, Education, Homeland Security, Development, Cybersecurity, Finance and culture.
Article 4: Judiciary Branch
The Judicial branch is what decides the constitutionality of parliamentary laws and resolves disputes about laws. However, judges depend on The Grand Assembly to enforce court decisions. Courts decide what really happened and what should be done about it. Judges are voted on by the citizens of Mabruenia.
Article 5: Citizenship
In order to gain citizenship in the Duchy, individuals would need to submit documents stating why they would want to become a citizen, as well showing a proof of ID and a legitimate passport from another nation. Citizenship is granted automatically by birth, and citizenship is only revoked in extreme situations, such as treason.
Article 6: Amendment Process
An amendment may be proposed by a two-thirds vote of both the Parliament and the Grand Assembly, or, if two-thirds of the county request one by a convention called for that purpose, the amendment must then be ratified by three-fourths of county legislators, or three-fourths of conventions called in each county. The leaders of the counties are the ones to call for amendment processes, if they so wish.
Article 7: Debts, Supremacy, Oaths, Religious Tests.
The Senators and representatives before mentioned, and members of several county legislatures, executive and Judicial offices, both of Mabruenia and several counties shall be bound by and oath of affirmation to support this constitution, but no religious tests shall ever be required as qualification to any office or public trust under the Mabruenian Duchy.
Article 8: Ratification:
The ratification of the four counties, shall be sufficient for the establishment of this constitution, between the counties so ratifying the same.
Bill of Rights
Amendment 1: Free speech, Free Assembly, and Freedom of Religion
Neither house of government shall restrict the freedom of speech, unless it is in times of war, or, it is supporting dictators, or it is used to cause insurrection. The government may not enforce or prohibit religion, and can not stop the assembly of individuals, unless in extreme circumstances.
Amendment 2: The Right to Bear Arms
Any individual once they turn 18 have the right to own small firearms for defense, however, background checks for violence and mental well-being shall be done.
Amendment 3: Quartering soldiers
No soldier shall in times of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner prescribed by law.
Amendment 4: The Right to privacy
No individual shall be forced to have their property taken or searched without a proper warrant from the authorities.
Amendment 5: Persecution
Serious crimes shall be done by A Grand Jury, individuals shall not be tried for the same crime twice, fair and speedy trials must be done
Amendment 6: Religion
1 Secular state:
The Grand Duchy of Mabruenia shall not have an official state religion. The government shall remain neutral in all religious matters, ensuring that no religious group is favored over another.
2 Freedom of Religion
All citizens of Mabruenia are guaranteed the right to freely practice, observe, and follow any religion of their choice, or none at all. No person shall be discriminated against based on their religious beliefs or practices.
3 Separation of Church and State
The government and religious institutions shall remain separate. Religious groups shall have no official role in the government, and governmental decisions shall be made independently of religious influence.
4 Religious Freedom in Education:
The state shall ensure that public educational institutions promote tolerance and understanding of different faiths but shall not endorse any particular religion.
