Welcome to GNZY™! These Terms & Conditions ("Terms") govern your access to and use of GNZY™ ("the App"), operated by
GNZY™ Technologies ("Company," "we," "us," "our," or "GNZY™"). By accessing or using GNZY™, you agree to comply with these Terms. If you do not agree with any part of these terms, please do not use the app. 

Overview

• This app is operated by GNZY Technologies. Throughout the app, the terms “we”, “us” and “our” refer to GNZY Technologies, and we offer this app, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

• By visiting our app and/ or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”, "Term & Conditions"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the app, including users who are browsers, vendors, customers, merchants, and/ or contributors of content.

• Please read these Terms of Service carefully before accessing or using our app. By accessing or using any part of the app, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the app or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

• Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the app following the posting of any changes constitutes acceptance of those changes.

1. Eligibility & Age Restrictions

Clause 1.1: Age Requirement

• You must be at least 13 years old to use GNZY™. If you are under 13, you are not permitted to access or register on the platform.
  
  

Clause 1.2: False Declaration

• Users who falsely declare their age to access the app in violation of these Terms may have their accounts suspended or terminated. 

2. Account Registration & Security

Clause 2.1: User Account 

• You must provide accurate and up-to-date information during registration. Providing false, misleading, or incomplete information may lead to account suspension.
  
  

Clause 2.2: Account Security 

• You are responsible for maintaining the confidentiality of your login credentials and for any activities that occur under your account.  
  
  

Clause 2.3: Unauthorized Use 

• If you suspect unauthorized access to your account, notify us immediately at support@gnzy.in. We are not liable for any loss or damage resulting from unauthorized account access.

3. General Conditions

Clause 3.1: Right to Refuse Service

• GNZY™ reserves the right to refuse service to any user, for any reason, at any time, without prior notice.
  
  

Clause 3.2: Data Transmission

• You understand that your content (excluding payment information such as credit/debit card details) may be transmitted unencrypted over various networks and may undergo modifications to meet the technical requirements of connected devices and networks. Payment information is always encrypted during transmission.
  
  

Clause 3.3: Prohibited Use of Service

• You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, use of the Service, or access to the Service via the GNZY™ app, without express written permission from GNZY™.
  
  

Clause 3.4: Clause Headings

• Clause titles and headings in this agreement are provided for convenience only and shall not affect the interpretation or enforcement of these terms.

4. Acceptable Use Policy

Clause 4.1: Fraudulent Activities

• Use the app for fraudulent activities, including fake orders, identity theft, or financial fraud.
  
  

Clause 4.2: Malicious Activities

• Engage in spamming, phishing, or malicious activities such as distributing malware or hacking GNZY™'s systems.
  
  

Clause 4.3: Inappropriate Content

Post, upload, or share harmful, misleading, or inappropriate content, including but not limited to:

• Hate speech, violence, threats, or harassment.

• Sexually explicit or adult content.

• Personal data such as phone numbers, addresses, or financial details in reviews or comments.

• False claims, defamatory remarks, or misinformation.
  
  

Clause 4.4: Software Tampering

• Attempt to reverse-engineer, decompile, or tamper with the app's software.

• In addition to all other restrictions outlined in these Terms and Conditions, you are strictly prohibited from using the GNZY™ app or its content for any of the following purposes:

(a) For any unlawful purpose;
(b) To solicit others to perform or participate in unlawful acts;
(c) To violate any applicable laws, regulations, rules, or ordinances at the international, national, state, or local level;
(d) To infringe upon or violate our intellectual property rights or those of others;
(e) To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
(f) To submit false, misleading, or fraudulent information;
(g) To upload or transmit viruses, malware, or any other form of malicious code that could affect the functionality or performance of the GNZY™ app, associated platforms, or the broader internet;
(h) To collect or track the personal information of other users without proper authorisation;
(i) To engage in spam, phishing, pharming, pretexting, scraping, crawling, or spidering activities;
(j) To use the Service for any obscene, vulgar, or immoral purpose;
(k) To interfere with or circumvent the security features of the GNZY™ app or related systems and technologies.

Clause 4.5: Enforcement

• GNZY™ reserves the right to suspend or terminate your access to the app or its services if you engage in any of the prohibited uses listed above.
  
  

Clause 4.6: Manipulative Practices

• Use automation tools, bots, or scripts to manipulate rankings, reviews, or engagement metrics.
  
  

Violations of this section may lead to account suspension, termination, or legal action.

5. User-Generated Content (UGC) & Moderation

Clause 5.1: Content Rights & License

• GNZY™ allows users to post reviews, ratings, and images. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display your content for operational purposes.
  
  

Clause 5.2: Prohibited UGC

You may not upload or share content that:

• Contains illegal, offensive, or misleading information.

• Violates third-party rights (e.g., copyrighted images, trademarks).

• Includes personal or sensitive information (e.g., phone numbers, email addresses).

• Is irrelevant, spam, or promotional in nature.

• GNZY™ reserves the right to moderate, edit, or remove content that violates these guidelines without prior notice.

6. Purchases, Payments & Refunds

Clause 6.2: Secure Transactions

• Transactions are securely processed via third-party payment providers. GNZY™ does not store credit card information.
  
  

Clause 6.3: Refunds & Returns

• Refunds are subject to the return policy of the respective seller.

• GNZY™ enforces a 24-hour return window unless otherwise specified by the brand.

• Refunds are processed within 7-10 business days once approved.

• GNZY™ is not responsible for disputes between buyers and sellers but may facilitate resolutions where possible.

7. Advertising & Third-Party Links

Clause 7.1: Sponsored Content

• GNZY™ may display advertisements or sponsored content. Advertisers are responsible for their content, and GNZY™ does not endorse or guarantee third-party products/services.

• You are responsible for reviewing the terms, policies, and practices of any third party before engaging in a transaction. Any complaints, claims, concerns, or questions related to third-party products or services should be directed to the respective third party.

13. Errors, Inaccuracies, and Omissions

Clause 13.1: Information Discrepancies

• Occasionally, the GNZY™ app may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, delivery times, or availability.

14. Account Suspension & Termination

GNZY™ reserves the right to suspend or terminate user accounts without notice if:

Clause 14.1: Violation of Terms

• The user violates any Terms & Conditions or policies.

Clause 14.2: Suspicious or Fraudulent Activity

• There is suspicion of fraudulent activity, unauthorised transactions, or misuse of GNZY™.
  
  

Clause 14.3: Harmful or Illegal Behaviour

• The user engages in harmful, disruptive, or illegal activities within the platform.
  
  

Users whose accounts are suspended or terminated may not create new accounts without prior approval.


Clause 14.4: Survival of Obligations

• Any obligations or liabilities incurred prior to the termination date shall survive the termination of these Terms and Conditions for all applicable purposes.
  
  

Clause 14.5: User-Initiated Termination

• You may terminate these Terms and Conditions at any time by ceasing to use the GNZY™ app and notifying us that you no longer wish to use our services.

15. Disclaimer of Warranties; Limitation of Liability

• GNZY™ does not guarantee, represent, or warrant that your use of the app will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained through the app will be accurate, reliable, or meet your expectations.
  
  

Clause 15.2: Service Interruptions and Modifications

• You acknowledge and agree that GNZY™ may suspend or discontinue the app or any part of the service at any time, for any duration, without prior notice.
  
  

Clause 15.3: Use at Own Risk

• Your use of, or inability to use, the GNZY™ app and services is at your sole risk. Unless expressly stated otherwise by GNZY™, all services and products offered through the app are provided "as is" and "as available," without any warranties or conditions of any kind—either express or implied—including but not limited to implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
  
  

Clause 15.4: Limitation of Liability

• In no event shall GNZY™, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, data loss, replacement costs, or similar damages arising out of your use of the app or any product or service obtained through the app.
  
  

Clause 15.5: Jurisdictional Limitations

• Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

GNZY™ is not liable for:

• Any losses, damages, or disruptions caused by third-party services, merchants, or payment providers.

• User reliance on product descriptions, reviews, or images.

• Unauthorized access to user accounts due to weak passwords or sharing of credentials.

16. Indemnification

Clause 16.1: Responsibility for Breach

• You agree to indemnify, defend, and hold harmless GNZY™, including its parent company, subsidiaries, affiliates, officers, directors, partners, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claims, demands, or liabilities—including reasonable attorney fees—arising from:
  (a) your breach of these Terms and Conditions or related documents,
  (b) your violation of any applicable law, or
  (c) your infringement of the rights of any third party.

17. Severability

Clause 17.1: Validity of Remaining Provisions

• If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law. The invalid or unenforceable portion shall be considered severed from the agreement and shall not affect the validity and enforceability of the remaining provisions.

18. Entire Agreement

Clause 18.1: Agreement Supremacy

• These Terms and Conditions, along with any policies or operating rules made available within the GNZY™ app, constitute the entire agreement between you and GNZY™ regarding your use of the app and its services. They supersede any prior or contemporaneous agreements, communications, or proposals—whether oral or written—between you and us.

• Failure by GNZY™ to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.

• Disputes shall first be attempted to be resolved amicably. If no resolution is reached, disputes shall be settled through arbitration in accordance with Indian Arbitration laws.
