A 2016 Univision data report states that more than nine out of ten children without legal counsel in immigration court are deported, whereas nearly half of those who have a lawyer are allowed to remain. Unfortunately, under US law, children arrested for illegally entering the country don’t have the right to demand a court-appointed lawyer or interpreter.
Lindsay Toczylowski, executive director of Immigrant Defenders Law Center in Los Angeles told the Texas Tribune:

On July 12, 2025, @volpinalex documented "ICE marching shackled and cuffed CHILDREN into vans in DTLA's federal building."
In this video, we see children cuffed at the hands and shackled at the feet as they awkwardly walk to be packed into a transport van.
Are these children, who are likely terrified at this time, the criminals that are the ones we are to be so scared of, and that is why they are shackled? Horse shit! Likely, this is the beginning of the decomposition of birthright citizenship and naturalization.
It is important to remember that this is not the first time we are seeing children in this position.
“We were representing a three-year-old in court recently who had been separated from the parents. And the child — in the middle of the hearing — started climbing up on the table. “It really highlighted the absurdity of what we’re doing with these kids.”
But the children being detained under the “zero tolerance” (or "no amnesty") policy are facing immigration proceedings without their parents by their side.
