These Terms of Use apply to FitNote / Qingjian Note provided by Gong ChengYong (the "App"). Please read these Terms and the Privacy Policy carefully before using the App. By downloading, installing, accessing, or using the App, you agree to comply with these Terms.
If you do not agree with these Terms, please stop using the App.

The App provides food logging, food nutrition calculations, custom foods, weight logging, water logging, exercise logging, trend analysis, BMI and goal reference values, and App Store subscriptions or purchases. Some features may require a membership or in-app purchase.
The specific features of the App may change as versions are updated. We may add, modify, suspend, or discontinue some features within a reasonable scope.
The current version is designed for local storage. Food, weight, water, exercise, custom food, food photo, and profile data that you create or enter in the App is stored only locally on your device and is not uploaded to developer-operated servers. You are responsible for protecting your device, system account, backups, and data in the App.
Local data may be lost due to device damage, system reinstallation, app deletion, data clearing, backup failure, device migration issues, or other events outside our control. Except as required by applicable law, we are not responsible for data loss or indirect losses caused by such events.
Food nutrition data, calorie estimates, BMI, goal reference values, trend analysis, water records, and exercise calorie estimates provided by the App are for personal daily tracking reference only. The local food databases bundled with the current app version are provided only as references for logging and nutrition calculations, and may not cover every country, region, brand, restaurant, cuisine, or local food name. For regions or foods that are not covered, you may use general food data as a reference or manually add records through custom foods.
These data and results may be inaccurate or incomplete because of food brand, origin, processing, cooking method, entry accuracy, device records, and personal settings.
You understand and agree that:
The App is not a professional service and is not intended for clinical judgment, emergency assistance, professional equipment monitoring, or on-site handling.
The App does not promise any weight change, training effect, diet effect, or body result.
You should use information shown in the App carefully based on your own circumstances, and except where prohibited by law, you are responsible for the risks arising from diet, exercise, weight goals, or other lifestyle arrangements you make based on that information.
If you need individualized diet, training, or body condition assessment, please obtain services from an appropriately qualified offline professional.
When using the App, you must comply with applicable laws and must not:
Use the App for illegal, infringing, fraudulent, or abusive purposes.
Reverse engineer, crack, bypass subscriptions or paid limits, or interfere with App Store transaction verification.
Upload, store, or distribute content that infringes others' rights or is illegal or inappropriate.
Use automation, attacks, tampering, or other methods to disrupt the App, device systems, or third-party services.
Use the App for clinical judgment, emergency assistance, or other situations that require professional equipment and on-site handling.
The App may offer paid items such as monthly membership, annual membership, and lifetime membership. Actual product names, prices, trials, promotions, renewal periods, and availability are shown in the App Store.
Monthly and annual memberships are usually auto-renewable subscriptions. After purchase confirmation, payment is charged to your Apple ID account.
Subscriptions renew automatically under App Store rules unless you cancel as required by Apple before the end of the current period.
You can manage or cancel subscriptions in the App Store or Apple ID account settings.
Lifetime membership is usually a one-time purchase and does not automatically renew. It applies to the membership features currently supported by the App, but does not mean that we must provide all future features, external services, or separate products permanently.
Purchase failures, purchase restoration, refunds, subscription cancellation, family sharing, and billing disputes are usually handled by Apple under App Store rules.
If product information fails to load, the network is unavailable, or transaction status cannot be confirmed, you can try again later or use "Restore Purchases."
Except as required by applicable law or App Store rules, refunds for completed purchases or subscriptions are handled by Apple under Apple's policies.
The App's software, interface design, icons, text, feature structure, database organization, algorithm expressions, and other content are protected by intellectual property laws, except for third-party open-source libraries, public data sources, or content otherwise stated.
You receive only a limited, non-exclusive, non-transferable, revocable license to use the App under these Terms. Without authorization, you may not copy, modify, distribute, rent, sell, publicly communicate, reverse engineer, or otherwise exploit all or part of the App.
Personal records, food photos, and custom food content that you enter or add in the App remain your responsibility. You must ensure that you have the right to use that content.
The App may use Apple App Store, StoreKit, Apple HealthKit, system photo library capabilities, open-source libraries, and public or licensed food nutrition data sources. Third-party services and data sources are provided by their respective third parties and may be subject to their own terms and policies.
We make reasonable efforts to display data sources and keep features stable, but we do not guarantee that third-party services, product information, system permissions, Apple Health active energy access, or food data will always be accurate, complete, continuously available, or suitable for your specific purpose.
We may change, interrupt, or terminate part or all of the App's features due to version updates, maintenance, compliance requirements, system limitations, business adjustments, force majeure, or similar reasons.
If you violate these Terms, or if we reasonably believe that your use may create risk, violate law, or infringe others' rights, we may restrict or terminate your access to relevant features to the extent permitted by applicable law.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, completely secure, completely accurate, or meet your specific needs.
Except where prohibited by law, we are not liable for indirect, incidental, special, punitive, or consequential damages arising from use or inability to use the App, reliance on information shown in the App, data loss, device failure, third-party services, App Store transactions, system permissions, or network issues.
In all cases, our total cumulative liability to you will not exceed the amount you actually paid for the App during the twelve months before the dispute arose, or the minimum limitation permitted by applicable law, whichever is higher.
We process information related to the App in accordance with the Privacy Policy. Please read the Privacy Policy to understand what information the App processes, how information is used, system permissions, third-party services, and your choices.
If you are a minor, you should use the App with consent and guidance from a parent or guardian. Parents or guardians should help minors understand these Terms, the Privacy Policy, and the limits of the App's tracking and estimate results.
The formation, validity, performance, and interpretation of these Terms are governed by applicable laws related to the service provider's location or as permitted by conflict-of-law rules. If a dispute arises, the parties should first try to resolve it through friendly negotiation. If negotiation fails, either party may seek resolution from a court or authority with jurisdiction.
If mandatory consumer protection laws in your region provide otherwise, those mandatory rights are not limited by these Terms.
We may update these Terms due to feature, legal, or operational changes. When updated, the new effective date will be shown in the App, release page, or another reasonable location. Your continued use of the App after an update means you accept the updated Terms.
