These Terms of Use ("Terms") are an agreement between you and MD Developer Studio ("we", "us", "our") for your use of the GeoSnap: GPS Map Camera mobile application (the "App"). By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. ELIGIBILITY
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
2. LICENSE TO USE THE APP
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Android devices you own or control, for personal or internal business purposes, in accordance with these Terms and the Google Play Terms of Service. You may not copy, modify, distribute, sell, rent, reverse engineer, decompile or create derivative works of the App, except as allowed by law.
3. YOUR CONTENT
Photos you take and text you enter (notes, names, addresses) belong to you. They are stored on your device, and you are solely responsible for them, including how and with whom you share them. Remember that photos taken with the App show your location in the visible stamp and in the photo's embedded GPS data.
4. ACCURACY OF LOCATION, TIME, MAP AND WEATHER DATA
Location, address, altitude, compass, magnetic field, map and weather information comes from your device's sensors, GPS signal, network and third-party services. It may be inaccurate, delayed or unavailable because of signal quality, device settings, network conditions or errors from those services.
- The App is provided for general documentation and personal use only.
- Photos stamped by the App are NOT certified proof and are not guaranteed to be accepted as legal, official or evidentiary records.
- Do not rely on the App for navigation, emergency, safety-critical, surveying, legal or medical purposes.
5. MANUAL LOCATION AND EDITING
The App lets you enter or edit locations, addresses and other stamp details manually. You agree not to use this feature to deceive, mislead or defraud any person or organization, including by creating false attendance records, false work or delivery proof, false insurance claims, or any other false or misleading records. You are fully responsible for any consequences of such use.
6. ACCEPTABLE USE
You agree not to use the App to:
- break any applicable law or regulation;
- photograph or record people where they have a reasonable expectation of privacy, or without consent where consent is required by law;
- stalk, harass, track or conduct surveillance of any person;
- photograph restricted areas where photography is prohibited;
- infringe the intellectual property or other rights of others;
- interfere with, disrupt or attempt to gain unauthorized access to the App, its services or its advertising systems (including generating fake ad clicks or impressions).
7. ADVERTISEMENTS AND THIRD-PARTY SERVICES
The App is free and supported by advertising provided by Google AdMob. The App also relies on third-party services (such as Google Firebase, Google Play Services, geocoding, map and weather providers). We are not responsible for the content of third-party ads, websites or services, or for any transaction between you and an advertiser. Your use of third-party services is subject to their own terms and privacy policies.
8. IN-APP PURCHASES (IF OFFERED)
The App may offer optional paid features, such as removing ads. All purchases are processed by Google Play and are subject to Google Play's terms and refund policies. Prices may vary by country and may change. Purchases are linked to your Google account; if you reinstall the App, you can restore them using the same account.
9. UPDATES AND CHANGES TO THE APP
We may update, change, suspend or discontinue the App, or any feature, at any time. Some updates may be required to keep using the App. The App may prompt you to install updates through Google Play.
10. INTELLECTUAL PROPERTY
The App, including its design, code, templates, graphics, name and logo, is owned by MD Developer Studio and protected by intellectual property laws. Map data, weather data and other third-party content belong to their respective owners (for example, map data © OpenStreetMap contributors). Nothing in these Terms gives you any right to use our trademarks.
11. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT PHOTOS OR DATA WILL NEVER BE LOST. PLEASE KEEP YOUR OWN BACKUPS OF IMPORTANT PHOTOS.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MD DEVELOPER STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PHOTOS, PROFITS, BUSINESS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING RELIANCE ON ANY LOCATION, TIME, MAP OR WEATHER INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR INR 1,000, WHICHEVER IS GREATER.
13. INDEMNITY
You agree to indemnify and hold harmless MD Developer Studio from any claims, damages, losses and expenses (including reasonable legal fees) arising from your misuse of the App, your content, or your violation of these Terms or of any law or third-party right.
14. TERMINATION
You may stop using the App at any time by uninstalling it. We may suspend or end your right to use the App if you violate these Terms. Sections 3, 4, 5, 10, 11, 12, 13 and 15 continue to apply after termination.
15. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts at Surat, Gujarat, India. Nothing in this section removes any rights you have under mandatory consumer protection laws of your country of residence.
16. CHANGES TO THESE TERMS
We may update these Terms from time to time. Changes are effective when posted on this page with a new "Last updated" date. Continuing to use the App after changes means you accept the updated Terms.
