SECTION 01 - INTRODUCTION AND RELATIONSHIP DEFINITIONS
Welcome to Funny Chimps. This Privacy Policy ("Policy") governs the collection, storage, processing, transfer, maintenance, and disposal of information by Andrew Chapman, the independent software developer operating under the non-registered creative moniker Zapish Interactive ("the Developer," "we," "us," or "our"). Because the Developer operates as an unregistered entity, all development pipelines, software deployments, and platform accounts are hosted and legally owned via authorized parent/guardian verifications through Ann Chapman. This Policy applies strictly to the Virtual Reality mobile application package known as Funny Chimps, along with all associated software builds, assets, server communication frameworks, matchmaking features, and localized support services (collectively, "the Game").
By accessing, downloading, installing, configuring, launching, or playing the Game, you ("the User," "player," or "your") explicitly acknowledge that you have read, understood, and agreed to be bound by the data handling practices described in this Policy. If you do not agree with any provision contained within this document, you must immediately halt installation, delete the application binary from your Virtual Reality device, and refrain from accessing our services.
SECTION 02 - SCOPE AND LEGAL BASIS FOR DATA PROCESSING
We operate under a strict philosophy of data minimization. We only authorize the processing of information that is technically required to establish stable multiplayer connections, authenticate player states, maintain accurate save profiles, and protect the community from cheating. The legal bases for processing data under regional regulations (including Canadian privacy frameworks and global data standards) include:
a) The execution of the contract established under our Terms of Service.
b) Legitimate interests in protecting the security, integrity, safety, and stability of our game servers.
c) Compliance with statutory legal obligations or technical parameters dictated by third-party distribution platforms.
SECTION 03 - CATEGORIES OF INFORMATION WE PROCESS
The data processed during your use of the Game falls into three distinct operational categories:
A) Information Provided Directly by the User
- Support Communications: When you contact us directly via our support channel (zapishvr@gmail.com) for technical troubleshooting, bug reporting, or feature feedback, we collect your email address, your chosen display name, and the complete contents of your message, including any attached text, logs, or screenshots.
- User-Selected Identity Data: Any profile names, custom clan tags, or textual strings you input directly into text fields provided within the Game interface for local or online identification.
B) Information Collected Automatically via Runtime Execution
- Hardware and Device Metrics: To optimize rendering performance and maintain frame rate targets, the software automatically queries your hardware ecosystem. This includes your specific Virtual Reality headset model (e.g., Meta Quest 2, Meta Quest 3, Meta Quest Pro), operating system build version, GPU/CPU architecture, battery status, and active refresh rate.
- Technical Logs and Core Telemetry: In the event of an application crash or frozen frame state, the application generates a runtime debug file. This includes system memory status at the time of failure, lines of code that failed to execute, and device thread logs.
- Network and Routing Data: To route network packets during multiplayer matches, our system recognizes your Internet Protocol (IP) address. This data is used to estimate your approximate geographical region (country and city level) to connect you to the closest available regional server hub.
- On-Device Voice Recording for Moderation: For voice moderation purposes, the Game records audio from your device’s microphone locally on your headset. This recording occurs only on your device. The only data that may be sent from your device to our servers is a text transcript of what you said, and only if that speech is determined to have violated our Terms of Service or contained a slur. No raw audio recordings are transmitted to or stored on our servers.
C) Information Inherited from Third-Party Integrations and SDKs
The Game does not utilize independent, custom-built databases to store personal identities. Instead, the Game links directly into foundational industry SDKs. These companies process data under their own corporate privacy policies:
- Meta Store Ecosystem: Meta provides an anonymized Meta User ID, your public Oculus/Meta platform profile name, active language preferences, and your platform-certified age group classification to authenticate your license to play.
- Unity Engine: The runtime engine collects baseline software analytics, hardware installation identifiers, and hardware performance metrics necessary to execute the graphics API.
- PlayFab (Microsoft): Acts as our cloud-save and profile manager. PlayFab securely processes your platform-linked player ID, internal inventory states, progression metrics, custom room configurations, and ban history records.
- Photon Engine (Exit Games): Facilitates real-time multiplayer networking. Photon processes your temporary IP address, player tracking strings, and real-time Voice-over-IP (VoIP) audio streaming packets to make multiplayer interaction possible. Note that any moderation-related transcripts (as described above) are handled separately from Photon’s real-time VoIP streaming.
SECTION 04 - THE EXPLICIT PROHIBITION OF DATA SELLING AND RENTING
The Developer states clearly and unequivocally: We do not sell, rent, lease, trade, monetize, or distribute your personal data, email addresses, usernames, or device identifiers to third-party advertising companies, brokers, or data harvesters. All data handling is restricted to game execution, platform compliance, and safety moderation.
SECTION 05 - PURPOSES OF PROCESSING DATA
Your data is used exclusively for the following operational workflows:
- To initialize, launch, update, and maintain the functionality of the game binary.
- To display your username correctly to other online players during multiplayer matches.
- To handle real-time voice streaming, network syncing, and position data across Photon servers.
- To perform on-device voice moderation by recording microphone audio locally on your device and, only when necessary, transmitting a text transcript to our servers if the speech violated our Terms of Service or contained a slur.
- To read crash reports to push patches, security updates, and performance optimizations.
- To track player reports and flag accounts violating community guidelines to issue bans.
- To verify identity when processing data deletion requests.
SECTION 06 - THIRD-PARTY DATA DISCLOSURE AND TRANSFER RECOGNITION
Information is only disclosed to external entities under the following conditions:
- Operational Necessity: Data is continuously transmitted to our cloud architecture partners (Unity, PlayFab, Photon, Meta) to allow the game to function online.
- Statutory Legal Compliance: We reserve the right to disclose available technical identifiers if required by a court order, law enforcement warrant, or valid legal demand under Canadian federal law.
- Safety and Liability Defense: We may share available telemetry data if necessary to detect, prevent, or address software piracy, severe community threats, malicious server attacks, or to protect the safety of our players.
SECTION 07 - INTERNATIONAL DATA TRANSFERS AND REGIONAL RECOGNITION
Because the infrastructure of our third-party service providers is hosted across global data center networks, your game telemetry and network routing data will be transferred out of your local province or country. Data may be stored, cached, or processed on servers situated in Canada, the United States, and the European Union. By playing the Game, you acknowledge that privacy laws vary by jurisdiction and that data stored abroad may be accessible to foreign regulatory bodies under local legal processes.
SECTION 08 - COMPREHENSIVE DATA RETENTION AND PURGING MECHANISMS
We retain your game progression states, username records, and ban logs for as long as your player account remains active within the PlayFab backend ecosystem. If a player profile remains completely inactive for an extended period, or if the underlying project is discontinued, we reserve the right to delete, scrub, or completely anonymize the associated database records without prior notice. Any moderation transcripts that are transmitted are retained only as long as necessary for safety enforcement and are then deleted or anonymized in accordance with our retention practices.
SECTION 09 - MANDATORY MANDATE: COMPLIANCE WITH CHILDREN'S PRIVACY LAWS
Funny Chimps is developed, coded, marketed, and distributed exclusively for an audience aged thirteen (13) years or older. The Game integrates advanced multiplayer networking, spatial tracking, and voice-communication features that do not support automated, programmatic filtering or compliance toggles for children under 13.
We do not knowingly query, collect, aggregate, or retain data from children under the age of 13. If you are under 13, you are legally forbidden from installing or playing this software. If a parent, legal guardian, or community moderator discovers that an individual under 13 has bypassed our store warnings and created a player profile, please contact us immediately at zapishvr@gmail.com with the subject line "Children's Privacy Alert." Upon verification, we will permanently delete all associated database nodes and block the device identifier from creating future accounts.
SECTION 10 - DATA SECURITY LIMITATIONS AND END-USER ACKNOWLEDGMENT
We employ industry-standard administrative, physical, and technical safeguards built into our cloud providers to shield data from unauthorized interception, loss, encryption modification, or exposure. Despite these efforts, no digital security network, internet routing path, or server cloud can be guaranteed to be completely impenetrable. The Developer cannot promise absolute immunity from cyberattacks, server breaches, or unauthorized third-party tracking. Any transmission of information during gameplay is done at your own risk.
SECTION 11 - YOUR EXPLICIT RIGHTS AND DATA MANAGEMENT OPTIONS
All Users have the right to request access to, correction of, or deletion of personal data associated with their Funny Chimps account, regardless of geographic location or whether such rights are specifically granted by applicable local privacy law.
- The Right of Access: You may request a summary of the personal data associated with your player profile.
- The Right of Correction: You may request correction or updating of inaccurate account information, usernames, or profile settings where technically supported.
- The Right of Deletion: You may request deletion of personal data associated with your Funny Chimps account. This deletion option is available to all Users and is not restricted to Users who are located in jurisdictions that provide a statutory right of erasure.
To request access, correction, or deletion of your data, contact us at zapishvr@gmail.com with the subject line "Data Privacy Request." Your request may be submitted at any time and without charge.
For security purposes, we may require reasonable verification that the request relates to the account or data belonging to the requesting User before processing the request. Verification will use information reasonably necessary to identify the relevant account and will not require you to provide unnecessary sensitive information.
When a valid deletion request is received and verified, we will delete or anonymize the applicable personal data from systems under our control within a reasonable period, subject to data that we are legally required to retain, data necessary to establish, exercise, or defend legal claims, or limited records that must be retained for security, fraud prevention, or enforcement purposes. Where applicable, information held by third-party service providers such as Meta, PlayFab, Photon, or Unity may be subject to their respective deletion procedures and privacy policies.
Deleting your data may result in the permanent loss of your Funny Chimps account, progression, inventory, settings, moderation history, or other account-associated features, and deleted data may not be recoverable.
If you request deletion of your account or personal data, we will not require you to continue using the Game as a condition of submitting or processing that request.
SECTION 12 - INDEPENDENT UPDATES TO THIS PRIVACY POLICY
The Developer reserves the right to revise, modify, rewrite, or update this Policy at any time to account for game updates, engine upgrades, shifts in legislation, or policy revisions mandated by Meta. Any adjustments will be noted by modifying the "Last Updated" timestamp at the header of this document. Your continued installation, launch, and usage of the Game following the publication of an updated Policy constitutes an explicit acknowledgment of the revised data management practices.
