Matters of wide importance or those that are significant for principled reasons are decided by Curatorship (hereinafter - the Cabinet) in plenary meetings. A quorum of six Curators is required for a plenary meeting to be competent. The Grand Archon directs the activities of the Cabinet and oversees the preparation and consideration of matters within the Cabinet's mandate. Each Commissariat is headed by a Curator. The Cabinet of Ministers may issue Decrees if authorized by the Constitution or another Act. Ministers are responsible to the NLA for their actions in office. Every Curator who participates in the consideration of a matter at a Cabinet meeting is responsible for any decision made, unless they express an objection that is entered into the minutes.
The Grand Archon of the Sophrosynarchy is elected by a nation-wide vote for a term of two years, and is the formal head of state. Grand Archon must be at least 16 years old on the day of the election. The Grand Archon makes decisions on proposals submitted by the Cabinet or the National Legislative Assembly. If the Grand Archon does not approve a proposal, it is sent back for further work. The Grand Archon is informed of the Arch-Chancellors nominee by the National Legislative Assembly. The Grand Archon appoints other Curators based on the Arch Chancellor's proposal and vote results. The Grand Archon makes decisions on military appointments and military orders in conjunction with the Curator of the Commissariate of Defence and Attack.
The Commissariate of Defense and Attack serves as a critical institution within Hyacinthia's governance framework, tasked with the responsibility of defending the micronation and ensuring the security of its citizens. This ministry embodies our commitment to maintaining sovereignty and protecting its interests in a complex geopolitical landscape.
The primary function of the Commissariate of Defense and Attack is to develop and implement strategies for national defense. This includes assessing potential threats, formulating defense policies, and coordinating military operations to safeguard Inocria's territory and population. The ministry may oversee the establishment of a defense force or military unit, responsible for training personnel, conducting drills, and preparing for various scenarios that could threaten the security of the micronation.
In addition to its defensive role, the ministry's name suggests an active approach to addressing perceived threats or conflicts. The "Attack" component indicates that the ministry also can be involved in offensive operations if deemed necessary by the leadership or the citizens of the Nation. This could involve strategic planning for engagements with adversaries or other entities that pose a challenge to Inocria's autonomy and stability.
The judicial power is vested in a system of independent courts. The judiciary is responsible for interpreting the Constitution and other laws and for ensuring their fair application. The court system is structured to provide impartial justice, with judges being independent and subject only to the law. The independence of the judiciary is safeguarded to prevent political interference. The establishment of Magistrate Courts, which also created the Commissariate of Justice, marked a significant step in formalizing the judicial framework. These courts, along with the foundational legal documents like the Personal Data Protection Act and the Privacy and Home Security Act, form the legal basis for protecting citizens' rights and ensuring the rule of law. The court system is comprised of several tiers, each with distinct functions. The Supreme Court, Courts of Appeal, and Magistrate Courts serve as the general courts of law. Additionally, special courts may be established by law to handle specific fields of justice.
Supreme Court: The highest court in the land, it consists of a President and four additional Justices. The Supreme Court has the final say in civil, commercial, and criminal matters. Its judgments are conclusive and not subject to appeal. It also has the power to review whether the application of laws is consistent with the Constitution. No one under the age of 14 can be a Justice.
Magistrate Courts: These courts are established in each administrative region to handle minor civil and criminal matters. Their jurisdiction includes petty theft, minor assaults, and small-claims disputes. Magistrates are appointed by the Grand Archon based on recommendations from the Judicial Appointments Committee of the Supreme Court for one-year terms. Eligibility requires passing a bar exam.
A unique and significant part of the judiciary is the Court of Impeachment. This court has the authority to issue judgments in the first and final instance against members of all three government branches, who have committed unlawful conduct or breached their constitutional obligations. The court is composed of five Justices elected by the National Legislative Assembly for a term of two and a half years, and it is presided over by the Chief Justice of the Supreme Court.
While judges can be retired upon reaching their 80th year, they retain their full income. The constitution also mandates that all court proceedings should be public and oral to the widest extent possible.
The Commissariate of Ecology and Restoration was established as a dedicated governmental body focused on the preservation and protection of the natural environment. Recognizing the importance of ecological sustainability and the need to maintain the integrity of natural ecosystems, this ministry plays a crucial role in promoting environmental stewardship and responsible resource management.
