TERMS OF SERVICE

SECTION 01 - CONTRACTUAL AGREEMENT AND SCOPE
These Terms of Service ("Terms") form a legally binding agreement between you ("User," "player," or "your") and Andrew Chapman, operating as the independent developer under the creative name Zapish Interactive ("Developer," "we," "us," or "our"). Certain development, hosting, and platform accounts are managed with the assistance and authorization of Ann Chapman. These Terms govern your download, installation, access, use, and updates of the Virtual Reality application known as Funny Chimps, including its software, assets, servers, matchmaking, and official channels (collectively, the "Game").
By holding the "A" button on your controller when prompted upon first joining the Game, or when prompted after a Terms of Service or Privacy Policy update, you confirm that you have read, understood, and agree to be bound by these Terms and the Funny Chimps Privacy Policy, which is incorporated by reference. Downloading, installing, launching, or continuing to use the Game after such acceptance also constitutes agreement. If you are accepting these Terms on behalf of a minor, you accept full responsibility for that minor's compliance and conduct. If you do not agree to these Terms, you must not use the Game and must delete it from your device.
SECTION 02 - ELIGIBILITY AND AGE REQUIREMENTS
The Game is intended for users who are at least thirteen (13) years of age. By using the Game you represent that you meet this age requirement. Users under 13 are prohibited from accessing the Game or its multiplayer and voice features. If the Developer reasonably determines that an account belongs to a user under 13, access may be restricted or terminated. Parents or guardians of users aged 13 to 17 are responsible for supervising use of the Game and ensuring compliance with these Terms.
SECTION 03 - LIMITED LICENSE
Subject to your ongoing compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, personal license to download, install, and use the Game on an authorized Virtual Reality device solely for your personal, non-commercial entertainment. The Game is licensed, not sold. You acquire no ownership rights in the Game or its content. All rights not expressly granted are reserved by the Developer.
SECTION 04 - PROHIBITED USES
You may not, and may not permit others to:
- Commercially exploit the Game, including renting, leasing, selling access, or charging fees for use.
- Modify, adapt, translate, create derivative works from, or redistribute the Game or its assets.
- Reverse engineer, decompile, disassemble, or attempt to extract source code, except to the limited extent permitted by applicable law.
- Circumvent, disable, or interfere with any digital rights management, security, store validation, or anti-cheat measures.
SECTION 05 - INTELLECTUAL PROPERTY
All rights, title, and interest in the Game and its content (including code, models, textures, animations, audio, music, user interface, logos, and other materials) are owned by the Developer or its licensors and are protected by copyright, trademark, and other laws. You may not remove, alter, or obscure any proprietary notices.
SECTION 06 - THIRD-PARTY INTELLECTUAL PROPERTY AND PLATFORM REFERENCES
Funny Chimps is an independent project. Any references to third-party platforms, trademarks, or concepts (including those of Meta Platforms, Inc. or other companies) are for compatibility, descriptive, or fair-use purposes only. The Developer claims no ownership of or affiliation with any third-party intellectual property. All such rights remain with their respective owners.
SECTION 07 - THIRD-PARTY PLATFORMS AND SERVICES
The Game relies on third-party services, including the Meta Horizon Store, Unity runtime, Microsoft PlayFab, and Photon networking. Your access may depend on your standing with those services. The Developer does not control and is not responsible for the availability, terms, privacy practices, or performance of third-party platforms. Interruptions or account actions by those platforms may affect your ability to use the Game.
SECTION 08 - USERNAMES AND ACCOUNT RESPONSIBILITY
Online play requires a username linked to your platform account or generated in the Game. You are responsible for activity under your username and for keeping your device secure. Usernames must not:
- Impersonate the Developer, staff, or any real person or organization.
- Suggest false affiliation with Zapish Interactive.
- Contain hate speech, slurs, sexual content, threats, or other prohibited material.
- Infringe trademarks or disclose private personal information.
The Developer may change, reset, or block any username that violates these rules or is otherwise disruptive.
SECTION 09 - COMMUNITY CONDUCT STANDARDS
You agree to behave respectfully when using the Game, its multiplayer features, voice chat, or related community channels. The following conduct is prohibited:
1. Harassment or bullying of any player.
2. Hate speech or discrimination based on protected characteristics.
3. Credible threats of violence or encouragement of violence.
4. Sexually explicit communication or sexual harassment.
5. Sharing or soliciting private personal information (doxxing) without consent.
6. Using the Game to promote illegal or dangerous activity.
7. Disruptive voice behavior such as intentional screaming, feedback, or noise.
8. Abusive use of soundboards or repeated audio clips intended to disturb others.
9. Repeated unwanted physical interaction with another player's avatar after being asked to stop.
10. Persistent following or pursuit after a clear request to stop.
11. Impersonation of the Developer, staff, or other players for deceptive purposes.
12. Falsely claiming moderation or developer authority.
13. Usernames designed to impersonate staff or create false affiliation.
14. Inappropriate usernames containing prohibited content.
15. Intentionally obstructing essential areas such as doorways or spawns.
16. Repeated unwanted physical interference with another avatar, including pushing, grabbing, launching, or similar conduct.
17. Repeated emote use directed at a player for harassment after being asked to stop.
18. Recording or streaming another player primarily to humiliate or harass them.
19. Spreading materially false information about the Game or its staff with the intent to cause harm or disruption.
20. Unauthorized advertising or solicitation.
21. Pressuring others for personal information, photos, passwords, financial details, or other sensitive information.
22. Pressuring others into real-world meetings or unwanted offline contact.
23. Evading moderation actions through alternate accounts or technical means.
24. Knowingly submitting false or intentionally misleading reports.
25. Organizing or participating in coordinated harassment.
26. Using Game channels to pressure players into joining external groups, communities, servers, or services against their wishes.
27. Abusing social or physics features to repeatedly disrupt other players.
28. Encouraging or assisting others to violate these standards.
29. A pattern of disruptive conduct that substantially interferes with another person's enjoyment of the Game or community.
30. Continuing prohibited conduct after a reasonable request to stop.
31. Manipulating, coercing, intimidating, guilt-tripping, threatening, or otherwise pressuring another person into taking an action they do not freely wish to take.
32. Pressuring, manipulating, or repeatedly requesting a Developer, administrator, moderator, or other staff member to grant, change, remove, restore, or otherwise alter a rank, role, permission, punishment, decision, privilege, or other staff-controlled outcome.
33. Attempting to obtain a staff position, rank, role, permission, promotion, special treatment, or other privilege through manipulation, persistent pressure, threats, harassment, guilt-tripping, bribery, favoritism, deception, or coordinated pressure from other users.
34. Threatening to leave, cause disruption, expose private information, damage the Game, harm the community, or take other adverse action for the purpose of pressuring someone into granting a requested role, rank, permission, or decision.
35. Repeatedly contacting or approaching a staff member about a decision after the staff member has reasonably indicated that the matter is closed, unless a legitimate appeal or review process is available.
36. Encouraging, organizing, or directing other users to pressure, manipulate, harass, threaten, or repeatedly contact a staff member on a person's behalf.
37. Using friendships, personal relationships, popularity, donations, contributions, community status, or other social influence to improperly pressure staff into providing a rank, role, privilege, or favorable decision.
38. Misrepresenting a staff member's statements, promises, authority, or decisions in order to obtain a role, privilege, punishment reversal, or other benefit.
39. Retaliating against a person because they refused a request, declined to grant a role or privilege, reported misconduct, participated in moderation, or otherwise exercised their rights under these Terms.
40. Attempting to circumvent a staff decision by repeatedly asking different staff members until receiving the desired answer, where such conduct is intended to pressure staff rather than use an established appeal or review process.
41. Any other conduct that constitutes coercion, manipulation, intimidation, or improper pressure against another person, including staff members.
Ordinary requests, applications, appeals, feedback, disagreement, negotiation, or respectful questions are not prohibited merely because they involve asking for a different outcome. A user may respectfully request a promotion, role, review, appeal, or reconsideration, provided that the request is made voluntarily and without harassment, coercion, manipulation, threats, or repeated unwanted pressure.
Enforcement: The Developer and designated moderators may issue warnings, temporary restrictions, mutes, session removals, suspensions, or permanent bans based on the severity, frequency, intent, and impact of the conduct. Enforcement decisions are made at the Developer's reasonable discretion. The list above is not exhaustive. Conduct that is abusive, threatening, disruptive, unsafe, coercive, manipulative, or inconsistent with a safe community may also result in action. These rules do not prohibit ordinary discussion, criticism, feedback, disagreement, or good-faith requests that do not otherwise violate these standards.
SECTION 10 - STAFF CONDUCT AND RESPONSIBILITIES
For purposes of this Section, "Staff" includes Developers, Administrators, Moderators, Community Managers, and any other person granted official authority or moderation responsibilities within the Game or its official community spaces.
Staff members are expected to exercise their authority responsibly, consistently, and in good faith. Staff members must not use their position to improperly intimidate, manipulate, threaten, exploit, or pressure users.
Staff members may not:
1. Abuse or intentionally misuse their moderation permissions.
2. Threaten a user with punishment solely to obtain personal favors, information, money, services, or other unrelated benefits.
3. Use staff authority to pressure users into friendships, relationships, external communities, private communications, real-world meetings, or other activities unrelated to legitimate Game or community purposes.
4. Demand passwords, authentication codes, payment information, or other sensitive credentials.
5. Reveal or misuse private information obtained through legitimate moderation activities.
6. Falsely claim authority, permissions, evidence, or instructions that they do not possess.
7. Manipulate moderation records, reports, evidence, logs, ranks, or other administrative information for personal benefit or to improperly target another person.
8. Retaliate against a user for submitting a good-faith report, appeal, complaint, suggestion, or criticism.
9. Grant or remove roles, ranks, permissions, punishments, or privileges in exchange for personal favors, money, gifts, social benefits, or other improper consideration.
10. Intentionally create or participate in conflicts of interest that compromise the fair administration of the community.
11. Use their staff position to obtain personal information or access that is not reasonably necessary for their assigned responsibilities.
12. Coordinate with other staff or users to improperly target, harass, silence, intimidate, or exclude another person.
13. Use moderation powers to settle personal disputes unrelated to legitimate community enforcement.
14. Pressure another staff member or Developer into changing a moderation decision, granting a role, or providing a privilege through threats, manipulation, intimidation, or other improper conduct.
Staff members may respectfully disagree with one another and may request reviews of decisions through appropriate internal channels. Good-faith discussion, recommendations, appeals, and requests for clarification are permitted.
Staff status does not exempt a person from these Terms. Staff members remain subject to the same community standards as other users, in addition to the responsibilities contained in this Section.
The Developer may remove, restrict, suspend, or terminate a person's staff permissions at any time where the Developer reasonably determines that the person has violated these standards, abused their authority, created a significant conflict of interest, or otherwise failed to meet the responsibilities associated with their position.
Nothing in this Section guarantees any particular staff position, rank, promotion, permission, or continued appointment. Staff appointments and permissions remain subject to the Developer's discretion and applicable community procedures.
SECTION 11 - ANTI-CHEAT AND TECHNICAL INTEGRITY
You must use only official, unmodified builds of the Game obtained through authorized storefronts. You may not create, distribute, or use cheats, hacks, aim assistance, wall-hacks, speed modifications, memory editors, or any tools that provide unfair advantages. You may not deliberately exploit bugs for unfair gain. If you discover a significant security vulnerability or severe bug, please report it privately to zapishvr@gmail.com rather than exploiting or publicly disclosing it.
SECTION 12 - SERVER AND INFRASTRUCTURE SECURITY
You may not attack or attempt to compromise the Game's servers or backend systems. Prohibited activities include distributed denial-of-service attacks, injection of malicious code, unauthorized access to developer tools or accounts, and interception or scraping of network traffic for the purpose of mapping or attacking the service.
SECTION 13 - MODERATION AND ENFORCEMENT
The Developer and designated moderators may review reports and take action including voice mutes, username changes, temporary suspensions from matchmaking, or permanent removal from multiplayer servers. Enforcement is exercised at the Developer's reasonable discretion based on the circumstances. While the Game is provided free of charge, the Developer will generally act in good faith. Permanent bans are typically final, though the Developer may review appeals at its sole discretion when appropriate. The Developer is not obligated to provide detailed evidence in every case in order to protect reporting players.
SECTION 14 - VIRTUAL CONTENT AND PROGRESS
Virtual items, cosmetics, avatars, ranks, statistics, levels, and achievements have no real-world monetary value, cannot be redeemed for cash or physical goods, and may not be traded outside the Game. The Developer may modify, balance, replace, reset, or remove any virtual content or progression data at any time without liability.
SECTION 15 - UPDATES
The Developer may release patches, hotfixes, content updates, and other changes. Some updates may be required to continue accessing multiplayer features. The Developer does not guarantee that any particular feature, map, mechanic, or setting will remain available in future versions.
SECTION 16 - AVAILABILITY
Multiplayer features require an internet connection. The Developer does not guarantee uninterrupted, error-free, or latency-free service. Servers may experience planned or unplanned downtime due to maintenance, updates, technical issues, third-party outages, or other causes.
SECTION 17 - DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE DEVELOPER DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. THE DEVELOPER DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY DEVICE, OR THAT ANY DATA WILL BE PRESERVED.
SECTION 18 - LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER (ANDREW CHAPMAN), ANN CHAPMAN, AND THEIR CONTRIBUTORS, MODERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE GAME. THIS INCLUDES CLAIMS RELATED TO DEVICE DAMAGE, SYSTEM CRASHES, DATA CORRUPTION, HEADSET OVERHEATING, MOTION SICKNESS, SEIZURES, DISORIENTATION, TRIPPING OR OTHER PHYSICAL INJURY OR DISCOMFORT WHILE USING VR, OR SERVER COSTS. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE) AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Developer (Andrew Chapman), Ann Chapman, and their contributors and moderators from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the Game, your submission of prohibited content, or your infringement of any third-party rights.
SECTION 20 - SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed. The remaining provisions will continue in full force and effect.
SECTION 21 - GOVERNING LAW AND VENUE
These Terms and any dispute arising from them or from your use of the Game are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that the exclusive venue for any legal proceedings shall be the courts located in Nanaimo, British Columbia, Canada.
SECTION 22 - TERMINATION AND CHANGES
You may terminate this agreement at any time by uninstalling the Game and deleting related data. The Developer may modify these Terms at any time. When material changes are made, the "Last Updated" date will be revised and you will be prompted to accept the updated Terms by holding the "A" button on your controller. Your acceptance of the prompt, or continued use of the Game after the update, constitutes agreement to the revised Terms. The Developer may also suspend or terminate your access for violation of these Terms or for any other reason at its reasonable discretion.

By holding the "A" button on your controller when prompted upon first joining or after a Terms of Service or Privacy Policy update, or by continuing to use the Game after such a prompt, you acknowledge that you have had the opportunity to read and understand these Terms of Service and the Privacy Policy and agree to be bound by them.
